HomeMy WebLinkAboutResolution 3097Resolution No `~~~~ ADOPTING THE SIXTH AMENDMENT TO THE CITY OF FORT WORTH'S ANNEXATION PLAN WHEREAS, on December 14 1999 the City Council approved Resolution No 2598 adopting an annexation plan for the City of Fort Worth m accordance with Section 43 052 of the Local Government Code; WHEREAS, on October 29 2002, the City Council approved Resolution No 2884 adopting the third amendment to the City's annexation plan identifying approximately 1,238 acres of land located north of Boat Club Road and west of Business Highway 287 Tarrant County Texas, referred to as the Eagle Mountain Zone; WHEREAS the City Council approved Ordinance No 15358 annexing the Eagle Mountain Zone for limited purposes on December 10 2002, WHEREAS Section 43 052(g) of the Local Government Code authorized the City to annex the Eagle Mountain Zone for full purposes during the 30-day period beginning October 29 2005 WHEREAS the City complied with procedural requirements imposed by Chapter 43 Subchapter C of the Local Government Code, in anticipation of annexation of the Eagle Mountain Zone between October 29 and November 28, 2005 mcludmg negotiation of service plan issues with five representatives of the area appointed by the Tarrant County Commissioners Court m accordance with Section 43 0562 of the Local Government Code; WHEREAS on June 15 2004 the City Council approved M & C C 20115 authorizing the Crty Manager to execute an agreement for provision of services to the Eagle Mountain Zone m lieu of annexation, pursuant to Section 43 0563 of the Local Government Code; WHEREAS pursuant to such agreement the Crty deferred full purpose annexation of the Eagle Mountain Zone until no earlier than January 1 2009 with certain exceptions; WHEREAS the agreement recognizes that the City may annex portions of the Eagle Mountain Zone after January 1 2009 as exempt annexations pursuant to Subchapter C 1 of the Local Government Code without mcludmg such areas m the annexation plan, to the extent permitted by law• WHEREAS Section~43:052(e) provides that a mumcipahty may amend its annexation plan at any time to remove an area proposed for annexation, WHEREAS, rt is advisable to amend the City's annexation plan to remove the Eagle Mountain Zone; • NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH.
