ORDINANCE NO.22683-04-2017 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF$220,000.00 IN THE WATER CAPITAL FUND, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE NEAR SOUTHSIDE MEDICAL DISTRICT WATER AND SANITARY SEWER IMPROVEMENTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the amount of$220,000.00 in the Water Capital Fund,from available funds,for the purpose of funding the Near Southside medical district water and sanitary sewer improvements. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22394-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Consultants, L.L.C., in the Amount of$314,000.00 for Near Southside Medical District Water and Sanitary Sewer Improvements Located in the Near Southside Medical District Neighborhood for a Revised Contract Amount of$421,865.00 and Adopt Appropriation Ordinances (COUNCIL DISTRICT 9) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinances increasing estimated receipts and appropriations in the Water Capital Fund in the amount of$220,000.00 and in the Sewer Capital Fund - Legacy in the amount of$130,000.00 from available funds; and 2. Authorize the execution of Amendment No. 1 to City Secretary Contract No. 46607 an Engineering Agreement with A.N.A. Consultants, L.L.C., in the amount of$314,000..00 for Near Southside Medical District Water and Sanitary Sewer Improvements for a revised contract amount of$421,865.00 (City Project CO2445) . DISCUSSION: On August 5, 2014, Mayor and Council Communication (M&C C-26906), the City Council authorized a Funding Agreement with Fort Worth South, Inc. (City Secretary Contract No. 45858) for the Near Southside Medical District Street Repair and Reconstruction Program. The general time frame for the design and construction of all program streets is 2014-2018 based upon the following construction plan and schedule: Group A Streets (Fiscal Year 2014-2015), Group B Streets (Fiscal Year 2016), Group C Streets (Fiscal Year 2017) and Group D Streets (Fiscal Year 2018). On April 14, 2015, Mayor and Council Communication (M&C C-27261), the City Council authorized an Engineering Agreement with A.N.A. Consultants, L.L.C., in the amount of$107,865.00 for Near Southside Medical District Water and Sanitary Sewer Improvements. This project will have no impact on the Water Department's operating budget. MWBE OFFICE: A.N.A. Consultants, L.L.C., agrees to maintain its initial SBE commitment of 13 percent that it made on the original agreement and extend and maintain that same SBE commitment of 13 percent to this first amendment. Therefore, A.N.A. Consultants, LLC, remains in compliance with the City's BDE Ordinance and attests to its commitment by its signature on the Acceptance of Previous SBE Commitment form executed by an authorized representative of its company. The project is located in COUNCIL DISTRICT 9, Mapsco 76H, 76M, 77E and 77J. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, of the Water Capital Fund, the Sewer Capital Fund- Legacy. The Fiscal Year 2017 Water Operating Fund Budget includes appropriations of$21,060,000.00 for the purpose of providing Pay-As-You-Go funding for Water Capital Projects. After this transfer for Fiscal Year 2017, the balance will be $11,280,188.00. The Fiscal Year 2017 Water Operating Budget includes appropriations of$31,636,073.00 for the purpose of providing Pay-As-You-Go funding for Sewer Capital Projects.
