HomeMy WebLinkAboutResolution 4779-05-2017 A Resolution NO. 4779-05-2017 CONSENTING TO LEGISLATION GRANTING ROAD POWERS TO FAR NORTH FORT WORTH MUNICIPAL UTILITY DISTRICT NO.1 OF TARRANT AND WISE COUNTIES WHEREAS, the Far North Fort Worth Municipal Utility District No. 1 of Tarrant and Wise Counties (the "District") consists of approximately 719 acres wholly in the extraterritorial jurisdiction of the City of Fort Worth, as depicted in Exhibit A;and WHEREAS, the District was created by the Texas Commission on Environmental Quality in 2017,with the City's consent;and WHEREAS, the City has received a copy of House Bill 4331 by Representative Phil King, which proposes conferring the ability to acquire, construct, finance, and maintain roadway improvements in the District;and WHEREAS, the City wishes to evidence its consent to legislation conferring the ability to acquire, construct, finance, and maintain roadway improvements in the District in accordance with City standards by special act of the 85h Texas Legislature; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: 1. That the City Council hereby grants its consent to the filing of legislation conferring the ability to acquire, construct, finance, and maintain roadway improvements within its extraterritorial jurisdiction in the District in accordance with the City standards by special act of the 85th Legislature; and 2. The City Council's approval and consent are contingent on reaching an agreement on the appropriate level of a reserve or sinking fund that would enable the capital maintenance and reconstruction of the capital infrastructure upon the dissolution or expiration of the MUD. 3. That the City Council states that it has not relinquished any rights, duties, or powers relating to the inclusion of the District within its extraterritorial jurisdiction; and FoRTWORTH 4. That the City Council further states that approval of this resolution does not provide endorsement or approval of any pending agreements pertaining to the District or its development.
