RESOLUTION FILE NO. _JZ9---
R E S O L U T I O N
WHEREAS, the regulation of public utility rates, including
water and sewer rates, is a matter of serious concern and significant
responsibility to the cities of the State of Texas; and
WHEREAS, H. B. 878 as introduced in the Legislature of the
State of Texas would provide for the limitation of utility rates to a
return of 8 per cent per annum based upon the value of the property
of the utility defined as "original cost less book depreciation as
reported to the United States Internal Revenue Service"; and
WHEREAS, such approach is unduly restrictive and open to
controversy in its application to the utility rate structures of
cities and as written could be of serious harmful effect to such
rate structure, and to the regulatory decision-making process: NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH:
That the City Council of the City of Fort Worth does hereby
express its unanimous opposition to the adoption of H. B. 878, and
respectfully solicits the assistance of the Tarrant County Legislative
delegation, and all Texas Legislators, in opposition thereto:
BE IT FURTHER RESOLVED, that a copy of this Resolution be
furnished to each member of the Tarrant County delegation.
