TO CITY SECRETARY CONTRACT
WHEREAS, the City of Fort Worth (CITY) and GSWW (having been
acquired by Burgess & Niple, Inc. ) , (ENGINEER) made and entered into City
Secretary Contract No. 32129, (the CONTRACT) which was authorized by the
City Council by M&C C-20821 on the 28th day of June, 2005 and
subsequently revised by two (2) previous amendments; and
WHEREAS, the CONTRACT was revised by: Amendment Number 1 in the
amount of $18, 875 . 00 which was authorized administratively on September
19, 2006and Amendment Number 2 in the amount of $21, 601 . 00 which was
authorized by M&C No. C-24112 on March 24, 2010; and
WHEREAS, the CONTRACT involves engineering services for the
following project :
Water and Sanitary Sewer Rehabilitation Contract 2004, STM-H; and
WHEREAS, it has become necessary to execute Amendment No. 3 to the
CONTRACT to include an increased scope of work and revised fee.
NOW, THEREFORE, CITY and ENGINEER, acting herein by and through
their duly authorized representatives, enter into the following
agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated June 7, 2012, a copy
of which is attached hereto and incorporated herein. The cost to City
for the additional design services to be performed by Engineer totals
$8, 863. 00 .
2 .
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $ 151, 679. 00 .
3.
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Mr. Chaubey:
This letter is our formal request for Supplemental Authorization to be compensated for additional
engineering services as requested by the City. Note that the original design contract was between GSWW,
Inc. and the City of Fort Worth. Since then, GSWW was purchased by Burgess & Niple. We operate as
Burgess & Niple. GSWW does not exist anymore.
Justification
City forces found a private sanitary sewer draining the residence at 2905 Alton Road. This sewer crosses
2909 Alton Road to get to the manhole at STA 3+60 of Sanitary Sewer L-2406. I had a meeting with the
City and the homebuilder for a new house at 2909 Alton Road. This amendment will incorporate the extra
engineering effort required for the additional work.
Our proposed Scope of Work is as follows:
We will have the proposed alignment surveyed and we will provide 2 sanitary sewer easements - one on
2905 Alton Road and one on 2913 Alton Road. We will provide a single plan & profile sheet of this design.
After construction, we will provide a mylar record drawing. This construction work will be added to the
current construction contract by change order. The City Inspector will coordinate getting the current
contractor to expose the existing utility lines so that the Surveyor can locate them and so we can design
the replacement sewer line.
Based upon this scope of work, the additional design cost proposed for Amendment No. 3 is $8,863.00.
