HomeMy WebLinkAboutOrdinance 22784-06-2017 ORDINANCE NO. 22784-06-2017 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF EXCESS RIGHT OF WAY OF CRAWFORD STREET, SITUATED IN HEIRS OF JOHN CHILDRESS SURVEY, ABSTRACT NO. 250, BEING PART OF AN UNRECODED PLAT OF DAGGETT'S SECOND ADDITION, AN ADDITION OF THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AND CONTAINING APPROXIMATELY 19629 SQUARE FEET OR 0.037 ACRES OF LAND,PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That an excess portion of Crawford Street right-of-way situated in the Heirs of John Childress Survey, Abstract Number 250, being a part of Daggett's Second Addition, an addition to the City of Fort Worth, Tarrant County Texas in an unrecorded plat in Tarrant County, Texas, and containing 1,629 square feet or 0.037 acres of land, and as more specifically described in Exhibits "A" attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street right-of-way is released and shall revert to the adjacent owner as provided by law. Adopt the attached ordinance vacating a portion of excess right-of-way for Crawford Street, to be replatted with the adjoining property for an extension of the proposed linear park for this new multi-family development in the Near Southside; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Dunaway Associates, on behalf of IREG/SCP FW South Land, LLC, has requested the vacation of this portion of excess right-of-way for Crawford Street to expand the proposed linear park along the new proposed multi-family development in the Near Southside. The City Plan Commission recommended approval of this request at its meeting on May 24, 2017. An acceptable final plat (FP-17-010) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through platting process. The City does not possess any fee interest in the right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way in fee or by easement. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the alley. This project is located in COUNCIL DISTRICT 9, Mapsco 77E. This M&C does not request approval of a contract with a business entity.
