AN ORDINANCE VACATING AND EXTINGUISHING TWO ALLEYS
SITUATED IN BLOCKS 30 AND 38, TUCKER'S ADDITION, CITY OF
FORT WORTH, TARRANT COUNTY, TEXAS, AS SHOWN IN THE PLAT
THEREOF RECORDED IN VOLUME 63, PAGE 124 OF THE PLAT
RECORDS OF TARRANT COUNTY, TEXAS, CONTAINING
APPROXIMATELY 2,000 SQUARE FEET OR 0.00459 AND 3,150 SQUARE
FEET OR 0.0723 ACRE OF LAND MORE OR LESS; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY
SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the following alleys described below:
1. Being a ten foot wide public alley, created by prescription, in Block 30, Tucker's
Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as shown
in the plat thereof recorded in Volume 63, Page 124 of the Plat Records of Tarrant
County, lying between the south right-of-way line of East Cannon, Avenue, a 50
foot wide public street, and the north right-of-way line of East Leuda Street, a fifty
foot wide public street and containing approximately 2,000 square feet or 0.0459
acre of land more or less;
2. Being a ten foot wide public alley, created by prescription, in Block 38, Tucker's
Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as shown
in the plat thereof recorded in Volume 63, Page 124 of the Plat Records of Tarrant
County, lying south of the south right-of-way line of East Leuda Street, a fifty foot

wide public street and the north right-of-way line of East Terrell Avenue, a public
street with a variable width and containing approximately 3,150 square feet or
0.0723 acre of land more or less;
and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated
herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right of way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

A 10 feet wide public alley, apparently created by prescription, in Block 30,
TUCKER'S ADDITION to the City of Fort Worth, Tarrant County, Texas, according to
the plat recorded in Volume 63, Page 124, Plat Records, Tarrant County, Texas,
lying between the south right—of—way line of East Cannon Avenue, a 50 feet wide
public street, and the north right—of—way line of East Leuda Street, a 50 feet wide
public street, and being more particularly described by metes and bounds as
follows:
COMMENCING at the intersection of the south right—of-way line of said East
Cannon Avenue and the west right—of—way of Bryan Avenue, a 50 feet wide public
street;
THENCE West along the north line of said Block 30 and the south right—of—way
line of said East Cannon Avenue, 95.00 feet to a point in the east line of said
alley at the POINT OF BEGINNING;
THENCE South along the east line of said alley, 200.00 feet to a point in north
right—of—way line of said East Leuda Street;
THENCE West along the north right—of—way line of said East Leuda Street, 10,00
feet to a point in the west line of said alley;
THENCE North along the west line of said alley, 200.00 feet to a point in the
south right—of—way line of said East Cannon Avenue;
THENCE East along the south right—of—way line of said East Cannon Avenue, 10.00
feet to the Point of Beginning, and containing 0.0459 acres (2,000 square feet) of
land, more or less.

SUBJECT:
Adopt Ordinance Vacating Alleys in Block 30, Between East Cannon Avenue and East Leuda Street, and
Block 38, Between East Leuda Street and East Terrell Avenue, Tuckers Addition, to be Replatted with the
Adjoining Property to Consolidate the Property for Future Development in the Near Southside (COUNCIL
DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating alleys in Block 30 between East Cannon Avenue and East
Leuda Street and Block 38 between East Leuda Street and East Terrell Avenue, Tuckers Addition to be
replatted with the adjoining property to consolidate the property for future development in the Near
Southside; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Grant Engineering, Inc., on behalf of Linda Claytor, has requested the vacation of these alleys to be
replatted with the adjoining property in order to consolidate the land for sale to a future developer within
the Near Southside. The City Plan Commission recommended approval of these requests at its meetings
on October 28, 2015 and June 24, 2017. An acceptable final plat (FS-16-157) has been received in
accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through platting
process. The City does not possess any fee interest in the right-of-way or own any property adjacent to
the right-of-way and did not expend any City funds to purchase the right-of-way in fee or by easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City
Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), Staff recommends
waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the
alley.
This project is located in COUNCIL DISTRICT 9, Mapsco 77J.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds.
