HomeMy WebLinkAboutOrdinance 22704-05-2017 ORDINANCE NO. 22704-05-2017 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AIRPORTS GRANT FUND IN THE AMOUNT OF $22,222,222.22, SUBJECT TO RECEIPT OF A GRANT FROM THE FEDERAL AVIATION ADMINISTRATION, FOR THE PURPOSE OF FUNDING THE RUNWAY EXTENSION PROJECT AT FORT WORTH ALLIANCE AIRPORT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Airports Grant Fund in the amount of $22,222,222.22, subject to receipt of a grant from the Federal Aviation Administration, for the purpose of funding the Runway Extension Project at Fort Worth Alliance Airport. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 22393-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the application for and acceptance of a grant, if awarded, from the Federal Aviation Administration in an amount up to $20,000,000.00; 2. Authorize the use of land credits in the amount up to $2,222,222.22 for the City of Fort Worth's in-kind local match of ten percent of the project cost; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Airport Grants Fund in the amount up to $22,222,222.22, subject to receipt of the grant. DISCUSSION: The Alliance Runway Extension Project is a multi-phase project that will be completed based on the availability of federal funds. Each year the City receives discretionary Federal Aviation Administration (FAA) funding for the runway extension. It is expected that up to $20,000,000.00 in discretionary funds to be available this year. This will be the sixteenth runway extension grant received, if awarded. Grants one through fifteen have funded environmental assessments, land acquisitions, two earth work packages, utility relocations, and design, construction of FM 156, design and construction of the new Burlington Northern Santa Fe Main Line Railroad, and completion of the ALSF (Approach Lighting System with Sequence Flashing Lights) building. The project is in its final phases and this grant will be used to fund construction costs associated with the Runway Extension. The Alliance Runway Extension Project is scheduled to be complete early 2018 with a total projected cost of$265,265,127.85. The pending $20,000,000.00, FAA Discretionary grant application will fully fund the remaining runway/taxiway construction associated with the Runway Extension Project. Existing land credits that remain from the original land donation for Alliance Airport will be used for the City's ten percent in-kind match. If the grant is approved, the value of the remaining land credits will be $12,135,341.44. The Aviation Advisory Board recommended approval of the Mayor and Council Communication (M&C) on Logname: 55FY17 RUNWAY EXTENSION GRANT Page 1 of 2 March 16, 2017. This grant is not eligible for the reimbursement of indirect costs. This contract will be with a governmental entity, state agency or public institution of higher education: Federal Aviation Administration. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations, receipt of the grant and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Municipal Airport Grants Fund and that prior to an expenditure being made, the Aviation Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
