Authorize the execution of a contract with Peachtree Construction, Ltd., in the amount of $1,176,955.50 for the Hot Mix Asphaltic Concrete Surface Overlay 2017-10 Project to reconstruct five residential street segments in eligible low- and moderate-income neighborhoods; and 2. Authorize substitution of Action Plan funding years selected in order to achieve project goals. DISCUSSION: On August 4, 2015, Mayor and Council Communication (MSC G-18521) the City Council approved the City's 2015-2016 Annual Action Plan which included $1,201,521.53 in Community Development Block Grant(CDBG)funds for the reconstruction of 10 residential street segments in CDBG-eligible areas of the City. There are CDBG funds left over from prior years' street reconstruction projects, and those funds will be added to the funds approved in this MSC for the project. Available funding will be used to reconstruct 500-699 W. Broadus Street, 5100-5299 Foard Street, 700-999 W. Hammond Street, 400-599 Cartwright Avenue and 3700-3999 Gordon Avenue, the five street segments which ranked highest by T/PW for reconstruction. Due to increased construction costs, the project only includes five street segments rather than the 10 segments originally approved in the 2015-2016 Action Plan. On February 16, 2017 and February 23, 2017, the project was advertised for bid in the Fort Worth Star-Telegram. On March 16, 2017, the following bids were received: Bidders Amount Peachtree Construction, Ltd. $1,176,955.50 LB Contracting, LLC $1,306,823.05 dvanced Paving Acquisition Ltd. $1,336,791.85 Peachtree Construction, Ltd., was the lowest responsible and responsive bidder. i M/WBE Office- Peachtree Construction, Ltd., is in compliance with the City's BDE Ordinance by committing to four percent MBE participation and documenting good faith effort. Peachtree Construction, Ltd. identified several subcontracting and supplier opportunities. However, the MBE's contacted in the areas identified did not respond or did not submit the lowest bids. The City's MBE goal on this project is eight percent. The total amount allocated for this project is $1,336,521.53 and any remaining funds may be used for approved change orders. This funding requires Interdepartmental Letters of Agreement pursuant to applicable laws and regulations governing the use of federal grant funds. The streets recommended for reconstruction are in COUNCIL DISTRICTS 8 and 9, Mapsco 64N, 90C, 90M, 91J and 92K. Perform independent research, investigations,tests,borings, and such other means 29 as may be necessary to gain a complete knowledge of the conditions which will be 30 encountered during the construction of the project. On request, City may provide 31 each Bidder access to the site to conduct such examinations, investigations, 32 explorations,tests and studies as each Bidder deems necessary for submission of a 33 Bid. Bidder must fill all holes and clean up and restore the site to its former 34 conditions upon completion of such explorations, investigations,tests and studies. 35 36 4.1.8. Determine the difficulties of the Work and all attending circumstances affecting the 37 cost of doing the Work,time required for its completion, and obtain all information 38 required to make a proposal.Bidders shall rely exclusively and solely upon their 39 own estimates, investigation,research,tests,explorations, and other data which are 40 necessary for full and complete information upon which the proposal is to be based. 41 It is understood that the submission of a proposal is prima-facie evidence that the 42 Bidder has made the investigation, examinations and tests herein required. Promptly notify City of all conflicts,errors, ambiguities or discrepancies in or 2 between the Contract Documents and such other related documents. The Contractor 3 shall not take advantage of any gross error or omission in the Contract Documents, 4 and the City shall be permitted to make such corrections or interpretations as may 5 be deemed necessary for fulfillment of the intent of the Contract Documents. 6 7 4.2.
