WHEREAS, the City of Fort Worth (City) and Dunaway Associates,
Inc, (Engineer) made and entered into City Secretary Contract No.
29019, (the Contract) which was authorized by the City Council by
MSC C-19701 on the 12th day of August, 2003 and subsequently
revised by three previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Water Main Extensions to Serve Walsh Ranch, Phase I .
WHEREAS, it has become necessary to execute Amendment No. 4 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:

Article I, of the Contract is amended to include the addition-
al engineering services specified in MSC C-21256, adopted by the
City Council on the 19th day of January, 2006 and further amplified
in a proposal letter dated October 12, 2005, copies of which are
both attached hereto and incorporated herein. The cost to City for
the additional services to be performed by Engineer total
$206,826.00.

Article II, of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $1,364,517.45. _-

3.
All other provisions of the Contract which are not expressly
amended herein shall remain in full force and effect.

Authorize Execution of Amendment No. 4 to the Engineering Agreement with Dunaway Associates,
Inc., for Walsh Ranch Water Main Extension, Phase 1
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 4 to City
Secretary Contract No. 29019 with Dunaway Associates, Inc., in the amount of$206,826.00, to provide for
additional engineering services, thereby increasing the contract amount to $1,364,517.45. Subsequent
amendments, if necessary, will be processed administratively, up to a $25,000 total.
DISCUSSION:
On August 12, 2003, (M&C C-19701) the City Council authorized an Engineering Agreement with Dunaway
Associates, Inc. in the amount of $965,406.95 for Walsh Water Main Extension, Phase 1. The agreement
provided for the design of 31,000 feet of 30 and 24-inch water line and a ground storage tank.
The agreement was subsequently revised by three previous amendments totaling $192,234.50 as follows:
. Amendment No. 1 (M&C C-19940, January 20, 2004) in the amount of $42,605 provided for the
design of an additional 3,500 feet of water line.
. Amendment No. 2 (City Secretary Contract No. 29588) in the amount of $24,302.50 and
administratively approved by the City Manager on February 27, 2004, provided for the necessary
services to acquire an alternate parcel of land for the proposed ground storage tank.
. Amendment No. 3 (M&C C-20561, March 8, 2005), in the amount of $125,377.00 provided for the
design of an additional 1,500 feet of water line and ground storage tank site due to the change in
location of the ground storage tank site.
In order to expedite construction, the project was divided into four units for design and construction
purposes. Units 1, 2 and 3, which consist of water main installation are under construction, and Unit 4, steel
ground storage tank.
Due to a recent collapse of a ground storage tank of similar design to the one proposed under Unit 4, in the
City of Ennis, Texas, on April 16, 2005, the Water Department decided to delay construction of the ground
storage tank until the report of the investigation of the collapse was released. Pending, the._inxestigation. the
Water Department and the developer of Walsh Ranch agreed that the City could construct a stand alone

water stand pipe (Unit 4) to provide water service to a reduced area and that the ground storage tank could
be constructed at a future date. Consequently, another unit (Unit 5), was created for the construction of the
ground storage tank. Construction of the water stand pipe, Unit 4 is underway.
The report of the Ennis collapse indicated that an inadequate foundation and not the design of the storage
tank caused it to fail. The Water Department is now comfortable with finalizing design and constructing of
the ground storage tank.
Amendment No. 4 will allow for the preparation of separate plans and contract documents for the ground
storage tank and the necessary revisions to the site layouttyard piping plan, mechanical instrumentation
diagram plan, ground storage reservoir/section plans, electrical schedules/schematics plans and loop
diagram plan. The amendment will also allow Dunaway Associates, Inc. to provide construction
management and inspection services during construction of the ground storage tank.
Dunaway Associates, Inc. proposes to provide the necessary additional engineering services for a lump
sum fee for$206,826.00. Staff considers this amount to be fair and reasonable.
Dunaway Associates, Inc. is in compliance with the City's M/WBE Ordinance by committing to 4% M/WBE
participation on this amendment No. 4. The City's goal on this amendment is 4%.
The project will be located in COUNCIL DISTRICTS 3 and 7, Mapsco 57W and X; and 76 D, H, J, M, N, O,
P, Q, and R.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds will be available in the current capital budget, as appropriated, of
the Commercial Paper—Water Fund.
