TOWN OF LAKESIDE ORDINANCE NO. 396 CITY OF FORT WORTH ORDINANCE NO. 22672-04-2017 JOINT ORDINANCE AND BOUNDARY AGREEMENT WHEREAS,the Town of Lakeside(hereinafter called"LAKESIDE")is a Type A general law city located in Tarrant County, Texas; and WHEREAS,the City of Fort Worth(hereinafter called"FORT WORTH") is a home rule city located in Tarrant, Wise, Parker, Johnson and Denton Counties; and WHEREAS,LAKESIDE and FORT WORTH share a common boundary; and WHEREAS, FORT WORTH City Council authorized a settlement agreement on September 22, 2016 of an Annexation Lawsuit entitled City of Fort Worth, Texas v. Town of Lakeside, Texas, Cause No. 141-280413-15 to execute all agreements necessary to complete the settlement; and WHEREAS, FORT WORTH most recently approved Ordinance No. 22504-11-2016 on November 15, 2016 to institute and adopt city-initiated annexation of approximately 93.4 acres of land in Tarrant County, located along Jacksboro Highway and east of the Town of Lakeside; and WHEREAS,LAKESIDE and FORT WORTH now desire to adjust the boundary between the two cities to promote orderly development to insure public safety and effective delivery of municipal services in conformance with the settlement agreement; and WHEREAS, Section 43.031 of the Texas Local Government Code authorizes adjacent municipalities to make mutually agreeable changes to their boundaries that are less than 1,000 feet in width; and WHEREAS, Section 43.142 of'the Texas Local Government Code allows a City to disannex areas in accordance with its City Charter and Section 42.023 of the Texas Local Government Code allows municipalities to release extraterritorial jurisdiction by ordinance; and WHEREAS,LAKESIDE and FORT WORTH acknowledge that this boundary adjustment concludes the jurisdictional boundary changes as follows: 1) FORT WORTH will disannex to LAKESIDE all of Highway 199 from Rankin Street to Nine Mile Bridge Road except for the north access road;2) FORT WORTH will disannex to LAKESIDE the area that is west of the east right- of-way line of Tyler Road; 3) FORT WORTH will disannex to LAKESIDE the area between LAKESIDE City limits and FORT WORTH'S extraterritorial jurisdiction west of Highway 199; and 4) FORT WORTH will release to LAKESIDE its extraterritorial jurisdiction in the triangular and rectangular-shaped tracts north of LAKESIDE. NOW, THEREFORE, BE IT ORDAINED AND MUTUALLY AGREED BY THE CITY COUNCIL OF THE TOWN OF LAKESIDE AND THE CITY COUNCIL OF THE CITY OF FORT WORTH: Ordinance No. 22672-04-2017 Page 1 of 14 SECTION 1 (portion of Highway 199 from Rankin Street to Nine Mile Bridge Road) Pursuant to Section 43.031 of the Texas Local Government Code, LAKESIDE and FORT WORTH hereby agree that the boundary between the cities will be adjusted as set out herein so that the 63.0-acre tract located in FORT WORTH, including the intersection of Highway 199 and Nine Mile Bridge Road, as described and shown in Exhibit "A", and with a width of less than 1,000 feet,will be located in the city limits of LAKESIDE. In accordance with this Joint Ordinance and Boundary Agreement,FORT WORTH hereby relinquishes the 63.0 acres described in Exhibit A to the City of LAKESIDE and disannexes and discontinues such property as part of the City of Fort Worth. In accordance with the terms of this Joint Ordinance and Boundary Agreement, the Town of Lakeside accepts and annexes 63.0 acres into its corporate limits as reflected in Exhibit A attached and incorporated herein. SECTION 2 (portion of area that is west of the east right-of-way line of Tyler Road) Pursuant to Section 43.031 of the Texas Local Government Code, LAKESIDE and FORT WORTH hereby agree that the boundary between the cities will be adjusted as set out herein so that the 5.3-acre tract located in FORT WORTH, as described and shown in Exhibit`B",and with a width of less than 1,000 feet, will be located in the city limits of LAKESIDE. In accordance with this Joint Ordinance and Boundary Agreement, FORT WORTH hereby relinquishes the 5.3 acres described in Exhibit "B" to the City of Lakeside and disannexes and discontinues such property as part of the City of Fort Worth. In accordance with the terms of this Joint Ordinance and Boundary Agreement,the City of Lakeside accepts and annexes the 5.3 acres into its corporate limits as reflected in Exhibit B attached and incorporated herein. SECTION 3 (portion of area between Lakeside city limits and Fort Worth