HomeMy WebLinkAboutResolution 2956~~ ,~,_~~ A Resolution NO ~~~~~ A RESOLUTION .AFFIRMING THAT THE PRIVATE DEVELOPER COMMITMENTS REQUIRED BY THE LAND USE/TRANSPORTATION JOINT VENTURE PROGRAM HAVE BEEN MET FOR THE HISTORIC HANDLEY PROJECT, REQUESTING THAT THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS FORWARD THE PROJECT INFORMATION TO THE TEXAS DEPARTMENT OF TRANSPORTATION FOR PLACEMENT IN THE STATEWIDE TRANSPORTATION IMPROVEMENT PROGRAM, AND AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS WITH THE TEXAS DEPARTMENT OF TRANSPORTATION AND WITH YOUGHAL CORPORATION WHEREAS on October 11 2001 the Regional Transportation Council selected the Historic Handley Project for funding in the amount of $268 560 through the Land Use/Transportation Joint Venture Program ("Program') for the redevelopment of property in the vicinity south of East Lancaster Avenue and north of the Union Pacific Railroad line between Handley Drive and Forest Avenue (the `Historic Handley Project") and WHEREAS Youghal Corporation and its lawful assigns (`Developer") will serve as the developer of the Historic Handley Project and WHEREAS pursuant to an agreement with the City the Developer will utilize the grant funds for the following work on the Historic Handley Project • Demolition of substandard curb and sidewalks adjacent to the Historic Handley Project • Construction of new Americans with Disabilities Act compliant sidewalks and pedestrian crosswalks • Installation of new pedestrian lighting, benches and trash receptacles • Landscaping, including street trees and installation of drainage and irrigation systems • With the concurrence of the City any other such work or construction meeting the requirements of the Program and WHEREAS the Developer has agreed to provide a twenty percent (20%) local match in the amount of $67 140 through cash/in kind contribution in the Historic Handley Project area, as required by the terms of the Program and pay for any additional costs related to the Project in excess of the total amount of the grant funds and I p,` .,.. WHEREAS the Developer has agreed to comply with all federal state and local provisions regulations and procedures in accordance with the Program and WHEREAS property within the Project area has been rezoned to MU 1 Low Intensity Mixed Use so as to allow mixed use development and to implement a redevelopment plan that meets the land use commitments of the Project, all of which are required in order for the City to be eligible to receive the grant (coll'ectively the Grant Prerequisites') and WHEREAS the City must submit this resolution to North Central Texas Council of Governments ("NCTCOG') in order for the Project to be placed in the Statewide Transportation Improvement Program which is required for the City to obtain the grant funds NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT 1 The City accepts a pledge by the Developer to provide a cash/in kind contribution as the twenty percent (20%) local match requirement under the Program and 2 The City certifies that the additional Grant Prerequisites have been met by the Developer and 3 NCTCOG is hereby requested to take the necessary action to place the Historic Handley Project in the Statewide Transportation Improvement Program and 4 The City Manager is hereby authorized to execute a Local Project Advance Funding Agreement with the Texas Department of Transportation governing the manner in which grant funds may be used to complete the Project and 5 The City Manager is hereby authorized to execute an agreement with the Developer governing the manner in which .grant funds may be used to complete the Project C ADOPTED th'S~ day of 2003 f .'' 3
