An ordinance providing for the licensing of carriages, hacks, omnibuses, automobilesland other like public vehicles operated for hire Within the City of Fort Worth, prescribing the rate of charges that shall bb made by the owners or custodians thereof for the transportation of passengers, and making it the duty of the person oonduc ting or operating• such vehicle to keep the said rate of charges conspicuously posted upon or about such vehicle; and providing a penalty to charge or collect fares in excess of said rate of charges and prescribing a penalty against any, person Who shall fraudulently obtain conveyance on such vehicle and 8' fail or refuse to pap therefor. BE IT ORDAINED BY THS BOARD OF COMMISSIONERS OF THE CITY OF FORT WORTH:- Section 1: That hereafter every person, associatidn of persons, firm or corporation, operating, or conducting for public hire within the corporate limits of the City of Fort Worth(any car- riage, hack, omnibus, automobiles) or o therC ike)publio vehicle for the carrying or transportation of (?assess Or persons) from am place or point to another within said city,shall,be- v . r : fore ngagl id businfs; procure and obtain a license of taxes therefor from the assessor and collector of the City of Fort Worth. Application for such license, shall be madeu pan blanks for that p urpose lwhic h shall state the name of the applicant and his place of residence, the kind and character of each vehicle so sought to be licensed and the make thereof,and that such appli- cant will obey all ordinances of the City of Fort Worth relating .l,'C�fi��-(i�i3 to such business. A license fee of ftwe 1 dollars shall be paid for each vehicle to the said Assessor and Collector for the use of the City of Fort Worth by the applicant and said license shall auth- orize the owner thereof to engage in such business for a period of one year from. the date of suc license, but in each instance a license fee shall be paid for each vehicle engaged in such business. Section 2: It shall be u nlawful for any person, association -of persons, firm or corporation, to engage in th busXness of oper- ating or conductin such vehicle in the City of lo t 1►Q as -M means or for the purpose of transporting Rassengers OVIXreone0for hire, as specified in Section 1 of this 'ordinanoe, without first having obtained the license and paid the license fee or fees, as the case may be, .as hereinbefore prescribed, and any person,fixm or corporation violating the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not less than one dollar and no more than five dollars, and each day while so engaging in said business without obtaining license as aforesaid shall constitute a separate and distinct offense 'and be punished accordingly. Section 3: The charge for service of carriage, hack, omnibus, and motor vehicle within the City of Fort North for the transpor- tation of passengers shall not exceed those stated in the follow- ing schedule.namnely: one mile or less for each passenger,fifty( 50 0 cents; more than one mile and less than two miles, each passenger, one(*l.00)dollar; more than two miles to City limits,each passen- ger, one dollar b fifty cents($1.50) ;to hotels from depots,or to depots from hotels,each passenger fifty( 50o)cents;provided,that for children under five years of age when accompanied by an adult or ad- ults,no charge shall be made;ohildren from five to twelve years of age,when accompanied by an adult or adults,a charge not to exceed twenty-five( 25e) cents each shall be permitted. Provided,that where, in answering a call for service,the distance necessary to be traveled by the most. direct route from the hack stand to the house or location of the patron,exceeds the distance necessary to be traveled to convey such patron to his destination,the charge may be based,under the pro- visions of this ordinance,on the longer distance of the two.Where ve- hicles are hired by the hour,the following scale is permitted: first A -3- hour,one or more persons, two($2.oo)dollars; each additional hour or fraction thereof, one or more persons, one dollar &ofifty cents (41.450) . A mile,as herein used, is defined to be eighteen ordinary city blocks by the most direct route. — Section 4: Rvery vehicle named in this ordinance shall have permanently affixed to the interior thereof, in a place readily to be seen and observed by passengers, a receptacle that shall con- tain at all times a card upon which shall be printed, in bold type, the foregoing schedule of rates;the number of the driver' s license; the name of the driver;the name of the owner; and