AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE
AMOUNT OF $57,000 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF
AUTHORIZING THE ACQUISITION OF ONE PERMANENT SEWER FACILITY
EASEMENT AND TEMPORARY CONSTRUCTION EASEMENT FROM MRS.
DONALD E. WILLIAMS AT 5951 WEST PIONEER PARKWAY, LOCATED IN
WEST ARLINGTON, TEXAS, FOR CONSTRUCTION OF SANITARY SEWER
REHAB CONTRACT 69; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated t:o the various City departments for Fiscal Year 2007-
2008 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Sewer Capital Projects Fund in the amount of $57,000 from available funds,
for the purpose of authorizing the acquisiifon of one permanent sewer facility easement and
temporary construction easement from Mrs. Donald E. Williams at 5951 West Pioneer Parkway,
located in west Arlington, Texas, for constructiion of Sanitary Sewer Rehab contract 69.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize the Acquisition of One Permanent Sewer Facility Easement and Temporary Construction
Easement from Mrs. Donald E. Williams at a Cost of $55,000.00 for 5951 West Pioneer Parkway
Located in West Arlington, Texas, for the Construction of Sanitary Sewer Rehab Contract 69; Pay
the Estimated Closing Costs of $2,000.00; Authorize the Acceptance and Recording of Appropriate
Instruments and Adopt Appropriation Ordinance (DOE No. 5405)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $57,000.00 from the Water and Sewer Operating Fund to the Sewer Capital
Projects Fund;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Sewer Capital Projects Fund in the amount of $57,000.00 from the available funds; and
3. Authorize the City Manager to approve the acquisition of one Permanent Sewer Facility Easement and
Temporary Construction Easement and authorize acceptance and recording of appropriate instruments
from Mrs. Donald E. Williams at 5951 West Pioneer Parkway, located in west Arlington, Texas, for
construction of Sanitary Sewer Rehab Contract 69.
DISCUSSION:
The easements are required for the construction of Sanitary Sewer Rehab Contract 69. The facility
consists of a 48 inch sanitary sewer main.
Mrs. Donald E. Williams has agreed to sell the easement at the negotiated amount of $55,000.00. The
acquisition cost is based on an outside independent appraisal of $47,814.00. The project requiring this
easement was set for letting by the Fort Worth Water Department in June, 2008. The time necessary to
consider and pursue condemnation for the subject easement would not have met that schedule.
Staff is of the opinion that a delay for condemnation would result in a project cost increase more than the
negotiated difference agreed to by the Grantor and therefore recommends that the City purchase the
easement for the negotiated price of $55,000. Closing costs are estimated at $2,000.00.
