0"N R E S O L U T I O N
A RESOLUTION DECLARING THAT CERTAIN LAND WITH-
IN THE CITY LIMITS OF THE CITY OF FORT WORTH
IS NO LONGER NEEDED FOR THE USE OF CITIZENS
AS A ROAD, SAVE AND EXCEPT THAT EASEMENTS ARE
RESERVED FOR ALL EXISTING UTILITIES.
WHEREAS, the Texas Highway Department presently owns
a small tract or parcel of land containing 0.544 of an acre
which was originally acquired for highway purposes within
the city limits of Fort Worth, Tarrant County, Texas; and,
WHEREAS, the Atchison, Topeka and Santa Fe Railway Com-
pany, a Delaware corporation, wishes to purchase subject
land from the State of Texas to facilitate its expansion of
new yard tracks presently being constructed immediately west
of and adjoining subject land on property presently owned by
said Railway Company; and,
WHEREAS, the Texas Highway Department has agreed to
recommend that subject land be declared surplus to its needs
for highway purposes and further has agreed to recommend sale
of subject land to said Railway Company, which is the sole
fee and mineral owner of land abutting the subject land pro-
posed for sale; and,
WHEREAS, one condition of the proposed sale of subject
land from the State of Texas to the Atchison, Topeka and
Santa Fe Railway Company is that said Railway Company obtain
a resolution from the City Council of the City of Fort Worth
stating that the land is no longer needed for its citizens
as a road; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
That the following 0.544 acres of land as described
below and as shown on Exhibit "A" attached hereto and made
a part hereof are no longer needed for use as a road, save
and except that easements are reserved and retained there-
in for all utilities, including electric and telephone fa-
cilities presently located within said 0.544 acres:
Being 0.544 of an acre of land more or
less situated in the County of Tarrant, State
of Texas, and being out of the A. F. Albright
Survey, Abstract No. 1849, and the J. Hibbins
Survey, Abstract No. 639, which 0.544 of an
acre of land more or less is particularly de-
scribed as follows:
BEGINNING at a point in the present east
right-of-way line of U.S. Highway 81 and 287;
Thence South 000 14' west along said
present east right-of-way line a distance of
699.98 feet to a point in the proposed east
right-of-way line of relocated U.S. Highway
81 and 287;
THENCE along said proposed east right-of-
way line the following courses and distances:
North 100 56' West a distance of 61.40 feet
to a point, said point being 176.02 feet south-
easterly from the centerline of relocated U.S.
Highway 81 and 287 opposite station 145+01.11;
North 250 28' West a distance of 77.64 feet
OOS to a point;
North 200 05' West a distance of 53.10 feet
to a point;
North Ol° 53' West a distance of 60.40 feet
to a point, said point being South 890 43' East
a distance of 193.36 feet and South 851 09' East
a distance of 54.87 feet from the southwest corner
of a tract of land conveyed by Worth Grain Company
to the State of Texas, as recorded in Vol. 5436,
page 995, of the Deed Records of Tarrant County,
Texas;
North 091 00' East a distance of 200.35 feet
to a point;
North 080 19' East a distance of 117.48 feet
to a point; and
^� North 070 45' East a distance of 146.55 feet
to a point.
The portion of the above described land in the
A. F. Albright Survey, Abstract No. 1849, being
a portion of a tract conveyed to the State of
Texas, recorded in Vol. 1467, page 518, of the
Deed Records of Tarrant County, Texas; and the
portion of the above described land in the J.
Hibbins Survey, Abstract No. 639, being the
east 30 feet of an old county road incorporated
into U.S. -Highway 81 (old Highway 2) in 1942.
