Consultants, L.L.C. (Engineer) made and entered into City Secretary Contract No. 28369, (the Contract) which was authorized by the City Council by M&C C-19439 on the 21 day of January; 2003; and WHEREAS,the Contract involves engineering services for the following project: Water and Sanitary Sewer Replacement Contract 2001 WSM-E WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated April 24, 2006, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total$4,124.00 (Water Cost; $2,062: TPW cost; $2,062 (GS93-020930522930)) 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $77,935.00 05-08-06 P01 :59 IN 3. No. 3383, 3384 and 3385 Mr. Sauceda, During a meeting held at the water department engineering department with Tony Sholola,Jim Deeter and Abe Calderon on March 28,2006 it was decided to combine WSM-E plans with WSM-K plan set.ANA Consultants agreed to absorb the cost of changing sheet numbers at no cost to the city only as a way to give the city a neat and orderly set of plans that reflects positively on the city as well as ANA Consultants. However, tasks required to combine the plans for advertisement and future deliverables requires additional expenditure of WSM-E contract funds on our part. WSM-E final plans were submitted to the city on August 26, 2003 and again on November 23,2004 both times with different Mylar cover sheets for signatures, cost estimates and specifications. These two final plan submittals were delayed due to city funding constraints. CLIENT SATISFACTION IS OUR BUSINESS Amedment-1 4-17-06 CONSULTANT=. _ Amendment No. 1: Page 3 of 4 At the request of the City, ANA Consultants has been requested to provide curb, gutter and driveway design services for WSM-E streets impacted by water and sewer construction, we would be unable to provide this service under the existing contract scope. The requested services represent a change in scope that is not covered by our current contract and therefore our insurance company will not cover the requested services without an amendment adding the change in scope to our contract. This request for additional services is not part of our existing WSM-E contract and will exceed our current scope. ANA Consultants, L.L.C. is recommending that our current contract be amended to include these additional services as well as the corresponding fee adjustments. ANA Consultants will provide the requested additional services for the amount indicated below. • Provide Curb Grade and Driveway Design: Hulen Street from Camp Bowie Blvd to Crestline Road Hulen Street 1,352 If Total linear footage 1,352 If @ $3.05/If= $4,124.00 TOTAL LUMP SUM AMENDMENT No. 1 $ 4,124.00 The above design fee does not include any street drainage calculations, storm drain analysis or additional design services outside street curb line or driveway approaches.Also not included are any walk replacement or additions,wheelchair ramp locations, pavement design, specifications or construction details. In reference to the e-mail received March 30, 2006 requesting we protect existing new curb and gutter, retaining wall and exposed aggregate concrete driveways, this request may not be feasible since curb alignment and drainage may impact these items.
