AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY
SITUATED IN BLOCK 29, TUCKER'S ADDITION, CITY OF FORT
WORTH, TARRANT COUNTY, TEXAS, AS SHOWN IN THE PLAT
THEREOF RECORDED IN VOLUME 63, PAGE 124 OF THE PLAT
RECORDS OF TARRANT COUNTY, TEXAS, CONTAINING
APPROXIMATELY 3,033 SQUARE FEET OR 0.069 ACRE OF LAND
MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID
LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a ten foot wide public alley, created by prescription, in Block 29, Tucker's Addition,
an addition to the City of Fort Worth, Tarrant County, Texas, as shown in the plat thereof
recorded in Volume 63, Page 124 of the Plat Records of Tarrant County, lying south of the south
right-of-way line of East Leuda Street, a fifty foot wide public street and containing
approximately 3,033 square feet or 0.069 acre of land more or less, and as more specifically
described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and
the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right of way is hereby
released and shall revert to the adjacent owner as provided by law.

All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

LEGAL DESCRIPTION
A portion of a 10 feet wide public alley, apparently created by prescription, in
Block 29, TUCKER'S ADDITION to the City of Fort Worth, Tarrant County, Texas,
according to the plat recorded in Volume 63, Page 124, Plat Records, Tarrant
County, Texas, lying south of the south right—of—way line of East Leuda Street, a
50 feet wide public street, and being more particularly described by metes and
bounds as follows:
COMMENCING at the intersection of the south right—of—way line of said East Leuda
Street, and the west right—of—way of Bryan Avenue, a 50 feet wide public street;
THENCE West along the north line of said Block 29 and the south right—of—way
line of said East Leuda Street, 95.00 feet to the northwest corner of Lot 7, of
said Block 29, and in the east line of said alley;
THENCE South along the east line of said alley, 150.00 feet to the POINT OF
BEGINNING;
THENCE South, continuing along the east line of said alley, 153.82 feet to a point
in the north right—of—way line of said East Terrell Avenue, In a non—tangent curve
to the left whose radius bears South 06'37'44" West, 493.55 feet;
THENCE along the north right—of—way line of said East Terrell Avenue, along said
curve to the left, through a central angle of 01'10'03", an arc length of 10.06

SUBJECT:
Adopt Ordinance Vacating an Alley in Block 29, Between East Leuda Street and East Terrell Avenue,
Tuckers Addition, to be Replatted with the Adjoining Property to Consolidate the Property for Future
Development (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating an alley in Block 29, between East Leuda Street and East
Terrell Avenue, Tuckers Addition to be replatted with the adjoining property to consolidate the property for
future development; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Grant Engineering, Inc., on behalf of Linda Claytor, has requested the vacation of this alley to be replatted
with the adjoining property in order to consolidate the land for sale to a future developer. The City Plan
Commission recommended approval of these requests at its meetings on October 28, 2015 and January
25, 2017. An acceptable final plat (FS-16-155) has been received in accordance with the Subdivision
Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through platting
process. The City does not possess any fee interest in the right-of-way or own any property adjacent to
the right-of-way and did not expend any City funds to purchase the right-of-way in fee or by easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City
Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), Staff recommends
waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the
alley.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds.
