HomeMy WebLinkAboutResolution 2863:._ Resolution No ADOPTING THE SECOND AMENDMENT TO THE CITY OF FORT WORTH'S ANNEXATION PLAN WHEREAS on December 14 1999 the City Council approved Resolution No 2598 adopting an annexation plan for the City of Fort Worth in accordance with Section 43 052 of the Texas Local Government Code, WHEREAS Section 43 052(c) provides that a municipality may amend its annexation plan to identify annexations that may occur beginning on the third anniversary of the date the plan is amended, WHEREAS on July 9 2002 the City Council approved a timetable to consider annexing the areas known as Linkwood Estates and El Rancho Estates for limited purposes, providing for public hearings on August 13 2002 and August 27 2002, and consideration of adoption of an ordinance annexing the areas for limited purposes on September 17 2002, which can be continued for up to 90 days, WHEREAS pursuant to Sections 43 123 and 43 127 of the Texas Local Government Code, an area that is annexed for limited purposes must be annexed for full purposes within three years thereafter WHEREAS the City Council approved Resolution No 2860 on August 13 2002, adopting the first amendment to the City's annexation plan providing that the Linkwood Estates area may be annexed for full purposes beginning on August 13 2005 WHEREAS El Rancho Estates consists of approximately 53 existing residential dwellings on approximately 198 acres located south of I.H. 30 and east of the Lost Creek subdivision and is more specifically described on the map attached as Exhibit A and by the legal. description attached as Exhibit `B WHEREAS El Rancho Estates is exempt from inclusion in the City's annexation plan pursuant to Section 43 052(h)(1) of the Local Government Code because the area has fewer than 100 separate tracts of land with residential dwellings on each tract; WHEREAS despite the statutory exemption, the City Council wishes to include the El Rancho Estates area in the annexation plan so that the full purpose annexation of El Rancho Estates will be conducted according to the same procedure as the full purpose annexation of Linkwood Estates, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: That the City's annexation plan approved on December 14 1999 by the adoption of Resolution No 2598 is hereby amended to include El Rancho Estates as described on attached Exhibits A and `B Further that the annexation of El Rancho Estates for full purposes may occur beginning on the third anniversary of the date of this plan amendment. Pettit Survey Abstract Number 1234 situated about 11 'h irides South 77 degrees West from the Courthouse in Tarrant County Texas, being all of El Rancho Estates, and the right-of ways as shown on the plat thereof being recorded in Volume 388-B Page 265 Plat Records, Tarrant County Texas, and being on the waters of the South Fork of Mary's Creek, and being more particularly described by metes and bounds as follows, BEGINNING• at the northwest corner of El Rancho Dnve as shown on said plat, being in the south Iine of that certain annexation described in Ordinance Number 4849 and being in existing south right-of way of Present U S 80 & 180 according to the `Final R. O W Map of I 30 Project Designator 7010• THENCE. with the present City Limit line, said existing south right-of way of present U S 80 & 180,and the north right-of way of El Rancho Drive, North 89 degrees 37 minutes 45 seconds East, 2655 08 feet, to the northeast corner of El Rancho Dnve, being in the east Iine of said S.H.
