NOWIMEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated March 15, 2017, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $408,795 . 00 . 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $1, 377,885 . 00 OFFICIAL(RECORD CITY SECRETARY FT.WORTH,TX Page -1- 3 . The project begins at approximately 1,500 feet south of Shelby Road (Existing M-257 Station 98+88) (Mapsco#107- N) and continues to the south termination at the City of Burleson metering station approximately 1,700 feet south of Burleson Retta Road located on South Oaks Golf Club property (existing M-257 Station 389+00) (Mapsco# 120-W). The original Contract was authorized in May of 2009 and was amended in March of 2011. Per instructions from the CITY staff, the project was put on hold in late 2011 and Alan Plummer Associates, Inc. delivered design contract documents that were brought to a stopping design point. At the time of work stoppage, several items remained outstanding including easements, structural designs of standard junction boxes, aerial crossings, and advertisement and bid phase. However there were several items not originally identified in the scope which were added to the work. It has been seven years since the original contract was authorized and more than five (5) years have elapsed since the work stoppage. The plan sets and specification need to be modified and updated to reflect new field conditions, new utility crossings, new CITY standards and possibly new land owner information and/or utilities. The following scope items are changes or clarifications the existing Contract. The original scope stipulated that the project will be funded by the State Revolving Fund (SRF), however CITY staff has informed us that the project is no longer SRF funded. Design Phase Services: Current Documents Design Update: 1. ENGINEER shall attend a new project kickoff meeting with CITY staff. 2. ENGINEER shall review existing plans and re-familiarize the design team with the project scope. 3. ENGINEER shall meet with the CITY for one (1) additional review meeting to review project deliverables (Plans, Specs, and Opinion of probable Construction Cost at Update) and up to two additional meetings to review project progress and discuss project items. 4. ENGINEER shall coordinate with other consultants currently working on interceptor projects which will connect to this project. Connecting pipelines diameters or elevations may have changed, or other design information. Up to two additional coordination meetings are included in this task. 5. The CITY will send a letter to each identified property owner notifying them of the upcoming project and that a surveyor, ENGINEER, sub-consultant crews and/or other professionals may require access across the property. 6. ENGINEER and CITY staff shall re-walk the alignment to visually observe if field conditions have changed and are to be updated in the survey. Two additional meetings are dedicated to re- walking the alignment. 7. ENGINEER shall attend two additional meetings with property owners, if requested by the CITY staff,to explain project design and to answer property owner's questions. 8. Review flow data and report from City's consultant and provide comments to the City. Identify design flow for the project. 9. ENGINEER shall design interceptor using Fiberglass Pipe material and shall evaluate pipe depth and required stiffness in accordance with AWWA M-45. 10. ENGINEER shall update topographic survey information at three creek crossings to update creek bank slopes and identify any erosion which could have occurred in the years since the initial topographic survey was collected. It is recognized that stream bank erosion can change with every major rain event, and that the last 24 months have had record rain fall in North Texas resulting in stream erosion. This topographic survey is up to 200 feet in length and 100 feet wide at each creek crossing. (600 LF in total) 11. ENGINEER shall change the pipe size and vertical design based on the flows provided by the CITY which are shown in the table below and shall update plan and profile design plan sheets. Design Ex. ENGINEER shall perform new pipeline capacity calculations based on Manning's equation and based on the flow capacity requirements in the table above. 13. ENGINEER shall design two siphons that would carry the flow under Village Creek and Deer Creek. The siphon design includes the structural design of four specialized junction boxes/flow splitting boxes. Each siphon will have two barrels as necessary to meet TCEQ requirements.The Original contract did not include the design of siphons. 14. ENGINEER shall design up to eleven custom (11) junction boxes (unique to each location) including the structural design of these junction boxes. The Original contract anticipated and included nine "10' X 10' standard junction boxes", however as design progress was made, the City has requested that each box has a unique shape and size and therefore specialized design is required. 15. ENGINEER shall update property ownership information and General Notes, and General Sheets on the plans. 16. ENGINEER shall update opinion of probable construction cost. 17. ENGINEER shall update the Specifications using the CITY's standard specifications and any specialized specifications necessary for this project. ENGINEER shall update Standard Detail sheets to reflect update CITY standard details necessary for this project. 