AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
WASHINGTON AVENUE RIGHT OF WAY AND PORTIONS OF TWO
ALLEYS,ALL SITUATED IN THE W.WELCH SURVEY,ABSTRACT NO.
1644, CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AND
CONTAINING APPROXIMATELY 0.2855,0.0138 AND 0.00722 ACRES OF
LAND RESPECTIVELY, AS RECORDED IN VOLUME 63, PAGE 17 OF
THE PLAT RECORDS OF TARRANT COUNTY TEXAS, PROVIDING
FOR THE REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF
EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the following alleys and street described below:
1. Being that portion of Washington Avenue, a 50 foot wide right-of-way, situated
in the W. Welch Survey, Abstract No. 1644, City of Fort Worth, Tarrant
County, Texas, situated in McAnulty & Nesbitt's Subdivision of Block 15
Fields Addition, an addition to the City of Fort Worth, Tarrant County, Texas;
as shown on the plat as recorded in Volume 63, Page 17 of the Plat Records of
Tarrant County, Texas, containing 12,438 square feet (0.2855 acre) of land
more or less;
2. Being that portion of a 12 foot wide alley situated in the W. Welch Survey,
Abstract No.1644, City of Fort Worth, Tarrant County, Texas, located in Block
2, McAnulty & Nesbitt's Subdivision of Block 15 of Fields Addition, an
addition to the City of Fort Worth, Tarrant County, Texas; as shown on the plat
as recorded in Volume 63, Page 17 of the Plat Records of Tarrant County,
Texas, containing 600 square feet (0.0138 acre) of land more or less;
3. Being that portion of a 12 foot wide alley situated in the W. Welch survey,
Abstract No. 1644, City of Fort Worth, Tarrant County, Texas, located in Block
1, McAnulty & Nesbitt's Subdivision of Block 15 fields Addition, an addition
to the City of Fort Worth, Tarrant County, Texas; as shown on the plat recorded
as Volume 63, Page 17 of the Plat Records of Tarrant County,Texas,containing
3,144 square feet (0.0722 acre) of land more or less;

and as more specifically described in Exhibits "A", "B" and "C" attached hereto and
incorporated herein, by reference be and the same are vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described street right-of-way is released and shall
revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

STREET VACATION
BEING a tract of land situated in the W. Welch Survey, Abstract No. 1644, City of Fort
Worth, Tarrant County, Texas and being a portion of Washington Avenue (a 50' right-of-
way) situated in the McAnulty & Nesbitt's Subdivision of Block 15 Fields Addition as
recorded in Volume 63, Page 17 of the Plat Records, Tarrant County, Texas
(P.R.T.C.T.) and being more particularly described as follows;
COMMENCING at an X cut found at the northwest corner clip of a tract of land
described in instrument to the State of Texas as recorded in Volume 13807, Page 39 of
the Deed Records, Tarrant County, Texas (D.R.T.C.T.), said point being on the south
right-of-way line of West Rosedale Street (a variable width right-of-way);
THENCE, along the south line of said State of Texas tract, South 45 degrees 32
minutes 59 seconds East a distance of 19.11 feet to a 518 inch iron rod set with a yellow
plastic cap stamped 'Huitt-Zollars" on the west right-of-way line of the aforementioned
Washington Avenue at the POINT OF BEGINNING;

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating two portions of alleys and a portion of Washington Avenue in
Blocks 1 and 2 McAnulty and Nesbitt's Subdivision of Block 15 Field's Addition between Rosedale Street

future mixed use development in the Near Southside; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Huitt-Zollars, Inc., on behalf of Lang Oleander, LLC, has requested the vacation of these portions of alleys
and a portion of Washington Avenue to be replatted with the adjoining property for a future mixed use
development within the Near Southside. The City Plan Commission recommended approval of these
requests at its meeting on April 26, 2017. An acceptable final plat (FS-1 7-085) has been received in
accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through platting
process. The City does not possess any fee interest in the rights-of-way or own any property adjacent to
the rights-of-way and did not expend any City funds to purchase the right-of-way in fee or by easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City
Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), Staff recommends
waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the
alleys or street.
This project is located in COUNCIL DISTRICT 9, Mapsco 76M.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds.
