WHEREAS, the City of Fort Worth (City) and TranSystems
Corporation Consultants, (Engineer) made and entered into City
Secretary Contract No. 28436, (the Contract) which was authorized by
the City Council by M&C C-19457 on the 4th day of February 2003 and
subsequently revised by eight previous amendment; and
WHEREAS, the Contract involves engineering services for the
following project:
Berry Street Street-scape from Waits Avenue to Forest Park
Boulevard.
WHEREAS, it has become necessary to execute Amendment No. 9 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:

Article I, of the Contract is amended to include the additional
engineering services specified in M&C C-21253, adopted by the City
Council on the 19th day of January, 2006, and further amplified in a
proposal letter dated October 19, 2005, copies of which are both
attached hereto and incorporated herein. The cost to City for the
additional services to be performed by Engineer total $7,690.00 .

Article II, of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the total
fee paid by the City for all work and services shall not exceed the
sum of $343,299.00.

amended herein shall remain in full force and effect.

To expand the scope of the project, we are requesting_ an additional fee of
$7,690.00 dollars. The additional work is outlined below:
• Topographic survey of north portion of Walgreen property (Approx% acre)
• Prepare construction plans for relocation of existing driveway and site
modifications on Walgreen property. Plans will include grading, curb
layout, driveway layout, and pavement striping.

Authorize Execution of Amendment No. 9 to an Engineering Agreement with TranSystems
Corporation Consultants, for Berry Street Streetscape Project from Waits Avenue to Forest Park
Boulevard
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 9 to City
Secretary Contract No. 28436 with TranSystems Corporation Consultants, in the amount of $7,690.00 for
additional design"services, thereby increasing the contract amount to $343,299.20.
DISCUSSION:
On February 4, 2003, (M&C C-19457) the City Council authorized an engineering agreement with
TranSystems Corporation Consultants, in the amount of $262,376.00 for the design of Berry Street
Streetscape Project from Waits Avenue lo Forest Park Boulevard (City Secretary Contract No. 28436).
The agreement was subsequently revised by eight previous amendments totaling $73,233.20 as follows:
. Amendment No. 1 (City Secretary No. 28751) in the amount of $6,600.00 and administratively
approved by the City Manager on May 27, 2003, provided for the engagement of a professional
geotechnical firm to test and make recommendations to aid in the design of the new pavement.
. Amendment No. 2 (City Secretary No. 29117) in the amount of $18,370.20 and administratively
approved by the City Manager on September 30, 2003, provided for the utilization of a sub-surface
utility contractor to investigate and determine the locations of existing underground utilities.
. Amendment No. 3 (City Secretary No. 29458) in the amount of $20,285.00 and administratively
approved by the City Manager on January 21, 2004, provided for the additional engineering services
necessary to augment the limits of the project to include the south side of Berry Street between
McCart and Forest Park, which was not originally a part of the project.
. Amendment No. 4 (City Secretary No. 29736) in the amount of $2,000.00 and administratively
approved by the City Manager on April 6, 2004, provided for the preparation of additional exhibits on
the project.
. Amendment No. 5 (City Secretary No. 30904) in the amount of $9,260.00 and administratively
approved by the City Manager on November 10, 2004, provided for the engineeri.^.g efforts necessary
to prepare exhibits to inform residents along Berry Street of the proposed proje

. Amendment No. 6 (City Secretary No. 31299) in the amount of $4,500.00 and administratively
approved by the City Manager on February 2, 2005, provided for preparation of additional easements
for 10 parcels of land.
. Amendment No. 7 (City Secretary No. 31877) in the amount of $7,160.00 and administratively
approved by the City Manager on May 25, 2005, provided for the additional survey and engineering
services necessary to prepare construction plans for the CVS property.
. Amendment No. 8 (City Secretary No. 32151) in the amount of $5,058.00 and administratively
approved by the City Manager on July 28, 2005, provided for survey and engineering services
required to revise the construction plans for the Kings Liquor property.
Amendment No. 9 will address the following:
Additional topographic survey and engineering is necessary for the preparation of construction plans for the
relocation of existing driveway and site modifications on the Walgreen property on Berry Street. Included in
the efforts are grading, curb layout, driveway layout and pavement striping.
TranSystems Corporation Consultants proposes to perform the additional services for a lump sum fee of
$7,690.00. City staff considers this fee to be fair and reasonable for the scope of services proposed.
This project is located in COUNCIL DISTRICT 9, Mapsco 76 X.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the
Street Improvements Funds.