ET,I) Pursuant to Section 43.031 of the Texas Local Government Code, LAKESIDE and FORT WORTH hereby agree that the boundary between the cities will be adjusted as set out herein so that the 4.6-acre tract located in the city limits of FORT WORTH, as described and shown in Exhibit "C", and with a width of less than 1,000 feet, will be located in the city limits of LAKESIDE. In accordance with this Joint Ordinance and Boundary Agreement, FORT WORTH hereby relinquishes the 4.6 acres described in Exhibit "C" to the City of Lakeside and disannexes and discontinues such property as part of the City of Fort Worth. In accordance with the terms of this Joint Ordinance and Boundary Agreement,the Town of Lakeside accepts and annexes the 4.6 acres into its corporate limits as reflected in Exhibit "C" attached and incorporated herein. Ordinance No. 22672-04-2017 Page 2 of 14 SECTION 4 (portion of Fort Worth ETJ located north of Lakeside) Pursuant to Chapter 42 of the Texas Local Government Code, FORT WORTH agrees to release the approximately 165.9 acres of extraterritorial jurisdiction as described and shown in Exhibit"D", and to transfer the said extraterritorial jurisdiction to LAKESIDE. SECTION 5 This ordinance shall be cumulative of all provisions of the ordinances of the Town of Lakeside and the City of Fort Worth, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 6 It is hereby declared to be the intention of the City Councils of Lakeside and Fort Worth that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence,paragraph or section. SECTION 7 The Town of Lakeside and the City of Fort Worth do hereby covenant and agree to protect, preserve and defend the herein described boundary adjustment. SECTION 8 The Town of Lakeside and the City of Fort Worth agree and ordain that the adoption by both cities of this Joint Ordinance and Boundary Agreement, and the boundary change resulting from this Agreement do not mitigate,diminish or lessen in any way the rights that either party may have, at law or in equity, to challenge or contest any other annexations, attempted annexations or extraterritorial jurisdiction claims made by the other party. SECTION 10 The Mayor of each city shall execute this Joint Ordinance and Boundary Agreement, upon adoption by both cities, in duplicate originals. Approve the attached joint ordinance and Boundary Agreement with the Town of Lakeside; and 2. Authorize the Mayor to execute the attached joint ordinance and Boundary Agreement. DISCUSSION: The Texas Local Government Code Chapter 43, Sections 43.023, 43.142 and 43.031 and Chapter 42, Sections 42.022 and 42.023, authorize adjacent municipalities to make mutually agreeable changes in their boundaries, and release extraterritorial jurisdiction by ordinance. The City of Fort Worth and the Town of Lakeside wish to make changes to the boundaries of each city which will promote orderly development, public safety, and effective delivery of municipal services. The joint ordinance is part of the 2016 settlement Agreement between the two municipalities. On September 27, 2016, the City Council approved Mayor and Council Communication (M&C L-15954) authorizing the settlement of an annexation lawsuit entitled City of Fort Worth, Texas v. Town of Lakeside, Texas filed as Cause No. 141-280413-15, which included in part the following terms: (i) City of Fort Worth paid $175,000.00 to the Town of Lakeside in exchange for Lakeside's release of certain areas within its Certificate of Convenience and Necessity for providing water service; (ii) release to Lakeside of Fort Worth extraterritorial jurisdiction along State Highway 199 from Haley Road to Nine Mile Bridge Road with the exception of the north access road; (iii) transfer to Lakeside of two tracts of Fort Worth extraterritorial jurisdiction lying north of Lakeside along with the Certificates of Convenience and Necessity for those areas, and (iv) execution of a Boundary Agreement to memorialize the revised jurisdictional boundaries of the two cities. On November 15, 2016, the City Council approved Mayor and Council Communication (M&C L-15970) instituting the annexation and adopting the ordinance annexing approximately 93.4 acres of land, located along Jacksboro Highway and East of the Town of Lakeside (AX-13-013). This Boundary Agreement concludes the jurisdictional boundaries changes as shown on the attached exhibit. The changes are listed as follows: 1.
