HomeMy WebLinkAboutOrdinance 22768-06-2017ORDINANCE NO. 22768-06-2017 AN ORDINANCE AMENDING CHAPTER 20 (LICENSES AND MISCELLANEOUS BUSINESS REGULATIONS) ARTICLE II (AMUSEMENTS), DIVISION 4: DANCE HALLS, SECTION 20-66 AND DIVISION 5: POOL HALLS, SECTION 20-97, OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (ZO15), AS AMENDED, BY REPEALING THE LANGUAGE "SIGNED AND SEALED BY THE ASSESSOR-COLLECTOR OF TAXES"; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth strives to protect the health, safety, and welfare of its citizens through reasonable exercise of its police powers; and WHEREA5, Article II, Division 4, Section 20-66 and Division 5, Section 20-97 of Chapter 20 of the City Code prescribes that the City Seal and the signature of the Assessor-Collector of Taxes be applied to certain permits; and WHEREAS, the City is in the process of implementing a new system to produce permits issued by the Department of Financial Management Services and seeks to standardize the production of permits to gain efficiency; and WHEREAS, the practice of affixing the City Seal and the signature of the Assessor-Collector of Taxes to permits issued by the Department of Financial Management Services was discontinued at an earlier point using the City's legacy system to pr•oduce permits; and WHEREAS, other similar City permits do not require or cariy the City Seal or any signature; and WHEREAS, staff recommends amending Article II, Division 4, Section 20-66 and Division 5, Section 20-97. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That the second sentence of Chapter 20, At-ticle II, Division 4, Section 20-66 be amended to strike the words "signed and sealed by the assessor-collector of taxes and" that the same words be struck fl�om the second sentence of Chapter 20, Article II Division 5, Section 20-97. S�CTION 2. That this ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (2015), as amended, except where provisions of this ordinance are in direct Ordinance No. 22768-06-2017 Page 1 of 2 conflict with the provisions of such ordinances and such Code, in which the conflicting provisions of sttch ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the ii�tention of the Ciry Council that the sections, paragraphs, sentences, clauses and phr•ases of the ordinance are sevei•able, and if any phrase, clause, sentence, pai•agrapli oi• section of this ordinance shall be declai•ed unconstihitional by the valid judginent or decree of any coui�t of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragrapl�s and sectioiis of this ordinance, since tlle same would have been enacted by tlle City Council �vithout the incorporation in this ordinance of any such unco7�stitutiona) plu�ase, clause, sentence, parag��aph or section. SECTION 4. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of tl�e provisions of the Code of the City of Fort Worth, or any other ordinances of the City, that have accrued at the time ofthe effective date ofthis ardinance; and, as to such accrued violations and al) pending litigation, both civil and criminal, �vhether pending in coui-t or not, under such ordinances, same shal( not be affected by tl�is ordinance, but nlay be prosecuted until final disposition by tlle coui•ts. SECTION 5. The City Secretaiy of the City of Fort Worth is hereby ciirected to engi•oss and enroll this ordinance by copying this caption and effective date in the mintrtes of the City Council and by tiling the ordinance in the ordinance records of the City. Approved on 6/20/2017 -'Ordinance `No. 22768-06 20'17 DATE: Tuesday, June 20, 2017 REFERENCE NO.: **G-19031 LOG NAME: 13AMEND ORDINANCE-POOL HALL AND DANCE HALL PERMITS SUBJECT: Adopt Ordinance Amending Chapter 20, Article II, Division 4, Section 20-66 and Division 5, Section 20-97 of the City Code to Language in Article II that Requires Dance Hall and Pool Hall Permits to be Signed and Sealed by the Assessor-Collector of Taxes (ALL COUNCIL DISTRICTS) RECOMMENDATION: It is recommended that the City Council adopt the attached ordinance to amend Chapter 20, Article II, Division 4, Section 20-66 and Division 5, Section 20-97, of the City's Code of Ordinance to make it consistent with other similar ordinances, longstanding and current practice, and to eliminate redundancies by excluding language requiring Dance Hall and Pool Hall Permits to be signed and sealed by the assessor-collector of taxes. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to remove language in Article II of Chapter 20 of the City Code relating to Dance Hall and Pool Hall Permits that is considered unnecessary and inconsistent with current practice. The City's Department of Financiai Management Services, Revenue Section, issues a variety of City Permits including Dance Hall and Pool Hall Permits. Under the current practice, all permits are produced from the City's legacy financial management system and none of the permits produced have ever been formatted to include a signature or City seal. Article II, contains language requiring Dance Hall and Pool Hall Permits to have the City seal and the signature of the Assessor-Collector of taxes applied to them. There are no distinct or compelling reasons in the Article supporting this differentiation for these two types of permits. As the City prepares to replace its long-serving financial management system used to produce permits with the ERP and point-of-sale systems to improve controls, gain efficiency, and streamline the permitting process, Staff is recommending that the City Council amend the ordinance to repeal the language "signed and sealed by the assessor-collector of taxes" from Dance Hall and Pool Hall permit contents requirements. This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that this will have no material effect on City funds.
