HomeMy WebLinkAboutResolution 2834A Resolution No ~c~~ A RESOLUTION AUTHORIZING THE CITY OF FORT WORTH TO INTERVENE IN GAS UTILITY DOCKET N0.9304 BEFORE THE RAILROAD COMMISSION OF TEXAS WHEREAS, on May 8, 2002 TXU Lone Star Pipeline ("TXU") filed with the Railroad Commission of Texas (the "Railroad Commission") a statement of intent to surcharge residential and commercial gas customers who are residents of the City of Fort Worth ("City") to cover future, unpredictable expenses associated with the implementation by TXLT of a pipeline integrity and safety assessment program ("Rate Filing"); and WHEREAS, because the Rate Filing relates to TXLT Gas s rates and services in the City the City has standing to intervene in this Rate Filing pursuant to Section 103 023 of the Texas Utilities Code; and WHEREAS, Section 103 022 of the Texas Utilities Code allows the City to retain professional services to assist the City in proceedings before the Raikoad Commission such as this Rate Filing; and WHEREAS, rt is m the public interest for the Crty to intervene m this Rate Filing; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH 1 That the City either on its own or through a consortium of other affected mumcipalities in which the City is a member ("Consortium"), is hereby authorized to intervene in the Rate Filing and to retain professional services to assist the Crty in the Rate Filing. 2. That the Consortium is hereby authorized to take all reasonable steps before the Railroad Commission or the courts in order to represent the City's interests in this Rate Filing. 3. The City Secretary is hereby duected to deliver a certified copy of this Resolution to the following: (i) on behalf of TXU Gas, Autry Warren, Rate Manager TXU Gas Distribution, 1601 Bryan Street, Dallas, Texas 75201 3402 and (ii) on behalf of the Consortium, Mr Jay B Doegey Crty Attorney Crty of Arlington, Post Office Box 231 Arlington, Texas 76004-0231 r s
