HomeMy WebLinkAboutResolution 2806JOINT RESOLUTION OF THE C{TIES OF LAKE WORTH AND FORT WORTH LAKE WORTH RESOLUTION N0.764 FORT WORTH RESOLUTION NO. °~~ WHEREAS the City of Lake Worth and the City of Fort Worth have approved a Joint Ordinance and Bouhdary Agreement (Lake Worth Ordinance No 621 and Fort Worth Ordinance No. 14502) whereby Fort Worth disannexed and Lake Worth Annexed 2.792 acres situated in the J Wilcox Survey and the J.M. Basquez Survey to facilitate development along State Highway 199 ("Jacksboro Highway") in Lake Worth; WHEREAS, an unnamed tributary encompasses a drainage area of approximately 1 092 acres extending east to west along the city limit boundary between the Cities of Lake Worth and Fort Worth, beginning near the intersection of Northwest Centre Drive and State Highway 199 and. ending at the point where the unnamed tributary enters the waters of Lake Worth as shown on Exhibit A including the property that was the subject of the Joint Ordinance and Boundary Agreement; WHEREAS a retail development is planned for a portion of the watershed area at the southwest comer of Jacksboro Highway and 1 H. 820 as shown on Exhibit A WHEREAS the planned retail development will be located primarily in the City of Fort Worth, with the exception of a portion of the parking lot, which is proposed to be located in the City of Lake Worth, as shown on Exhibit A WHEREAS Lake Worth and Fort Worth acknowledge that it is in the best interest of both cities and their citizens to cooperate in resolving drainage issues in the watershed area, with due regard for the percentage of the responsibility of each city with 68% of the responsibility being the City of Lake Worth and 32 % of the responsibility being the City of Fort Worth, WHEREAS, Lake Worth and Fort Worth further acknowledge that Charbonneau Road, a public roadway that could provide access from the planned retail development to Jacksboro Highway is currently substandard and will need to be improved in order to allow reasonable access to the planned retail development; WHEREAS, Lake Worth and Fart Worth acknowledge that these issues must be addressed holistically as the area continues to develop NOW THEREFORE, IT IS RESOLVED BY THE CITY COUNCILS OF THE CITIES OF LAKE WORTH AND FORT WORTH That the Cities of Lake Worth and Fort Worth will cooperate in addressing drainage issues in the watershed area, with due regard to the percentage of responsibility That the Cities of Lake Worth and Fort Worth will require developers of the watershed area to address drainage issues relating to their developments, share information concerning proposed development and drainage mitigation measures in the area, and participate in the cost of engineering and constructiori of improvements acceptable to both cities as appropriate; That the Cities of Lake Worth and Fort Worth wilt require developers in the watershed to detain stormwater runoff on-site; at the developers' expense, in a manner so as not to increase the volume or velocity of storrnwater runoff until such time as adequate permanent downstream • drainage improvements are completed; and t That the Cities of Lake Worth and Fort Worth will require developers of property accessing Charbonneau Road to participate in the cost of the necessary improvements to the '' roadway in accordance with city ordinances and thereupon will allow reasonable access to the same. ~, APPROVED by the City Council of the City of Lake Worth on this ~ day of " ~ ~~ , 2002. t Attest: i h I Ci tary CI y of Lake Worth ~~ 4 i • ,a M By~ GJ~~ ~~-~,~,4...~ Walter Bowen Mayor City of Lake Worth APP/RO'VED AS TO FORM AND LEGALITY L~/~ Wayne K.
