HomeMy WebLinkAboutOrdinance 3566 ORDINANCE NO. &l�� AN ORDINANCE RELOCATING A TWELVE FOOT DRAINAGE EASEMENT ON LOTS 11 AND 12, BLOCK 10 WAVERLY PARK SECTION NO. 1, AN ADDI- TION TO THE CITY OF FORT WORTS, TARRAN`I' COMM.. TEXAS, NORTH TWO FEET, AND PROVIDING FOR THE PLACING GF EIGHT FEET OF THE EASEMENT ON LOT 12 AND FOR LEAVING FOUR FEET OF THE EASEMENT ON LOT 11; AND PROVIDING FOR THE REVERSION OF THE REMAINING TWO FEET TO THE OWNER OF LOT ll.. BLOCK 1, WAVERLY PARK SECTION NO. 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY CF FORT WORTH, TEXAS: SECTION 1. That the twelve foot drainage easement now existing six feet on Lot 11 and six feet on Lot 12, Block 1, Waverly Park Section No. 1, an addition to the City of Fort Worth, Tarrant County, Texas, is hereby moved and relo- cated in such a manner so that hereafter eight feet of said twelve foot drain- age easement shall be located and situated on Lot 12, Block 1, Waverly Park Section No. 1, and four feet of such drainage easement shall remain and be a part of Lot 11, Block 1, Waverly Park Section No. l; and that the remain- ing two feet of the existing drainage easement situated upon the said Lot 11, Block 1, Waverly Park Section No. 1, is hereby vacated and abandoned and will re- vert to the owner as provided by law. SECTION 2. 1 That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. That this ordinance shall take effect and be in full force and ef- fect from and after the date of its passage. Davis Re: Request for moving an City Manager Easement, Lot 11, Block 1, Building Waverly Park Sect. No. 1. Dear Sir: Attached is a letter dated October 18, 1956, signed by Mr. J. B. Diaches, Builder, 4.23 Insurance Bldg., Fort Worth, Texas, re- questing the moving of the Utility Easement on Lot 11, Block 1, Waverly Park Addition Section No. 1, two feet north. There is a plat attached that shows the location of the house that has recently been constructed on Lot 11, Block 1, the northerly side of the house extends over into the Utility Easement for a distance of one foot. Mr. Diaches states in his letter that it is necessary to move the easement two feet north to comply with the Veteran Administration requirements. He also states in a letter dated November 2, 1956, that he is the owner of the adjacent Lot 12 and that it is his desire that the easement be moved two feet north placing 8 feet of the easement on Lot 12. We are attaching a plat on which we have shown the proposed" request. Since Air. Diaches is the owner of Lot 12 we see no particular reason why the request should not be granted* our recommendation is that the 12 foot drainage easement (6 feet of which is on Lot 11 and 6 feet on Lot 12, Block 1, Waverly Park Addition) be moved North 2 feet thus placing 8 feet of the easement on Lot 12 and leaving 4 feet of the easement on Lot 11 which will clear the existing building by one foot. Worth, Texas Dear Sirs: Request is being made to move the easement on lot $ 11 block 1, Waverly Park Addition, 2 feet north. The reason for this is to clear the house on lot 11 from being situated on the easement line as shown on the survey.
