WHE , � -"City of Fort Worth (CITY) and Gary P. Rutilek d/b/a The
Landscape�-igace (ENGINEER) , made and entered into City Secretary Contract
No. 46708 (the CONTRACT) , which was authorized by City Council on the 5th day
of June, 2015, in the amount of $ 322, 953.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1 in
the amount of $14,950.00, which was authorized administratively on April 25,
2016 for the following project; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 2 in
the amount of $8,736.00, which was authorized administratively on February 02,
2017 for the following project; and
WHEREAS the CONTRACT involves engineering services for the following
project:
Northwest Community Park - Phase II; and
WHEREAS, it has now become necessary to administratively execute Amendment
No. 3 to the CONTRACT to increase the scope of work and revise the fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends
the CONTRACT:

Article I of the CONTRACT is amended to include the additional engineering
services specified in a proposal dated March 16, 2017, a copy of which is
attached hereto and incorporated herein. The cost to CITY for the additional
design services to be performed by ENGINEER totals $4,775.89. (See Attached
Funding Breakdown Sheet, Page -3- )
2.
Article II of the CONTRACT is amended to provide for an increase in the
fee to be paid to ENGINEER for all work and services performed under the
CONTRACT, as amended, so that the total fee paid by CITY for all work and
services shall be an amount of $351,414.89.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Re: Northwest Community Park Phase II- Additional Services
Dear Bryan:
Pursuant to recent our recent conversations, I am forwarding a proposal for additional services related to
work elements not included in our original or subsequently amended scope. These items include
reimbursement for plat filing, easement filing and related printing costs. Amendment No. 1 to the project
contract included platting of the property but specifically excluded filing fees and related costs which were
to be paid by the City. In an effort to maintain project progress,the plat filing fees and related costs were
paid by our team. This request for amendment would permit us to be reimbursed for these expenses.
To date the costs expended total $4,175.89. It is estimated that an additional $600.00 may be required to
allow for County filing and preparation/filing of separate instruments to Oncor. We therefore request that
the contract be amended to add a total of$4,775.89 to the project consultant fees. The City will be billed
on the basis of actual costs incurred.
If this proposal meets with your approval, please initiate preparation of a contract agreement at your
convenience. Please call if you have any questions concerning any of the items herein or specifically
omitted.
