TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Alan Plummer Associates, Inc. , (ENGINEER) made and entered into City Secretary Contract No.27615, (the CONTRACT) which was authorized by M&C C-19022 on the 26st day of March, 2002 in the amount of $958, 152 . 00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No . 1 in the amount of $12 , 161 . 85 administratively authorized March 3 , 2003, Amendment No . 2 in the amount of $23, 411 . 00 administratively authorized July 17 , 2003, Amendment No. 3 in the amount of $17, 982 . 31 administratively authorized September 30, 2003, Amendment No . 4 in the amount of $7, 700 . 00 administratively authorized January 26, 2004, Amendment No. 5 in the amount of $154 ,549 . 00 which was authorized by M&C C-20377 on November 2 , 2004, Amendment No . 6 in the amount of $286, 777 . 00 which was authorized by M&C C- 21106 on October 25, 2005, Amendment No. 7 in the amount of $75, 019 . 00 which was authorized by M&C C-21928 on January 9, 2007 Amendment No. 8 in the amount of $63,512 . 00 which was authorized by M&C C-24751 on March 01 , 2011; and NVHEREAS, the CONTRACT involves engineering services for the following project: Wastewater Diverson from East of Eagle Mountain Lake Drainage Stream to Big Fossil Creek Drainage Basin and Low Pressure Sewer System to serve the South Shore of Lake Worth; and WHEREAS, it has become necessary to execute Amendment No. 9 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated February 28, 2017, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $400, 155 . 00 . 2 OFFICIAL RECORD Page -1- CITY SECRETARY FT.WORTHS TX Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $1, 999,419 . 16 . Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. The work defined amends the previous contract for Wastewater Diversion from East Eagle Mountain Lake drainage based to Big Fossil Creek Drainage Basin. Introduction: The original Contract was authorized in 2002 and was most recently amended in 2011. Per instructions from the City Staff the project was brought to a close in May of 2009 and the ENGINEER delivered design contract documents that were finalized to approximately 80% stage. At the time of work stoppage, several items remained outstanding including easements, alignment finalization along Heritage Trace Parkway and advertisement and bid dates. It has been fourteen years since the original contract was authorized and seven (7) years have elapsed since the work stoppage, the plan sets and specification need to be modified and updated to reflect new field conditions, new utility crossings, new City standards and new land owner information. Several items are included in this scope of service that are significant changes to the current design. These include: Change to the alignment of the pipeline at four locations, changes to the location where the force main flow ends and the gravity pipeline begins and changes to the force main diameter. DESIGN MANAGEMENT. ENGINEER shall provide efficient and effective use of ENGINEER's and CITY's time and resources. ENGINEER shall manage change, ® communicate effectively, ® coordinate internally and externally as needed, and ® proactively address issues with the CITY's Project Manager and others as necessary to make progress on the work. 1.1. Managing the Team 1.1.1 Lead, manage and direct design team activities 1.1.2 Ensure quality control is practiced in performance of the work. 1.1.3 Communicate internally among team members 1.1.4 . Task and allocate team resources 1.2. Communications and Reporting 1.2.1 Attend two (2) pre-design project kickoff/chartering meetings with CITY staff to confirm and clarify scope, understand CITY objectives, and ensure economical and functional designs that meet CITY requirements. One meeting will be for the force main and one for the gravity main. 1.2.2 Conduct review meetings with the CITY at the end of each design phase. Three review meetings are planned for the gravity portion and three are planned for the force main portion. Meetings will be held at the 30%, 60% and 90% Stages. Prepare review comments log for the submission to the City for comments on the plans, if requested. The submissions could occur at the 30%, 60% and 90% design stages. 1.2.3 Prepare invoices and submit monthly in the format requested by the CITY. The project is planned for 30 months for design, bid and construction of two construction projects in one financial year. 1.2.4 Prepare and submit monthly progress reports in the format provided by the Water Department. 1.2.5 Include a summary table to show the percent complete for each task on the Level of Effort (LOE) spreadsheet with each invoice corresponding to the invoice amount. 