18. ENGINEER shall coordinate with CITY staff to coordinate with franchise utilities the locations of their utilities and update Dig-tess data in the topographic survey a locations where the pipeline crosses public right of way. These crossing are Burleson Retta Road, Overview Court, FM 1187, Rendon Road, Shelby Road. ENGINEER shall submit six (6)additional sets of plans to CITY staff to submit to franchise utilities Owners for review and approval. ENGINEER shall update plans and specifications based on comments from franchise utilities and CITY staff and with any new information identified by utility owner and CITY staff. 19. Update design sheets (32)based on pipe size, new property information, updated design. 20. ENGINEER shall confirm and update Utility Permits for TxDOT crossings. 21. ENGINEER shall submit additional updated plans and specifications to the CITY for review. Review Plan submittals include two (2)half size sets of plans and one (1)full size set and two (2) sets of specifications. Reference Scope Item #3 for meetings. ENGINEER shall incorporate the CITY's review comments to the plans and specifications. 22. ENGINEER shall obtain the latest FEMA model for the section of Village Creek that will be impacted by the Aerial Crossing and review FEMA model then shall include the aerial crossing in the model and identify the impacts of the Aerial Crossing on the Flood plain. If necessary the ENGINEER shall coordinate with the City's Flood Plain Manager and shall prepare the Letter of Pg.3 of 6 F:\projects\0318\040-01\ProjectMgmt\Contracts\Amendment_#2\Project scope to Complete v2.docx ATTACHMENT A CITY OF FORT WORTH UPPER AND MIDDLE VILLAGE CREEK RELIEF SANITARY SEWER MAIN-257, PART 2 AMENDMENT NO. 2 SCOPE OF SERVICE 02/28/2017 Map Revision (LOMR) for review by the Flood Plain Manager. The ENGINEER shall submit the LOMR to FEMA for review and approval bases on Record Survey provided by the Contactor at the completion of the construction of the aerial crossing. 23. ENGINEER shall re-establish project control information for the entire project because project monuments and control points may have been tampered with, removed or damaged since the initial survey was conducted. ALTERNATIVE RE-ALIGNMENT SCOPE: 1. ENGINEER shall re-survey up to 2,500 LF of new project topographic information. ENGINEER shall redesign up to 2,500 LF of pipeline based on the new topographic survey collected due to alignment conflicts or other surface improvements that have occurred in conflict with the current design. Prepare new additional easements for up to six easements due to alignment changes to avoid trees on properties adjacent to Overview Court. ENGINEER shall update the soils report to include information from three additional soil borings along the revised alignment. DELIVERABLES: 1) Updated plans and specifications. 2) Updated Opinion of Probable Construction Cost(OPCC)reflecting design changes. Final Construction Plans. However, ENGINEER can provide these services, if needed, upon the CITY's written request. There is no budget allowance for Additional Services. Additional amounts paid to the ENGINEER as a result of additional Scope of the Project shall be in writing by both parties before the services are performed. These additional services include the following: 1. Preparation of applications and supporting documents (in addition to those furnished under Basic Services)for private or governmental grants, loans, or advances in connection with the Project; preparation or review of environmental assessments and impact statements; review and evaluation of the effects on the design requirements for the Project of any such statements and documents prepared by others; and assistance in obtaining approvals of authorities having jurisdiction over the anticipated environmental impact of the Project. 2. Modeling Services related to size and capacity of the capacity of sanitary sewer interceptors. 3. Services to make measured drawings of or to investigate existing conditions or facilities, or to verify the accuracy of drawings or other information furnished by CITY or others, beyond what is identified in the Basic Services above. 4. Services related to construction administration including but not limited to review of additional submittals, payment applications, inspections, response to requests for information or additional preparation of Change Orders, unless stated in the scope of services, 5. Services in Connection with major work change directives and major change orders to reflect changes requested by CITY. 6. Services related to Threatened and Endangered Species including mussel presence or absence surveys, documentation to Texas Parks and Wild Life and Aquatic Resource Relocation Plans. 7. Services resulting from CITY's request to evaluate additional Study and Report Phase alternative solutions beyond those previously identified. 8. Services required as a result of CITY's providing incomplete or incorrect Project information to ENGINEER. 9. Services requiring out-of-town travel of ENGINEER. 10. Services related to collecting level A Sub surface utility engineering (SUE) data on utilities or coordinate with franchise utilities regarding crossing agreements and/or encroachment agreements. 11. Preparing additional Bidding Documents or Contract Documents for alternate bids or prices requested by CITY for the Work or a portion thereof. 12. Assistance in connection with Bid protests, rebidding, or renegotiating contracts for construction, materials, equipment, or services, except when such assistance is required. 13. Property surveys or related engineering services needed for the transfer of interests in real property; and providing other special field surveys. 