AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
O.A,K GROVE ROAD WEST
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUE5 AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon the following, to-wit:
OAK GROVE ROAD WEST: �'rom Oak Grove Road West to Oak Grove Road, known and
designated as Project No. 104-24000-273, a five-
inch th.ick h.ot-mix asphaltic concrete pavement on
a six-inch tfiick lime stabilized subgrade with
seven-incli high concrete curb and eighteen-inch
wide concrete gutter on a twenty-eight foot road-
way. Six-inch thick concrete driveways will be
constructed where specified.
together with concrete eu�bs, gutters, driveways and �ncidentals �o such iroprovements
on proper grade and line where sam� are not already so constructed, together with storm
sewers'and drains and other necessary incid�ntals and appurtenance�; all of said im-
provements to be const�ucted as and where shown on the Plans and in strfct accordance
with the Plan� and Specification� therefor; congract therefore has been made ars3

WHEREAS, the City Council of the City of Fort 6dorth, Texas, has caused the Public
Works Director to prepare and file estimaices of the cost of such improvements and
estimates of the amount per front foot proposed to bE assessed a�ainst abutting property
and the owners thereof, and such estimates have been examined, N, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL A� THE CI�Y OF FORT WORTH, T'EXAS, THAT:

Such estimates be, and they are hereby adopted and approved.

It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public pl�ces herefnafter described, with the amount or amounts
per front foot proposed to be assessed for sueh improvements agafn�t abutting pro-
perty and the owners thereofe are as follows, �o-wit;

The estimated cost of impxovements is $ 62,�.06.43 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereo£ for
concxete curb and gutter i� $ 5.g8 ; the estimated amount per front foot to
be assessed against abutting property and the os�ners thereof for pavement is $ 14.48 •
the estimated amount per front foot to be assessed again�t abuttin� px°opert}r and the �
owners thereof for -Q- wide concrete sidewalk is $ -�- ; the estimated
amount per square foot to be assessed against abuttin� property and the owners thereof for
six-inch thick concrete driveway is $ 2.23 per square foot; the total
est�.mated amount per front foot to be assessed against abutting property and the owners
thereof is $ 20.46 , plus the cost incurred for concrete dx°iveway construction
where specified.
A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, stree�s, avenues and public places, as well"as to all
owning or.claiming any interest in any such property. Such hearing shall be
given and held on the lst day of August , 19 7g , at 7:30 �.M.,
in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and
the City Secretary is hereby directed to give or.cause to be given notice,of the
time and place of such hearing and of other matters and facts in accordance with
the terms and provisions ot an Act gassed at the First Ca11ed Session.of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session,.now being known as Article 1105b of Vernon's Texas Civil Statutes
as amended by Acts 1967, 60�h Legislature, Page 365,_ Chapter 176, Section 1,
emergency effective May 12, 19670 �uch no�ice sha11 be.by advertisement�insexted
at least three (3) times in a newspaper published in the �ity of Fort Worth,
Texas, the first publication to be made a� least twenty-one (21) days before
�he date of said hearing; Said notice shall comply with and be in accordance with
the terms and provisions of said Act as amended, The City Secretary is fu�ttier
directed to give or cause to be given persona� notice of the time and place of
such hearing to all owning or claiming any property abutting ori said portions of
`highways, streets, avenues and public places, as well as to all owning or claiming
any interest in any such property, Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by deposi�ing such
writCen notice in the United..S.tates Mai� at least fourteen (14j days before the
date of the hearing, postage prepaid, i� envelopes addressed �o all persons
own�ng or claiming any interest in the respective properties abutting the high-
ways, stree,ts, avenues and public places or portions thereof to be improved, as
the names ef such persons are shown on the current rendered tax rolls of the Citp
of Fort Worth and at the addresses so shown', or if the name of sueh respective
owners do.not appear on such rendered ta�x ro11s, then address to,such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereone In those cases in which an owner of property
abutting a highway,-street, avenue or public place or portion or portions there-
of which is to be,improved is listed as "unknown" on the then.curren� City of
Fort Worth tax rolls, or the name of an owner is shown vn the City of Fort Worth
fax mlls but no addres� for such owner is shown,�no notice need be maileda In
those cases where the owner is shown to be an es�ate, the mailed notice may be
addressed to such estateo In this connection, the City Secre�ary shall prepare
and file or cause to be prepared.and filed with these proceedings a list of the-
'properties to be as,sessed,, the names of those persons ow�irig or claiming any
interest in said.properfies to whom the notice was mailed,�toge�her with the last
known addresses determined as aforesaid of the r�spective owners and those per�
sons owning or claiming any interest in said prop�rty,
The City Secretary shall certify that eaeh of the parties in said list whose
address is shown on the then current re.ndered or unrendered tax'rol�s of the City
o.f Fort Worth was mailed a copy.of the notice of hearing and shall further certify
the date or dates,on which said notice'was mailed. A copy of each notice shall be
attached to such'ce�tificate, The certificate of the Gity Secreta�y will be con-
clusive evidence of the facts therein recited, ,

'The Ci�y Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the Ci�y Cauncil and by
filing �he complete ordinance in the appropriate Ordinanc� Records of this City.
V.
This ordinance shall tak� effect and be in �full force and effect from and
after the da�e of its passage.

This project was initiated by a paving petition, signed by the owners of 53.2
percent of the adjacent property and received in the Assessment Paving Office
on February 1, 1978, On M�rch 7, 1978, the City Council authorized the Public
Works Director to design and advertise the project for bids (M&C G-3745).
Improvements
Oak Grove Road West will be improved with residential grade hot-mix asphaltic
concrete pavement with concrete curb, gutter, and driveway approacheso Also
included are required drainage appurtenances.

Based on the low bid and standard policy, approximately $15,023.78 is proposed
to be assessed against the four residentially zoned properties and one church,
which will be provided for by a bond fund transfer from the Revolving Fund
Unspecified. Cost to the City is approximately $47,082.65, including engi-
neering. Bond fund transfers are required from the Assessment Paving Unspeci-
fied Account for the City's construction costs and from the Engineering
Unspecified Account to supplement the engineering funds in the project
account.