1.2.6 Prepare and submit two baseline Project Schedules initially, and Project Schedule updates with a schedule narrative monthly, as required in Attachment D to this Standard Agreement and according to the City of Fort Worth's Schedule Guidance Document. One schedule will be for the force main portion, and the other for the gravity portion. The coordination includes TxDOT, rail road, franchise utilities, other consultants, County staff and private property owners. 1.2.9 With respect to coordination with permitting authorities, ENGINEER shall communicate with permitting authorities such that their regulatory requirements are appropriately reflected in the designs. ENGINEER shall work with regulatory authorities to obtain approval of the designs, and make changes necessary to meet their requirements, as part of the design scope. 1.2.10 Personnel and Vehicle Identification: When conducting site visits to the project location, the ENGINEER or any of its sub-consultants shall carry readily visible information identifying the name of the company and the company representative. 1.2.11 The ENGINEER shall conduct two pre-design walk through of the project alignment to review new field conditions. One site visit will be for the force main portion and the other will be for the gravity main. 1.2.12 The ENGINEER shall conduct one project review meeting (1) with the owner to review project progress of the force main design portion. CONCEPTUAL DESIGN (30 PERCENT). The Conceptual Design shall be submitted to CITY per the approved Project Schedule. This task is for new alignment areas only. The purpose of the conceptual design is for the ENGINEER to perform the following: 2.01 Study the project in areas that require change. 2.02 Identify and develop up to two alternative alignments (or partial re-alignments) that enhance the system at the following locations: 2.02.1 Boat Club Road right of way which impacts approximately 5,020 linear Feet of force main. The re-alignment of the force main is to be adjacent to the north right of way of Boat Club Road and outside of the ROW, since TxDOT roadway improvements are pending. (force main) 2.02.2 Park Drive Road right of way which impacts approximately 3,820 linear feet of force main. This change is due to the construction of the road adjacent to the school and the gas pipeline and easement. (force main) 2.02.3 N. Decatur Road right of way which impacts approximately 830 linear feet of gravity main. The re-alignment of the gravity main is to avoid a newly designed 48-inch Water Transmission main and the proposed gravity main is planned to be 2-5 feet inside the edge of the existing asphalt roadway. (gravity main) 2.02.4 Wagley Robertson Road crossing and areas west of the roadway which impacts approximately 900 linear feet of gravity main. This change is due to the development in the area. (gravity main) 2.03 Present (through the defined deliverables) these alternatives to the CITY, using an exhibit or role maps showing these options with aerial photos. 2.04 Recommend the alternatives that successfully addresses the design problem, 2.05 Obtain the CITY's endorsement of this concept and alignment selection to begin topographic survey collection. ENGINEER will develop the conceptual design of the infrastructure as follows. 2.1. Data Collection ® In addition to data obtained from the CITY, ENGINEER will research proposed improvements in conjunction with any other planned future improvements that may influence the project. ® The ENGINEER will also identify and seek to obtain data for existing conditions that may impact the project including but not limited to; utilities, agencies (TxDOT and railroads), City Master Plans, and property ownership as available from the Tax Assessor's office. Geotechnical Investigations 2.2.1 Previous Contract scope included this item and it is sufficient, and No additional data collection is planned in this amendment. 2.2.2 Review current report and assess impacts to the pipeline design. 2.3. The Conceptual Design Package shall include the following: 2.3.1 Conceptual Plans. One set of plans will be prepared for the force main portion, and another will be for the gravity main portion. The existing design sheets will be updated to current standards. The new alignment sheets will be'provided in the plan view only. 2.3.2 Proposed phasing of any sanitary sewer work that is included in this project documented in both the project schedule and narrative form. 2.3.3 Documentation of key design decisions in email format. 2.3.4 Estimates of probable construction cost. 2.3.5 Engineer shall confirm with the City the flows and the sizes of the proposed force main and the gravity main. 2.3.6 Copy of the Quality Control comments from the internal QC meeting. 