ORDINANCE NO. 3-Z(oS' AN ORDINANCE PROVIDING THAT THE ALLEY IN BLOCK 2, BELLS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND CLOSED; AND PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the alley in Block 2, Bells Addition to the City of Fort Worth, Tarrant County, Texas, is hereby vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever. SECTION 2. That the fee to the land in said alley above described is hereby re- leased and will revert to the owners as provided by lav, save and except that an easement is reserved for all existing utilities; and it is spe- cifically understood and agreed that should a building or other permanent structure be erected over the alley, the sanitary sever in said alley will be either rerouted or replaced with cast iron pipe under said building or structure at the owners' expense. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Jones Re: Request for closing an City Manager alley in Block 2, Bells Building Addition Dear Sir: Attached is letter dated October 20, 1954, signed by Mr. W. P. Cook, which states that he owns Lots 3 and 4, 25 and 26 in Block 2, Bells Addition, and requests the closing of the alley through Block 2, Bells Addition, from Malta Street to Barr Street. Also attached are signatures of all of the owners in this block, except Lot 7, which belongs to a Mr. C. F. Woodward and Lot 19, which belongs to a Miss Margaret Nash. We understand Miss Nash's home is in Chicago, Illinois. These people have been unable to locate Mr. 0. F. Woodward, and we are attached a letter signed by Mr. E. R. Hawkins, Attorney representing Mrs. Harger, which states that they will convey frontage to the owner of lot 7 when requested. Mr. Cook, who is acquiring Lots 3 and 4, 25 and 26 from Mrs. Harger, states that he expects to build on these four lots, which will close the alley. We are attaching a plat, which shows the location of the alley through Block 2 of Bells Addition. We have shown in red line the lots on which Mr. Cook plans to erect the building. We have also shown an existing sanitary sewer all the -ray through this block. The entire block is vacant at the present time. The alley has never been open for public use. Since the alley is only ten (10) feet in width and crosses a very large open creek, we see no particular reason why it should not be closed. The property in this block is 5uned for commercial use. Our recommendation is that the alley through Block 2, Bells Addition, be closed as requested and that easements for all existing utilities be retained, and should a building or any other permanent structure be erected over the alley that the sanitary sewer be re-routed or replaced with cast iron pipe under said building or structure at the owner's expense. Thelin Re: Alley Closing in Public Works Director Block 2, Bell's 301 City Hall Addition Fort Worth, Texas Dear Sir: In connection with the closing of the alley in Block 2, Bell's Addition, Mr. C. F. Woodward, who owns Lot 7 in Block 2, is not available and his address is not known, Inasmuch as Mrs. Harger owns a portion of Lot 22 in Block 1 and part of the closed Pyres Street adjacent thereto, Lot 7 does not have frontage to the Freeway service drive which is similar to the situation we have taken care of in connection with Lot 5, Block 2, owned by Mr. W. H. Ogden. As Attorney for Eugenia Harger I have authority to advise that we are willing to convey that part of Lot 22 in Block 1, as well as the part of the closed Ayres Street adjacent thereto, to the owner of Lot 7 in consideration of the sum of $50.00, similar to the arrangement made with Mr. W. H. Ogden who is the owner of Lot 5 in Block 2, Bell's Addition. Yours truly E. R. Jones City Manager Building Dear Mr. Jones: We have received a copy of,your mimeographed memorandum addressed to Mr. Thelin, dated October 22, with reference to a request for closing an alley in Block 2, Bell Addition. We have investigated our records and find that we do not have any water mains in this alley. This block can be served by the existing and future mains in adjacent streets and we there- fore offer no objection to the closing of the alley. I expect to build a building on these four lots which will close the alley. The alley has never been used and is not open on the ground and could never be of any value to the to the property unless the alley is closed.
