T NDMENT TO JOB ORDER CONTRACT (JOC) SERVICES CONTRACT ("Amendment") is
`tic a tered into by and between the CITY OF FORT WORTH("City"), a Texas home rule municipal
`torpor Pion, acting by and through h /L (/',rkt, its duly authorized Assistant City Manager, and
JAVIER VILLAGONEZ D/B/A GTO CONSTRUCTION ("Contractor"), each individually referred to as a
"party"and collectively referred to as the"parties."
WHEREAS, City and Contractor entered into a Services Agreement, dated September 25, 2015,
Fort Worth City Secretary Contract No. 47047 (the "Contract"), for Contractor to provide certain lead
remediation for City and the parties desire to amend the Contract;
WHEREAS,the Contract details certain set prices in its Attachment C (the"Price Schedule")for
services provided by Contractor to City; and
WHEREAS, the United States Federal Government has promulgated certain rules that have
changed the requirements for lead remediation resulting in a need to change the Price Schedule.
NOW THEREFORE, the parties hereby enter into this Amendment as follows:
1. The parties hereby agree to amend the Agreement by replacing the Price Schedule with
the new price schedule attached hereto as Exhibit A.
2. Except as provided for above with the replacement of the Price Schedule, all other terms
and conditions of the Contract remain in full effect.
3. This Amendment contains the entire understanding and agreement between City and
Contractor, their assigns and successors in interest, as to the matter contained herein. Any prior or
contemporaneous oral or written agreement is hereby declared null and void to the extent in conflict with
any provision of this Amendment.
4. This Amendment may be executed in one or more counterparts and each counterpart
shall, for all purposes, be deemed an original, but all such counterparts shall together constitute one and
the same instrument.