2.4. Engineer shall conduct, with the Owner, one (1) project review meeting to review the 30% submittal. ASSUMPTIONS ® Two copies of the conceptual design package (30% design) will be delivered. ® PDF files created from design CAD drawings will be uploaded to the designated project folder in Buzzsaw. ® ENGINEER shall prepare the meeting notes of the Concept Review meeting and revise the conceptual design package (30% design of the new alignments, and updated plan sheets for alignments that have no change), if needed. ® ENGINEER shall not proceed with Preliminary Design activities without obtaining written approval by the CITY of the Conceptual Design Package. ® City will provide the latest sanitary sewer model for the East Eagle Mountain sewer basin and the big fossil basin to ENGINEER for review of the data and confirm recommended pipe sizes in the model. Preliminary plans and specifications shall be submitted to CITY per the approved Project Schedule. ENGINEER will develop the preliminary design of the infrastructure as follows. 3.1. Development of Preliminary Design Drawings and shall include the following: ® Cover Sheet ® A Proiect Control Sheet, showing all Control Points, used or set while gathering data. Generally on a scale of not less than 1:400. The following information shall be indicated for each Control Point: Identified (existing City Monument#WXYZ, PK Nail, 5/8" Iron Rod); X, Y and Z Coordinates, in an identified coordinate system, and a referred bearing base. Z coordinate on City Datum only; descriptive location (i.e. set in the centerline of the inlet in the South curb line of WXYZ Drive at the East end of radius at the Southeast corner of WXYZ Drive and ABC Street). ® Overall project easement layout sheet(s) with property owner information. ® Overall project sanitary sewer layout sheets.. The sewer layout sheets shall identify the proposed sewer main improvement/existing sewer mains and all sewer appurtenances in the vicinity. The entire alignment will be scaled sufficiently to show the sizes of the existing sewer mains within approximately 1,500 feet of the proposed pipeline. It should show surrounding street and street names. ® Property Map sheets will be produced to show the proposed easements, existing easements and property lines as well as the proposed pipeline. The Property Map sheets are usually on a scale that shows the detailed widths of the easements and the properties surrounding each impacted parcel. ® Coordinates on all P.C.'s, P.T.'s, P.l.'s, manholes, valves, mainline fittings, etc., in the same coordinate system as the Control Points. ® Bench marks per 1,000 ft. of plan/profile sheet—two or more. ® Bearings given on all proposed centerlines, or baselines. ® Station equations relating utilities to paving, when appropriate. ® Plan and profile sheets which show the following: proposed sanitary sewer plan/profile and recommended pipe size, manholes, , existing sample locations, existing fire line locations, existing utilities and utility easements, and all pertinent information needed to construct the project. The ENGINEER shall make provisions for reconnecting all identifiable water and/or wastewater service lines which connect directly to any main being replaced, including replacement of existing service lines within City right-of-way or utility easement. When the existing alignment of a water and sanitary sewer main or lateral is changed, provisions will be made in the final plans and/or specifications by the ENGINEER to relocate all service lines which are connected to the existing main and connect said service lines to the relocated main. ® Provide map showing location of new manhole, bends, or connections. The contract documents shall specify that it is the Contractor's responsibility to coordinate utility location, etc. manhole construction. ® The ENGINEER will prepare standard and special detail sheets for sewer line installation that are not already included in the CITY's specifications. These may include connection details between various parts of the project, tunneling details, boring and jacking details, details unique to the construction of the project, trenchless details, and special details. ® The ENGINEER will prepare plan sheets to show the soil boring locations and the soil boring logs on plan sheets to be included as an appendix to the force main plan set and the gravity main plan set. The anticipate number of sheets is 3 for each project. 3.2. Development of Preliminary Specifications shall include the following: ® The ENGINEER will prepare construction documents and specifications in accordance with City Standard specifications and shall provide special specifications for specialty items that are not available from the City. The documents shall the bid proposal, the easement documents, the SUE reports, the geotechnical reports, permits and any supplemental supporting documentation necessary for the Construction of the force main and the gravity main. One contract document will be prepared for the force main portion of the project and another for the gravity main portion of the project. 