WHEREAS, the property owners along the east end of the 4500 Block of Collinwood Avenue at its intersection with anorth-south alley have requested that the City Council approve the closure of a portion of Collinwood Avenue between the northeast corner of Lot 15 Block 68 and the southeast corner of Lot 26, Block 40 of Chamberlin Heights Addition and located along the west nght-of--way line of the north-south alley at its intersection with the east end of Collinwood Avenue; and WHEREAS, these street closure would discourage vehicular access to and from those properties fronting Western Avenue, lessen neighborhood crime, and prevent illegal parking and trash dumping along the portion of Collinwood Avenue abutting the north-south alley and WHEREAS, the Plan Commission reviewed the request on November 21 2003 and recommends that the request be approved, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS That the following street located between the northeast corner of Lot 15 Block 68 and the southeast corner of Lot 26, Block 40 of Chamberlin Heights Addition and located along the west nght-of way tine of the north-south alley at its intersection with the east end of Collinwood Avenue as shown on Exhibit A attached hereto and incorporated herein, be physically closed, with the City to retain title to the public nght- of way in said street and alley retauung any and all easements for existing and prospective utilities, and retaining the nght of access at all times for the purpose of maintaining existing and prospective utility facilities and for emergency access: In addition, the City reserves the nght, at the sole discretion of the City Council, to reopen by resolution the aforesaid streets and alleys at any time by directing the removal of any bamcade or other means of closure. Closure of the street would not impair existing utilities nor require re-platting of adjacent properties The City Plan Commission at its November 21 2003 meeting recommended that the City Council approve the street closure FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds. The adjacent petitioning property owners will pay for all costs associated with the closure as determined by the Director of the Transportation and Public Works Department.
