COUNTY OF TARRANT § WHEREAS, the City of Fort Worth ("City") and TranSystems Consultant Corporation ("Engineer") made and entered into City Secretary Contract No. 31980 (the "Contract') which was administratively executed by the City Manager on June 30, 2005; WHEREAS, the Contract involves engineering services for the following project: Inspection Services for Cleveland-Gibbs Road (Bridge Only) WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract for the construction inspection services of Cleveland-Gibbs Road bridge; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement that amends the Contract: 1. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer (due to extended completion time requirements) for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $29,840. Explanation of the extended time and corresponding additional compensation requirement is represented in M&C C-21235 approved by n City Council on January 10, 2006, and a letter dated August 24, 2005, a copy of both are attached hereto. 2. All other provisions of the Contract which are not expressly amended herein shall remain in full force and effect. EXECUTED on this the day of , 2006, in Fort Worth, Tarrant County, Texas. This exceeds the original contract amount of$21,840.00 budget by ;3,673.82 The original contract was exceeded due to contractor scheduling. Often when working with the contractor, it is difficult to predict when he will be working;efficiently with multiple rasks in progress. Multiple tasks in progess is the most efficient use of the inspector. The contractor has not been under any pressure to complete the project and this has resulted in more time beim required for inspection than originally allotted for. The contractor also had equipment problems which resulted in excess time being spent on the project to complete the task. Based on the remaining work effort,we are requesting an additional $8,000.00 be added to our contract so that we ruy complete the project. DISCUSSION: On June 30, 2005, the City Manager administratively executed an engineering agreement with TranSystems Consultant Corporation in the amount of $21,840.00 for inspection services during the construction of the Cleveland-Gibbs Road bridge. The purpose of the original agreement was to provide critical inspections during the construction of the bridge and to train Department of Engineering staff to develop in-house capabilities for similar projects in the future. Due to contractor scheduling problems, the bridge construction has taken longer to complete than originally anticipated. This amendment will allow continued inspection by TranSystems of the bridge construction through the completion of the project. Staff considers the proposed fee of $8,000.00 to be fair and reasonable for the additional services to be provided. This project is located in Council District 2.