3.3. Geotechnical Investigation (Not included) ® Not included because previous Contract scope included the Geotechnical Investigation task and the work was completed. ® APAI will review the geotechnical report findings and assess if the findings impact the design. 3.4. Constructability Review ® Prior to the 60 percent review meeting with the CITY, the ENGINEER shall schedule and attend a project site visit with the CITY Project Manager and Construction personnel to walk the project. The ENGINEER shall summarize the CITY's comments from the field visit and submit this information to the CITY in writing. Engineer shall prepare an updated Estimates of probable construction cost based on the 60% Plans for the force main and one based on the 60% plans for the gravity main. 3.6 Engineer shall conduct, with the Owner, one (1) project review meeting to review the 60% submittal. 3.7. Utility Clearance 3.7.1 The ENGINEER will coordinate with City's Utility Clearance staff who will consult with the CITY's Transportation and Public Works Department, Water Department, and other CITY departments, public utilities, private utilities, private utilities and government agencies to determine the approximate location of above and underground utilities, and other facilities (current and future) that have an impact or influence on the project. ENGINEER will design CITY facilities to avoid or minimize conflicts with existing utilities, and where known and possible consider potential future utilities in designs. 3.7.2 The ENGINEER shall upload individual PDF files for each plan sheet of the approved preliminary plan set to the designated project folder in Buzzsaw for forwarding to all utility companies which have facilities within the limits of the project. The DWF files should be created directly from the CAD files as opposed to PDF files. If requested by utilities, ACAD files will be provided. 3.8. Traffic Control Plan 3.8.1 Develop a traffic control plan utilizing standard traffic reroute configurations posted as "Typicals" on the CITY's Buzzsaw website. The typicals need not be sealed individually, if included in the sealed contract documents. 3.8.2 Develop supplemental traffic control drawings as needed for review and approval by the Traffic Division of the Transportation and Public Works Department. These drawings shall be sealed by a professional engineer registered in the State of Texas. The supplemental traffic control drawings will be for two locations along the force main portion of the project. One location is adjacent to North Pointe Elementary School, the other location is along N. Decatur Road in the area between Milo Drive and Millstone Trail. 3.9 Erosion Control Plan 3.9.1 Develop erosion control plans to be included in the 60% submittal to the Owner. The plan shall show proposed erosion control features and proposed locations of temporary erosion control methods for construction of the pipeline. Up to four design sheets will be provided for the force main and up to four plan sheets will be provided for the gravity main. 3.10 The ENGINEER shall prepare for and conduct one public meeting during the preliminary design phase for the force main portion and one public meeting will be for the gravity sewer portion. 3.11 The ENGINEER shall create a Data Base listing names and addresses of residents and businesses affected by the project delivered in a Microsoft excel spreadsheet format and generated from Tarrant County Appraisal District information. The Engineer will prepare the iSWM Construction Plan according to the current CITY iSWM Criteria Manual for Site Development and Construction which will be incorporated into the SWPPP by the Contractor. The SWPPP design sheets will be included in the construction plans and will be prepared by the ENGINEER. 4.0.1 Draft Final plans (90%) and specifications shall be submitted to CITY per the approved Project Schedule. 4.0.2 Following a 90% construction plan review meeting with the CITY, the ENGINEER shall submit Construction Documents (100%) to the CITY per the approved Project Schedule. Each plan sheet shall be stamped, dated, and signed by the ENGINEER registered in State of Texas. 4.0.3 The ENGINEER shall submit a final design estimate of probable construction cost with both the 90% and 100% design packages. This estimate shall use ONLY standard CITY bid items. Bid Support (Two project; one force main, one gravity main) 5.1.1 The ENGINEER shall upload all plans and contract documents onto Buzzsaw for access to potential bidders. ® Contract documents shall be uploaded in pdf format, and the bid proposal in .xls file format. ® Unit Price Proposal documents are to be created utilizing CFW Bidtools only and combined in a specified spreadsheet workbook, Bid Proposal Worksheet Template, and will be populated and configured so that all pages are complete and the Summary Worksheet(s) in the workbook detail and automatically summarize the totals from the inserted Unit Price Proposal document worksheets. ® Plan Sets are to be uploaded to Buzzsaw in two formats, .pdf and .dwf files. The .pdf will consist of one file of the entire plan set. The .dwf will consist of individual files, one for each plan sheet, and will be numbered and named in a manner similar to that of the plan set index. 