14. Providing assistance in responding to the presence of any Constituent of Concern at the Site, in compliance with current Laws and Regulations. Preparing to serve or serving as a consultant or witness for CITY in any litigation, arbitration, or other dispute resolution process related to the Project. 16. Services in making revisions to Drawings and Specifications occasioned by the acceptance of substitute materials or equipment other than "or-equal" items; services after the award of the Construction Contract in evaluating and determining the acceptability of a proposed "or equal'. 17. Services resulting from significant delays, changes, or price increases occurring as a direct or indirect result of materials, equipment, or energy shortages. 18. Additional or extended services during construction made necessary by (1) emergencies or acts of God endangering the Work(advance notice not required), (2)the presence at the Site of any Constituent of Concern or items of historical or cultural significance, (3) Work damaged by fire or other cause during construction, (4) a significant amount of defective, neglected, or delayed work by Contractor, (5)acceleration of the progress schedule involving services beyond normal working hours, or(6)default by Contractor. 19. Services (other than Basic Services during the Post-Construction Phase) in connection with any partial utilization of any part of the Work by CITY prior to Substantial Completion. 20. Services related to preparing Traffic Control Plans. 21. Services related to Construction Staking, edge of easement staking, or centerline of pipe staking. 22. Services related to municipal waste presence or absence evaluation and permitting. Compensation A. The ENGINEER shall be compensated a total lump sum fee of $408,794.44 as summarized in Exhibit B-1 —Engineer Invoice and Section IV—Summary of Total Project Fees. The total lump sum fee shall be considered full compensation for the services described in Attachment A, including all labor materials, supplies, and equipment necessary to deliver the services. B. The ENGINEER shall be paid monthly payments as described in Section II - Method of Payment. II. Method of Payment A. Partial payment shall be made to the ENGINEER monthly upon City's approval of an invoice prepared and submitted by the ENGINEER in the format and including content as presented in Exhibit B-1, Progress Reports as required in item 111. of this Attachment B, and Schedule as required in Attachment D to this Agreement. B. The estimated current physical percent complete as required on the invoice shall be calculated from the progress schedule as required in Attachment D to this Standard Agreement and according to the current version of the City of Fort Worth's Schedule Guidance Document. C. The cumulative sum of such monthly partial fee payments shall not exceed the total current project budget including all approved Amendments. D. Each invoice shall be verified as to its accuracy and compliance with the terms of this Agreement by an officer of the ENGINEER. III. Progress Reports A. The ENGINEER shall prepare and submit to the designated representative of the Water Department, monthly progress reports and schedules in the format required by the City. Authorize execution of Amendment No. 2 to City Secretary Contract No. 38536 with Alan Plummer Associates, Inc., in the amount of$408,795.00 for a total revised contract amount of$1,377,885.00 for additional design and engineering services for Sanitary Sewer Main 257 Upper and Middle.Village Creek Parallel Relief Main, Part 2 (City Project No. C01227). DISCUSSION: On March 31, 2009, Mayor and Council Communication (M&C C-23421) the City Council authorized an Engineering Agreement with Alan Plummer Associates, Inc., in the amount of$889,676.00 for Sanitary Sewer Main 257 Upper and Middle Village Creek Parallel Relief Main, Part 2. The Agreement was subsequently revised by Amendment No. 1 in the amount of$79,414.00 authorized on December 7, 2010 (M&C C-24626). Amendment No. 2 will provide additional engineering services for the redesign of a portion of Main 257 including detailed design of siphons, junction structures, and realignment to improve access for future maintenance. The proposed scope of services consists of preparation of plans and specifications, survey services, geotechnical engineering, environmental assessment, permitting and ROW/easement services. Alan Plummer Associates, Inc., proposes to provide the additional services for a fee up to the amount of $408,795.00. Staff considers the proposed fee to be fair and reasonable. In addition to the amendment amount, $2,181,205.00 is required for project management and real property acquisitions. Engineering for the Sanitary Sewer Main 257 Upper and Middle Village Creek Parallel Relief Main, Part 2 is one component of the overall project that includes project management, easement acquisition, utility Logname: 60M257P2A2-APAI Page I of 3 coordination, material testing, inspection, construction, and contingencies. The overall project budget is $21,000,000.00. Design is expected to be completed by November 2017. Construction is anticipated to commence in September 2018 and construction of all the phases to be completed by April 2020. M/WBE OFFICE: Alan Plummer Associates, Inc., is in compliance with the City's M/WBE Ordinance by committing to an additional 24 percent M/WBE participation on this Amendment No. 2. The project is located in COUNCIL DISTRICT 8, Mapsco 106V, 106Y, 106Z, 120B, 120F, 120K, 120P, 120T and 120X .
