HomeMy WebLinkAboutResolution 2853A Resolution NO ~~ AFFIRMING THAT THE PRIVATE DEVELOPER COMMITMENTS REQUIRED BY THE TRANSPORTATION-LAND USE JOINT VENTURE GRANT PROGRAM HAVE BEEN MET FOR THE MAGNOLIA GREEN DEVELOPMENT PRJOECT AND REQUESTING THAT THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNENTS PLACE THE MAGNOLIA GREEN PROJECT IN THE STATEWIDE TRANSPORTATION IMPROVEMENT PLAN WHEREAS, on October 11 2001 the North Central. Texas Council of Governments ("NCTCOG') nominated the Crty of Fort Worth ("City") to receive a grant m the amount of $1,233,688 through the Texas Department of Transportations ("TxDOT") Transportation-Land Use Joint Venture Grant Program (the `Grant") for the redevelopment of property in the vicinity of the southwest corner of Hemphill Street and Rosedale Street (the `1Vlagnolia Green Project" or `Project") and WHEREAS Pennsylvania Avenue Limited Partnership and its lawful assigns ("Developer") will serve as the developer of the Magnolia Green Project; and WHEREAS, pursuant to an agreement with the Crty the Developer will utilize the Grant funds for the following work on the Magnolia Green Project: • Demolition of substandard curb and sidewalks relevant to the Project; • Construction of concrete sidewalk and curbs, including up to 8 block faces of sidewalk reconstruction or new construction, • Construction of crosswalks with back paver accents at various intersections, • Installation of new pedestrian lighting and wayfindmg systems, benches, and trash receptacles; • Landscaping and installation of drainage and irngation systems, • Location of TXLT electric utility lines underground, and, • With the concurrence of the Crty any other such work or construction meeting the goals and objectives of the Grant and are eligible expenses under the Grant; and WHEREAS the Developer will provide a twenty percent (20%) local match m the amount of $308,422 through the dedication of certain land m the Magnolia Green Project area, as required by the terms of the Grant, and pay for any additional costs related to the Project above the total amount of the Grant funds, and WHEREAS property within the Protect area has been rezoned to allow mixed-use development and the Developer has pledged to coordinate streetscape improvements in accordance with Fort Worth South design standards and to implement a redevelopment plan that meets the land use commitments at the Prof ect site, all of which are required m order for the City to be eligible to receive the Grant (collectively the `Grant Prerequisites")• and WHEREAS, m order for the Protect to be placed m the Statewide Transportation Improvement Plan (the `STIP"), which is required m order for the City to obtain the Grant funds from TxDOT NCTCOG requires that the City Council adopt a Resolution stating that the Developer's land dedication satisfies the twenty percent (20%) local match required by the Grant and the other Grant Prerequisites have been met. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH THAT 1 The twenty percent (20%) local match requirement under the Grant will be met through the dedication of certain land m the Magnolia Green Protect area by the Developer Pennsylvania Avenue Limited Partnership 2. The additional Grant Prerequisites have been met. 3. NCTCOG is hereby requested to place the Magnolia Green Protect m the August 2002 revisions to the STIP AND IT IS SO RESOLVED.