5.1.2 The ENGINEER shall sell contract documents and maintain a plan holders list on Buzzsaw from documents sold and from Contractor's uploaded Plan Holder Registrations in Buzzsaw. 5.1.3 The ENGINEER will develop and implement procedures for receiving and answering bidders' questions and requests for additional information. The procedures shall include a log of all significant bidders questions and requests and the response thereto. The log shall be housed and maintained in the project's Buzzsaw folder titled Request for Information. Two addenda are planned for the force main portion and two are planned for the gravity main portion. 5.1.4 The ENGINEER shall upload all approved addenda onto Buzzsaw and mail addenda to all plan holders. 5.1.5 Attend the bid opening in support of the CITY. 5.1.6 Tabulate and review all bids received for the construction project, assist the CITY in evaluating bids, and recommend award of the contract in writting. A copy of the Bid Tabulation and the CFW Data Spreadsheet created utilizing CFW Bidtools only are to be uploaded into the project's Bid Results folder on Buzzsaw. 5.1.7 Incorporate all addenda into the contract documents and issue conformed sets. 5.2 Final Design Drawings (Issued for Construction Drawings) 1) Final Design Drawings shall be submitted in both Adobe Acrobat PDF format (version 6.0 or higher) format and DWF format. There shall be one (1) PDF file and one (1) DWF file for the TPW plan set and a separate PDF and PDF file for the Water plan set. Each PDF and DWF file shall be created from the original CAD drawing files and shall contain all associated sheets of the particular plan set. Singular PDF and DWF files for each sheet of a plan set will not be accepted. PDF and PDF files shall conform to naming conventions as follows: I. TPW file name example — "W-1956_org4.7.pdf" where "W-1956" is the assigned file number obtained from the CITY, "_org" designating the file is of an original plan set, "47" shall be the total number of sheets in this file. One for the gravity portion and one for the force main portion. 6.1.2 After the pre-construction conference, the ENGINEER shall provide project exhibits and attend public meeting to help explain the proposed project to residents. The CITY shall select a suitable location and mail the invitation letters to the affected customers. One meeting will be held for the force main portion of the project and another will be held for the gravity main. 6.1.3 The ENGINEER shall visit the project site at requested intervals as construction proceeds to observe and report on progress. A total of four project site visits or construction meetings are included for the entire project. Two for the force main portion and two for the gravity main portion. 6.1.4 (Not Used) 6.1.5 As requested by the CITY, the ENGINEER shall prepare responses for up to two Requests for Information (RFIs) from the Contractor related to the force main portion and five RFIs related to the gravity main portion. Additional RFIs will be considered as special services. 6.1.6 As requested by the CITY, the ENGINEER shall provide necessary review for up to seven selected shop drawings related to the force main portion and up four re- submitted shop drawings. Additional shop drawing reviews will be considered as special services. 6.1.7 As requested by the CITY, the ENGINEER shall provide necessary review for up to seven selected shop drawings related to the gravity main portion and up four re-submitted shop drawings. Additional shop drawing reviews will be considered as special services. 6.1.8 The City shall prepare any Proposed Contract Modifications (PCM), respond to Contractor's Contract Modification Requests (CMR) and Change Orders. 6.1.9 The ENGINEER shall attend the "Final" project walk through and assist with preparation of final punch list. Two "Final" project walk through will be performed, one for the force main potion and the other for the gravity main portion. 6.2 Record Drawings (One set for the force main portion and one for the gravity portion). 6.2.1 The ENGINEER shall prepare Record Drawings from information provided by the CITY depicting any changes made to the Final Drawings (Construction Drawings) during construction. If conflicting information is found between the above listed markups, the CITY shall decide the appropriate corrections. 