no other card, paper or thing whatsoever,except as herein presdribed,shall be carried in said receptacle,and said receptacle and the card to be contained therein shall be exhibited to the Commissioner of Fire and Police,and if in conformity with the provisions of this ordi- nance then same shall be approved. Section 5: Bvery vehicle named In this ordinance shall have plainly indicated on the glass of its lamps the number of its li- cense and the figures of such number shall not be less than one and one-half inches in height;and same shall be subject to the approval of the Commissioner of Fire and Police in order that same shall be in conformity, with the provisions of this ordinance. Section 6: Nothing herein contained shall preclude the owner or person in charge of any of the vehicles herein named to accept less than the maximum fare prescribed in this ordinance; but in the event of agreement so to do,he shall not thereafter demand more than the amount agreed upon. Section 7: Any person who shall by fraudulent trick,scheme or device obtain transportation upon any public licensed vehicle, as the term"vehicle" is usedin this ordinance,within the City of Fort Borth and in consummation of such fraudulent trick,scheme or device,refuse to pay the lawful rates of fare prescribed by -4- this ordinance for such transportation, or the amount agreed upon, same being less than the maximum rates herein prescribed, shall be deemed guilty of' a misdemeanor,and upon conviction thereof, shall be punished by fine not exceeding five($5.00)dollars in the corporation court of the City of Fort Worth. Section B: Should any owner,driver, lessee, or operator or person in charge of any vehtcle herein named,refuse to convey or, transport a passenger at the rates hereinbefore provided, or de m and or receive an amount in excess of his lawful fare, he shall be deemed guilty of a misdemeanor,and upon conviction thereof, shall be punished by fine in any sum not less than five ($5.00)dollars and not exceeding ten($10.00)dollars. This sec- tlon,however, is made subject to Section 11 heretn, relating to persons suffering from disease or contagious or infectious dis- orders. , SectJ,on -9; Any vehiel — or- the conveyance of passengers for hire which is in an unsafe,unsanitary or unsightly condition may be condemned by the C" m issioner of Dire and Police,and If the owner,driver,leasee or operator thereof shall continue to utilize said vehicle without first having made the same safe, sanitary and sightly, he shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceed- ing 'ten($10.0o)dollare,and each day' s use of such vehicle while in such unsafe, unsanitary or unsightly condition,shali be and constitute a separate and distinct offense. Provided,that before such vehicle is condemned and Its use prohibited,the owner thereof or the person in oharge of same, shall be notified and summoned by means of written notice, before such Polio& Commissioner and opportunity to be heard thereon afforded such owner or person in charge. Section 10: Any owner,driver, lessee or operator violating any of,the provisions of this ordinance,where no special penalty is provided therefor, shall be deemed gz ilty of a misddmeanor, Ay -5- and upon conviction thereof,shall� be fined, in any sum not less than five($5.00)dollars and no more than ten($10.00)dollars. Section 11: The owner,driver or person in charge of any car- riage or vehhole for the conveyance of passengers shall be at liberty to refuse to transport aaay .invalid, even upon thw--tezr of legal fare,whose appearance shall justify such owner,driver ,or person in charge in believing in good faith that the disease or sickness from whtoh such invalid or afflicted person is suffer t ' ing is of an' infeotious or contagious,nature; and should such owner,driver or person in charge cX such vehicle at any time have reason to believe that he has received anv, such person so afflicted into his carriage or vehicle, he shall thereafter forthwith re- port such fact to the health officer of the City of Fort Worth, and have such vehicle or carriage thoroughly disinfected under the supervision of such health officer,and shall also furnish} to such *fficer the name or names of such nick yr afflioted person or persons,and the address to which such person or persons were so transported or carried. section 12: All ordinances and parts of ordinances in con- flict herewith be and the same are hereby repealed, � y p Section 131 This ordinance shall take effect and be in force from and after its passage and publication as prescribed by law.
