ZS7k- ZSECOND AMENDMENT TO TRACT 22 LEASE AGREEMENT
BETWEEN THE CITY OF FORT WORTH AND
TARRANT REGIONAL WATER DISTRICT
WHEREAS, the City of Fort Worth, Texas, a Texas home rule municipal corporation
("Tenant") entered into a Tract 22 Lease Agreement ("Agreement") (City Secretary Contract No.
42578) effective as of July 29, 2011, with Tarrant Regional Water District, a Water Control and
Improvement District ("District") for leased premises located at 1000 Calvert Street Fort Worth,
Texas, more particularly described in the Agreement ("Leased Premises); and
WHEREAS, Tenant and District executed an Amendment to the Agreement dated May 6,
2013 (City Secretary Contract No. 42578-A1) deleting Section 2.0 of the Agreement and
renumbering Section 2.D. of the Agreement to Section 2.C.; and
WHEREAS; The Agreement shall expire on July 29, 2019; and
WHEREAS, Tenant and District desire to extend the term and amend certain provisions
of the Agreement, as specified below;
NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged, Tenant and District hereby agree as follows:
I.
1. Section 2.A. is amended as follows.
A. The Initial Term of the Agreement shall end on July 29, 2022.
2. Section 2.13. shall be deleted in its entirety and replaced with the following:
Tenant shall be granted five (5) one (1) year each renewal options at the end of
the Initial Term of the Agreement, subject to agreement by the District, which
agreement the District may withhold, condition or delay at its sole discretion.
Tenant must provide ninety (90) days' written notice to District of its intent to
exercise each renewal option prior to the end of the Initial Term or end of any
renewal period ("Renewal Term"). Any Renewal Term shall be upon the same
terms and conditions as the Initial Term, as set forth herein.
3. Sections 9.A. and 9.13. of the Agreement shall be deleted in their entirety and
replaced with the following;
9. Alterations and Improvements. Tenant shall have the right to make alterations and
improvements to the Leased Premises ("Tenant Improvements"). All Tenant Improvements
which remain on the Leased Premises after the termination of this Agreement shall become the
property of the District and may be disposed of as the District may determine wi or

II.
All other terms and conditions of the Agreement remain unchanged and in full force and
effect.

HEARING:
SUBJECT: Authorize Execution of a Second Amendment to Tract 22 Lease Agreement with Tarrant
Regional Water District for Leased Premises Located at 1000 Calvert Street, Fort Worth,
Texas, for Use by the Police Department (COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the execution of a Second Amendment to Tract 22 Lease Agreement with Tarrant
Regional Water District for property located at 1000 Calvert Street, Fort Worth, Texas, for use by the
Police Department; and
2. Authorize the City Manager or his designee to execute the appropriate documents concerning the
second amendment to the Lease Agreement.
DISCUSSION:
In 2011, the City of Fort Worth entered into an eight-year Lease Agreement with Tarrant Regional
Water District (TRWD) for the property and improvements located at 1000 Calvert Street for use as a
Police and Fire Training Academy (City Secretary Contract No. 42578). With the pending sale of the
City's property located at 350 West Belknap Street to Tarrant County, the City will need to relocate
police personnel currently occupying the property. The use of the former Police and Fire Training
Academy property owned by the Tarrant Regional Water District provides the necessary space to
temporarily relocate the police personnel until a permanent facility solution can be developed.
The TRWD has agreed to extend the lease term through July 29, 2022, with five one-year renewal
options being granted to the City with the consent of TRWD. The rental rate for the property will
remain at$10.00 per year and the City will continue to be responsible for all utility service, repair and
maintenance costs. The lease amendment also allows the City to make the required alterations and
improvements to the facility in order to accommodate the relocated police operations.
This property is located in COUNCIL DISTRICT 2, Mapsco 62Y.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are appropriated in the General Fund, Police Department
Budget sufficient to cover the lease payments outlined under this Agreement. Future year payments
will be subject to appropriation.