6.2.3 The CITY shall review the draft Record drawings and provide any comments to the ENGINEER. 6.2.4 The ENGINEER shall modify the Final Drawings electronically and shall place a stamp on the plans indicating that they represent Record Drawings of the project as constructed. The stamp shall be signed and dated by the ENGINEER and shall be placed on each plan sheet, whether there are any revisions on the sheet or not. Each sheet shall clearly indicate all changes which apply to that sheet by clouding and numbering, or other suitable means. 6.2.5 The following disclaimer shall be included with the Record Drawing stamp: ® These Record Drawings were prepared using information provided by others and represent the as constructed conditions to the extent that documented changes were provided for recording. The ENGINEER assumes no liability for undocumented changes and certifies only that the documented changes are accurately depicted on these drawings. 6.2.6 The ENGINEER shall submit a set of sealed Final Drawings, modified and stamped as Record Drawings, in PDF format on Compact Disk for record storage. The ENGINEER may keep copies of the information provided by the CITY for their files, but all original red-lined drawings shall be returned to the CITY with the Compact Disk. 6.2.6.1 Record Drawings shall also be submitted in both Adobe Acrobat PDF format (version 6.0 or higher) format and DWF format. ENGINEER will support and perform activities related to ROW and land as outlined below: 7.1. Right-of-Way Research ® The ENGINEER shall determine rights-of-way, easements needs for construction of the project. Required temporary and permanent easements will be identified based on available information, current design plans and recommendations will be made for approval by the CITY. 7.2. Right-of-Way/Easement Preparation and Submittal. 7.2.1 The ENGINEER shall prepare documents to be used to obtain right-of-way and permanent and/or temporary easements required to construct the improvements. Three for the gravity main portion and seven for the force main portion. 7.2.2 The ENGINEER shall submit the right-of-way and/or easement documents to CITY Project manager for real property acquisition 7.2.3 The documentation shall be provided in conformance with the checklists and templates available on the CITY's Buzzsaw site. 7.2.4 The ENGINEER shall confirm the easement widths and shapes with the City prior to preparing easement documents. 7.2.5 The ENGINEER shall review updated easement documents and update ownership information on easement documents that remain unrecorded. 7.3. Temporary Right of Entry Preparation and Submittal 7.3.1 Six meetings with private property owners are included. The meetings are for the gravity portion (3) and the force main portion (3) as necessary. ASSUMPTIONS ® Ten Easements or right-of-way documents will be necessary. ® Right-of-Way research and mapping includes review of property/right-of-way records based on current internet based Tarrant Appraisal District (TAD) information available at the start of the project and available on-ground property information (i.e. iron rods, fences, stakes, etc.). It does not include effort for chain of title research, parent track research, additional research for easements not included in the TAD, right-of-way takings, easement vacations and abandonments, right-of-way vacations, and street closures. SURVEY AND SUBSURFACE UTILITY ENGINEERING SERVICES. ENGINEER will provide survey support as follows. 8.1. Design Survey ® ENGINEER will perform field surveys to collect horizontal and vertical elevations and other information needed by ENGINEER in design and preparation of plans for the project. Information gathered during the survey shall include topographic data, elevations of all sanitary and adjacent storm sewers, rim/invert elevations, location of buried utilities, structures, trees (measure caliper, identify overall canopy, and have qualified arborist identify species of trees), and other features relevant to the final plan sheets. Existing drainage at intersections will be verified by field surveys. Spot elevations will be shown on intersection layouts with cross slope to fit intersecting grade lines. ® Collect Topographic survey information for approximately 10,600 linear feet. ® Collect coordinates and information regarding the locations of the D-holes/Level A SUE performed to locate franchise utility locations. ® The minimum survey information to be provided on the plans shall include the following: — A Project Control Sheet, showing ALL Control Points, used or set while gathering data. Generally on a scale of not less than 1:400: The following information about each Control Point; a.ldentified (Existing. CITY Monument#8901, PK Nail, 5/8" Iron Rod) b.X, Y and Z Coordinates, in an