Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$1,500,000.00 from available funds; and 2. Authorize the execution of a contract with Conatser Construction TX, LP, in the amount of $1,250,000.00 for 2017 Water Emergency Response Contract which includes two optional renewals, (CPN 100774). DISCUSSION: The work to be performed under this contract consists of replacing and/or relocating large diameter water mains and other pertinent construction required in response to emergency water main break incidents. The project was advertised for bid on January 19, 2017 and January 26, 2017 in the Fort Worth Star-Telegram and on March 2, 2017, the following bids were received. Bidder Amount Time of Completion Conatser Construction TX, LP $11,969,763.20 365 Calendar Days William J. Schultz, Inc. d/b/a Circle C Construction $12,551,530.00 Company In addition to the contract amount, $250,000.00 is required for project management, material testing and inspection. The bid documents included a stipulation that the total quantities listed may not reflect actual quantities and that the amount budgeted for the projects is $1,250,000.00. Final payments will be made based on actual measured quantities. The bid documents also included a stipulation giving the City the option to renew (subject to appropriated funding) this contract two times under the same terms, conditions and unit prices. This project will have no impact on the Water Department's operating budget when completed. Construction under this contract is on an as-needed basis. Additional pre-qualifications are required for this contract as follows: Bidder shall 2 provide an acceptable experience record for emergency repair of large diameter water 3 mains. Bidder shall submit manpower and equipment records along with the resume(s) 4 of key personnel who will be assigned to work on the emergency.Bidders must provide 5 a plan of action for immediately responding when contacted about an emergency, 6 staying on the site until completion of the emergency repair and handling more than one 7 emergency work order at a time.An acceptable experience record must reflect the 8 Bidder's experience with emergency work of the same nature and magnitude as that of 9 this contract(emergency repair of 24"-54"diameter water mains)and such experience 9 10 must have been gained not more than four(4)years prior the date on which bids are to 9 11 be received for this project.The names and contact person(s)of past clients for projects 12. completed within this time frame along with their addresses and telephone numbers shall 13 be supplied. The requested material must be submitted to the City no later than fourteen 14 (14)days prior to the date of the opening of the bids. City reserves the right to reject any or all Bids, including without limitation the rights 2 to reject any or all nonconforming,nonresponsive, unbalanced or conditional Bids 3 and to reject the Bid of any Bidder if City believes that it would not be in the best 4 interest of the Project to make an award to that Bidder, whether because the Bid is 5 not responsive or the Bidder is unqualified or of doubtful financial ability or fails to 6 meet any other pertinent standard or criteria established by City. City also reserves 7 the right to waive informalities not involving price, contract time or changes in the 8 Work with the Successful Bidder. Discrepancies between the multiplication of units 9 of Work and unit prices will be resolved in favor of the unit prices. Discrepancies 10 between the indicated sum of any column of figures and the correct sum thereof will 11 be resolved in favor of the correct sum. City may consider the qualifications and experience of Subcontractors, Suppliers, and 23 other persons and organizations proposed for those portions of the Work as to which 24 the identity of Subcontractors, Suppliers, and other persons and organizations must 25 be submitted as provided in the Contract Documents or upon the request of the City. 26 City also may consider the operating costs, maintenance requirements,performance 27 data and guarantees of major items of materials and equipment proposed for 28 incorporation in the Work when such data is required to be submitted prior to the 29 Notice of Award. 30 31 17.3. City may conduct such investigations as City deems necessary to assist in the 32 evaluation of any Bid and to establish the responsibility, qualifications, and financial _ 33 ability of Bidders,proposed Subcontractors, Suppliers and other persons and 34 organizations to perform and furnish the Work in accordance with the Contract 35 Documents to City's satisfaction within the prescribed time. 36 37 17.4. Contractor shall perform with his own organization, work of a value not less than 38 35% of the value embraced on the Contract, unless otherwise approved by the City. 39 40 17.5. If the Contract is to be awarded, it will be awarded to lowest responsible and 41 responsive Bidder whose evaluation by City indicates that the award will be in the 42 best interests of the City. _ 43 44 17.6.
