AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE AMOUNT OF $234,361.00 IN THE WATER
CAPITAL PROJECTS FUND, FROM AVAILABLE FUNDS, FOR THE
PURPOSE OF FUNDING EMERGENCY WORK TO REPAIR A 27 — INCH
SANITARY SEWER MAIN M — 347 ON FOSSIL CREEK GOLF COURSE
PROPERTY; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017
in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations
in the amount of$234,361.00 in the Water Capital Projects Fund, from available funds, for the purpose
of funding emergency work to repair a 27 — inch sanitary sewer main M — 347 on Fossil Creek golf
course property.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no
way impair the remaining portions, sections, or parts of sections of this ordinance, which said
remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 22394-09-2016 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are
in direct conflict with such other ordinances and appropriations, in which instance said conflicting
provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Ratify City Secretary No. 48546, an Emergency Contract with Conatser Construction TX, LP, in the Final
Amount of$234,360.53 for M-347 Emergency Sanitary Sewer Repair Work Performed on Fossil Creek
Golf Course Property and Adopt Appropriation Ordinance (COUNCIL DISTRICT 4)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Projects Fund in the amount of$234,361.00 from available funds; and
2. Ratify an emergency Agreement with Conatser Construction TX, LP, City Secretary No. 48413, in the
final amount of$234,360.53 for emergency work to repair a 27-inch sanitary sewer main M-347 located on
Fossil Creek Golf Course Property (City Project No. 100930).
DISCUSSION:
On December 13, 2016, Staff discovered a hole in a sanitary sewer main (M-347) located within Fossil
Creek Golf Course property. The hole caused sewage to discharge into Fossil Creek during high flows.
Approximately 100 linear feet of 27-inch pipe was needed to repair M-347 along with one Type "A"
manhole to replace an existing manhole and facilitate emergency bypass pumping and restore sewer
service. It was beyond the City's ability to perform repairs of this size, length, and depth. The Water
Department engaged Conatser Construction TX, LP for the emergency repair to sanitary sewer main M-
347.
The attached City Manager memo dated December 15, 2016 approved the emergency work up to
$300,000.00. The total construction cost was $234,360.53, which is fair and reasonable for the work
performed.
Sanitary Sewer Overflows are a threat to the health and safety of the City of Fort Worth. Chapter 2, Article
I, Section 2-9 of the City's Code of Ordinances and Section 252.022 of the Local Government Code
exempts from normal bidding requirements expenditures that are necessary to preserve or protect public
health or safety of the municipality's residents; and procurements that are necessary because of
unforeseen damage to public machinery, equipment, or property.
This project was located in COUNCIL DISTRICT 4, Mapsco 50A.
This M&C does not request approval of a contract with a business entity.

The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Water Capital Projects Fund. The Fiscal Year 2017 Sewer Operating Budget includes appropriations
of$31,606,073.00 for the purpose of providing Pay-As-You-Go funding for sewer capital projects. After
this transfer for Fiscal Year 2017, the balance will be $13,096,129.00. Appropriations will consist of the
following:
