HomeMy WebLinkAboutOrdinance 22727-05-2017 ORDINANCE NO.22727-05-2017 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF $1,753,390.68 IN THE TRANSPORTATION IMPACT FEE CAPITAL LEGACY FUND, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE ADDITIONAL PROJECT COSTS IN THE OLD DECATUR ROAD PROJECT;PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the amount of$1,753,390.68 in the Transportation Impact Fee Capital Legacy Fund, from available funds, for the purpose of funding the additional project costs in the Old Decatur Road project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22394-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Old Decatur Road Project of the Transportation Impact Fee Capital Legacy Fund (39008) in the amount of $1,753,390.68 and reduce the fund balance in the Service Area G Project (UN9917) of that fund by the same amount; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Old Decatur Road Project of the Transportation Impact Fee Capital Fund (30108) in the amount of $859,011.22 and reduce the fund balance in the Service Area G Project (UN9917) of that fund by the same amount; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriation in the Old Decatur Road Project of the Street Improvements Fund Close (39409) in the amount of$199,959.00 (CFA#2005115; RD#346165; DOE#5045) and reduce the fund balance in the Unspecified Project of that fund by the same amount; and 4. Authorize the execution of a construction contract with Jackson Construction, Ltd., in the amount of $4,319,628.00 for Old Decatur Road Reconstruction from IH-820 to Angle Avenue and authorize a potential incentive payment in the amount of$90,000.00. DISCUSSION: The 2014 Bond Program included Old Decatur Road as an improvement project from IH-820 to Angle Avenue and is being delivered in two separate phases. Phase 1, (Mayor and Council Communication (M&C C-27500) was the construction of a roundabout intersection at Old Decatur Road and Angle Avenue and the extension of a large diameter water transmission main. Phase 1 was completed in August 2016. Phase 2 of the roadway improvement includes the construction of a three-lane street segment, capable of Logname: 20OLD DECATUR ROAD PHASE 2-CO2014 Page 1 of 3 being expanded to four lanes in the future when traffic volumes warrant. The project was advertised on January 12, 2017 and January 19, 2017 in the Fort Worth Star-Telegram using the low bid with potential incentives method. On February 9, 2017 the following bids were received: Bid Results ontractor I Bid Amount ackson Construction, LTD $4,319,628.00 cMahon Contracting L.P. $4,390,663.21 avecon Publimorks, LP $5,536,647.63 liAccelerated Critical Path, Inc $5,791,770.00 Jackson Construction, LTD, is the apparent low bidder. Old Decatur Road Reconstruction includes contingencies, Staff costs and potential incentives. Upon approval of this M&C, the total project budget is $10,186,139.07. There are potential incentives of$3,000.00 per day, up to a maximum $90,000.00, if the contractor delivers the project prior to a specified final completion date, of 300 calendar days. Failure to deliver the project by the specified final completion date will subject the contractor to liquidated damages of$1,250.00 per day for an unlimited number of days until final completion is achieved. Construction is anticipated to commence in June 2017 and be complete in 300 calendar days. MM/BE OFFICE: Jackson Construction, Ltd., is in compliance with the City's BDE Ordinance by committing to one percent MBE participation and documenting good faith effort. Jackson Construction, Ltd., identified several subcontracting and supplier opportunities. However, the MBE's contacted in the areas identified did not respond or did not submit the lowest bids. The City's MBE goal on this project is 13 percent. A portion of this project will include 2014 Bond Funds. Available resources within the General Fund will be used to provide interim financing for these expenses until debt is issued. Once debt associated with this project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official intent to reimburse. This project is located in COUNCIL DISTRICT 2. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budget as appropriated, of the Transportation Impact Fee Capital Legacy Fund, the Transportation Impact Fee Capital Fund, the Street Improvement Fund Close Fund and the 2014 Bond Program Fund. The current fund balance in the Service Area G Project of the Transportation Impact Fee Capital Legacy Fund is $1,825,389.80 and of the of the Transportation Impact Fee Capital Fund is $1,250,267.40. The current fund balance in the Unspecified Project of the Street Improvements Fund Close is $12,614,757.58.