identified coordinate system, and a referred bearing base. Z coordinate on CITY Datum only. c.Descriptive Location (Ex. Set in the centerline of the inlet in the South curb line of North Side Drive at the East end of radius at the Southeast corner of North Side Drive and North Main Street). Coordinates on all P.C.'s, P.T.'s, P.I.'s, Manholes, Valves, etc., in the same coordinate system, as the Control. No less than two horizontal bench marks, per line or location. D1. CONSULTING SERVICES SCHEDULE DEVELOPMENT: The CONSULTANT shall prepare schedules for consulting services that meet the requirements described in this specification, showing by Critical Path Method (CPM) the planned sequence and timing of the Work associated with the Agreement. All submittals shall be submitted in PDF format, and schedule files shall also be submitted in native file format (i.e. file formats associated with the scheduling software). The approved scheduling software systems for creating the schedule files are: - Primavera (Version 6.1 or later or approved by CITY) - Primavera Contractor(Version 6.1 or later or approved by CITY) - Microsoft Project(Version 2003/2007 or later or approved by CITY)(PHASING OUT) D2. BASELINE CONSULTING SERVICES SCHEDULE: Following notice-to-proceed, the CONSULTANT shall develop, submit and review the draft detailed baseline consulting services schedule with the CITY to demonstrate the CONSULTANT's understanding of the Agreement requirements and approach for performing the work. The CONSULTANT will prepare the final detailed baseline consulting services schedule based on CITY comments, if any, and submit to the CITY no later than the submittal of the first project invoice. The following guidelines shall be adhered to in preparing the baseline schedule, and as described in further detail in the CITY's Schedule Guidance Document. a. The scope shall be subdivided by work breakdown structure (WBS) representing the tasks,subtasks, and activities associated with delivering the work. b. The schedule shall accurately describe the major work activities, key milestones, and dependencies/relationships as appropriate to the work. c. The schedule should include appropriate meetings, review periods, critical decision points,including third party utility dependencies and reviewing agencies. D3. PROGRESS CONSULTING SERVICES SCHEDULE: The CONSULTANT shall prepare and submit monthly to the CITY for approval the updated schedule in accordance with D1 and D2 and the CITY's Schedule Guidance Document inclusive. As the Work progresses, the CONSULTANT shall enter into the schedule and record actual progress as described in the CITY's Schedule Guidance Document. In addition, the CITY may require the CONSULTANT to submit a revised schedule demonstrating the proposed plan to make up the delay in schedule progress and to ensure completion of the Work within the allotted Agreement time. D5. SCHEDULE TIERS SPECIAL INSTRUCTIONS: The requirements for the schedule are determined based on the nature and needs of the project. The schedule tier for this project is stated at the top of this document. CONSULTANT shall submit each schedule relying on the CITY's current Schedule Guidance Document. D6. Adopt the attached Resolution expressing official Intent to reimburse expenditures with proceeds of future debt for Wastewater Diversion from East of Eagle Mountain Lake Drainage Basin to Big Fossil Creek Drainage Basin and Low Pressure Sewer System to Serve the South Shore of Lake Worth Project; 2. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the Water/Sewer DPN Fund in the amount of $1,133,155.00 from available funds for the purpose of property acquisitions and staff project management costs; and 3. Authorize execution of Amendment No. 9 to City Secretary Contract No. 27615 with Alan Plummer Associates, Inc., in the amount of $400,155.00 for a total revised contract in the amount of $1,999,419.16 for additional design and engineering services for the Wastewater Diversion from East of Eagle Mountain Lake Drainage Basin to Big Fossil Creek Drainage Basin and Low Pressure Sewer System to Serve the South Shore of Lake Worth (City Project No. 01309). DISCUSSION: On March 26, 2002, Mayor and Council Communication (M&C C-19022) the City Council authorized an Engineering Agreement with Alan Plummer Associates, Inc., in the amount of$958,152.00 for the Wastewater Diversion from East of Eagle Mountain Lake Drainage Basin to Big Fossil Creek Drainage Basin and Low Pressure Sewer System to Serve the South Shore of Lake Worth project. The Agreement was subsequently revised by eight previous amendments totaling $641,112.16, as follows: © Amendment No. 1 in the amount of $12,161.85 administratively authorized March 3, 2003. ® Amendment No. 2 in the amount of $23,411.00 administratively authorized July 17, 