HomeMy WebLinkAboutResolution 3103A( Resolution NO y~~~~~ WHEREAS on June 16, 2004 four mdrviduals, Myron Dukes, Christopher Dukes, Lauren Dukes and Juamtnce Deadmon drowned at the Fort Worth Water Gardens, WHEREAS the Crty of Fort Worth anticipates multiple lawsuits will be filed as a result of the drownmgs, WHEREAS the Crty of Fort Worth s maximum habilrty under the Texas Tort Claims Act would be $500 000 00 for the entire occurrence, WHEREAS the City of Fort Worth denies any habilrty for said incident, but would like to avoid timely and costly litigation, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS That the Fort Worth Crty Attorney is hereby authorized to file a suit m mterpleader and to deposit the $500 000 00 maximum under the Texas Tort Claims Act with the Tarrant County District Court for court ordered division among the following known and unknown claimants. the individual representative of the Estate of Myron Dukes, the individual representative of the Estate of Christopher Dukes, the individual representative of the Estate of Lauren Dukes, the individual representative of the Estate of Juanitnce Deadmon, Stephanie Dukes, Myron Dukes, Jr Lottie Dukes, Fruenze Deadmon Sr and Alexandra Deadmon, m payment of any and all claims stemming from the drowning at the Fort Worth Water Gardens on Ju e 6 2 04 OPTED this day of 2004 ...--~---~ .. - f ~ G_lover ~; ,} JUL ~ 204 g Cty~Secretary'` ~ 1`~a ~U~~ -~.
