HomeMy WebLinkAboutResolution 2826v A Resolution No ~~a~ AUTHORIZING THE MAYOR OF THE CITY OF FORT WORTH ("CITY") TO EXECUTE A CERTIFICATE APPROVING THE ISSUANCE OF MULTIFAMILY HOUSING REVENUE BONDS BY THE TRINITY RIVER PUBLIC FACILITY CORPORATION FOR OVERTON PARK TOWNHOMES, 5501 OVERTON RIDGE BLVD. • WHEREAS, the Trinity River Public Facility Corporation ("TRPFC") is a public non-profit corporation created, iri part, to assist the Fort Worth Housing Authority m financing the costs of acquiring, constructing and equipping replacement housing units for current residents of Ripley Arnold Place and Ripley Arnold Addition, and WHEREAS, TRPFC wishes to issue tax exempt multifamily housing revenue bonds ("Bonds") in order to finance the acquisition, construction and equipping of a 216 unit multifamily residential facility known as Overton Park Townhomes, to be located at 5501 Overton Ridge Blvd. in the City and WHEREAS, in order for such Bonds to be issued, Section 147(f)(2)(A) of the Internal Revenue Code requires the prior approval of each governmental unit having jurisdiction over the area in which the multifamily housing facility m question is located, and WHEREAS, Section 147(f)(2)(B) of the Internal Revenue Code deems such a Bond issuance to be approved by a governmental unit if the elected representative of the governmental unit approves the Bond issue following a public hearing concerning the issuance and the nature of the multifamily housing facility m question, and WHEREAS, a public hearing concerning the Bond issue and the nature of the Overton Park Townhomes has previously been held, as evidenced by the certificate attached hereto NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH That Mayor Kenneth Barr is hereby authorized to execute the attached Approval Certificate evidencing approval by the City Council of the Bond issuance. APR 16 ~ ~,..~. ~~ cccy s~tuy of tai GitY of port Worth,l~a~as ~ '~ APPROVAL CERTIFICATE The undersigned Mayor of the City of Fort Worth (the `City") hereby certifies m connection with the issuance of Multifamily Housing Revenue Bonds (GNMA Collateralized Mortgage Loan -Overton Park Townhomes Project) Series 2002 (the `Bonds") by the Trinity River Public Facility Corporation (the `Issuer") as follows. 1 I am duly elected for a term ending May 2003 at an at large election within the Crty and I am currently the incumbent and acting Mayor of the City Such office is the chief elected office of the City 2. Issuer has represented that the Bonds will be issued for the public purposes of financing costs of acquiring, constructing, and equipping a 216 unit multifamily residential facility known as Overton Park Townhomes to be located at 5501 Overton Ridge Boulevard in the Crty of Fort Worth, Tarrant County Texas (the `Project") It is anticipated in the plan of finance for the Project that the Bonds will be delivered as Bonds the interest on which is excludable from the gross income of the owners thereof for purposes of federal income taxation. 3 There has previously been conducted a public hearing, following reasonable public notice, with respect to the issuance of the Bonds. The minutes of such hearing are attached to this Certificate as Exhibit A. 4 This Certificate is provided to comply with the provisions of Section 147(f) of the Internal Revenue Code of 1986, as amended. 5 The Bonds are hereby approved. IN WITNESS WHEREOF I have hereunder set my hand this " ~ Kenneth Barr Mayor City of Fort Worth • Exhibit A CERTIFICATE AS TO PUBLIC HEARING I hereby certify that the following are true and accurate minutes of a public heanng conducted m connection with the issuance of `Tnmty River Pubhc Facility Corporation Multifamily Housing Revenue Bonds (GNMA Collateralized Mortgage Loan Overton Park Townhomes Project) Serves 2002 The public heanng was held m accordance with published notice commencing at 5 30 p.m. on February 21 2002 at the Fort Worth Housing Authority Administrative Office, 1201 East 131i' Street, Fort Worth, Texas 76102 and was conducted by Antoinette Jackson of the law firm of Coats, Rose, Yale, Ryman & Lee, P C counsel to Trinity River Public Facility Corporation. Upon opening the heanng, Ms. Jackson explained the nature of the hearing and the purpose of the financing, including the acquisition, construction and equipping a 216 unit multifamily residential facility known as Overton Park Townhomes (the `Project") Ms. Jackson continued that the required Notice for the Pubhc Hearing for the Project had been published m the Fort Worth Star Telegram She invited any interested person to continent on the matters to which the heanng applied.