2003. • Amendment No. 3 in the amount of $17,982.31 administratively authorized September 30, 2003. o Amendment No. 4 in the amount of $7,700.00 administratively authorized January 26, 2004. ® Amendment No. 5 in the amount of $154,549.00 authorized November 2, 2004 (M&C C-20377). ® Amendment No. 6 in the amount of $286,777.00 authorized October 25, 2005 (M&C C-21106). © Amendment No. 7 in the amount of $75,019.00 authorized January 9, 2007 (M&C C-21928). ® Amendment No. 8 in the amount of $63,512.00 authorized March 01, 2011 (M&C C-24751). At the time the original agreement was executed, extensive proposed development east of the Eagle Mountain Lake Area warranted the installation of the sewer force and gravity mains from the Dosier htti)://at)ps.cfwnet.or2/council packet/mc review.asp?ID=24601&councildate=5/2/2017 5/4/2017 M&C Review Page 2 of 3 Creek Sewer Lift Station to the existing Big Fossil Creek collector. However, the slowdown of the economy in 2008/2009 curtailed all proposed development in the identified area which led to staff placing the project on hold and utilizing the construction funding on other projects. Recent on—going and pending development in the area now necessitate the construction of the project to handle projected sewage flows. Amendment No. 9 will allow for the project plans and specifications to be modified and updated to reflect current city standards, current field conditions along with utility conflicts and current property ownerships. The scope of services include easement preparation, alignment revisions, traffic control plans, design survey, subsurface utility engineering and environment assessment. Staff considers the amendment amount to be fair and reasonable for the scope of services proposed. In addition to the amendment amount, $733,000.00 is required for project management, real property acquisition and utility coordination. This project is anticipated to be included in a future revenue bond issue for the Water and Sewer Fund. Available cash within the Water and Sewer portfolio and the City's portfolio along with the appropriation authority authorized under the Direct Purchase Note program will be used to provide interim financing for this project until debt is issued. To the extent resources other than the Water and Sewer portfolio are used to provide interim financing, the Water and Sewer Fund will be charged interest that is equivalent to the overall rate of return being earned by the City portfolio (currently approximately one-percent annually). Should the City's portfolio not support the liquidity needed to provide an interim short-term financing source, another funding source will be required, which could mean issuance of securities under the Direct Purchase Note program or earlier issuance of Water and Sewer revenue bonds than is currently planned. Once debt associated with this project is sold, bond proceeds will be used to reimburse the Water and Sewer portfolio and the City's portfolio in accordance with the attached Reimbursement Resolution. The City Council adopted the Water Department's Fiscal Year 2017-2021 Five-Year Capital Improvement Plan on January 24, 2017 (M&C G-18927). This City Council adopted plan includes this specific project, with funding identified through the DPN program to be reimbursed with future revenue bonds. In accordance with the provisions of the Financial Management Policy Statements, Staff anticipates presenting revenue-supported debt issuances to the City Council for consideration within the next three years. This debt must be issued within approximately three years to provide reimbursement for these expenses. If that does not occur, the costs will no longer be reimbursable by issuing tax-exempt debt and the funding source will have to be made whole through other budgetary methods. Adoption of this Resolution does not obligate the City to sell bonds, but preserves the ability to reimburse the City from tax-exempt bond proceeds. Engineering for the Wastewater Diversion Design is one component of the overall project that includes project management, easement acquisition, utility coordination, material testing, inspection, construction, and contingencies. The overall project budget is $9,840,170.00. Design is expected to be completed by December 2017. Construction is anticipated to commence in January 2018 with construction of all phases to be completed by December 2019. This project will have no impact on the Water Department's operating budget when complete. M/WBE OFFICE: Alan Plummer Associates, Inc., is in compliance with the City's M/WBE Ordinance by committing to an additional 21 percent M/WBE participation on this Amendment No. 9. The City's M/WBE goal on this Amendment 20 percent. The project is located in COUNCIL DISTRICTS 2 and 7, Mapsco 32E, 32L, 32M, 33D, 33G, 33J,33K, 33L, 34A and 34B.
