HomeMy WebLinkAboutOrdinance 18241-09-2008ORDINANCE NO. 18241-09-2008 AN ORDINANCE AMENDING ORDINANCE NO. 18219-08-2008 ORDERING A LOCAL OPTION ELECTION TO BE HELD 1N THE CITY OF FORT WORTH, TEXAS ON TUESDAY THE 4~ DAY OF NOVEMBER, 2008, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS-OF-SAID CITY THE QUESTION OF VVI~THER OR NOT TO PERMIT THE LEGAL SALE OF BEER AND WINE FOR OFF-PREMISE CONSUMPTION ONLY WTHIN THE CITY OF FORT WORTH, TO AMEND MANNER OF ELECTION ADMINISTRATION AND TO ADD AND CHANGE POLLING LOCATIONS. WHEREAS, the City Council adopted Ordinance No. 18219-08-2008 on August 12, 2008 ordering a Local Option Election to be held on November 4, 2008, on the Question of Whether or Not to Permit the Legal Sale of Beer and Wine for Off-Premises Consumption Only Within the City of Fort Worth; WHEREAS, said ordinance designated the Tarrant County Elections Adminstrator as the elections administrator for both Tarrant and Denton Counties; WHEREAS, the City Council desires to designate the Denton County Elections Administrator as the Elections Administrator for Denton County; WIiEREAS, as authorized by Subchapter D of Chapter 31 of the Texas Election Code, the City of Fort Worth anticipates entering into contracts for election services with Tarrant and Denton Counties. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTI®N 1. TAI2ItANT COUNTY VOTING Section 5, "Early Voting", of Ordinance No. 18219-08-2008 is hereby repealed in its entirety and replaced as follows: SECTION-5. TARItANT C®UNTY VOTING (a) This Section shall only apply to the conduct of voting in Tarrant County. (b) Early Voting Clerk. Steve Raborn, Tarrant County Elections Administrator, shall serve as the early voting clerk. Mr. Raborn's off cial mailing address is: Steve Raborn, Early Voting Clerk P.O. Box 961011 Fort Worth, TX 76161-0011 (c) Early Voting Chief Deputy Clerk. Marty Hendrix, City Secretary of the City of Fort Worth, shall serve as chief deputy early voting clerk. (d) Applications for Ballot. Applications for ballots by mail shall be mailed to Steve Raborn at the address set out in subsection (b). Applications for ballot by mail must be delivered no earlier than September 5, 2008 and received no later than the close of business on October 28, 200$. (e)(1) Early Voting Tarrant County Residents. Early voting by personal appearance of Fort Worth residents that live in Tarrant County shall be conducted beginning October 20, 2008, and continuing through October 31, 2008. (g) An individual, having knowledge and experience in the conduct of elections with the electronic voting system for which the Central Counting Station is established shall be appointed by Tarrant County as the Manager of the Central Counting Station. The Manager shall be in charge of overall administration of the Central Counting Station and the general supervision of the personnel working at the Station. (h) Individuals trained in the operation of the automatic tabulating equipment installed at the Central Counting Station, shall be hereby appointed by Tarrant County as Tabulation Supervisors. The Tabulation Supervisors shall be in charge of the operation of the automatic tabulating equipment. (i) An individual shall be appointed by Tarrant County as Assistant to the Tabulation Supervisor. Such assistant shall assist the Tabulation Supervisor in the operation of the automatic tabulating equipment as directed by the Tabulation Supervisor. (j) An individual shall be appointed by Tarrant County as Presiding Judge of the Central Counting Station. He shall maintain order at the Central Counting Station and shall have such authority as may be prescribed by the Texas Election Code (k) The polling places, on election day, November 4, 2008, shall be kept open from 7:00 a.m. to 7:00 p.m., and due return shall be made to the City Council showing the number of votes cast for and against the Proposition. (1) That the Tarrant County Elections Administrator shall be responsible for conducting the election and shall furnish the election officials said ballots and voting 8 equipment, together with any other forms, blanks or instruction in accordance with the laws of the State of Texas, insofar as same are applicable, and with the provisions of this ordinance. (m) The locations of the polling places for the election on the proposition, except insofar as they may be changed by the City Council, are set forth on Exhibit "A" attached hereto and made a part hereof. SECTION 2 DENTON COUNTY VOTING Section 6, "Aclininistrative Matters", of Ordinance No. 18219-08-2008 is hereby repealed in its entirety and replaced as follows: SECTION 6 DENTON COUNTY VOTING (a) This Section shall only apply to the conduct of voting in Denton County. (b) Don Alexander, Denton County Elections Administrator, shall serve as the early voting clerk. Mr. Alexander's official mailing address is: Don Alexander, Early Voting Clerk P.O.
