URGING THE REGIONAL TRANSPORTATION COUNCIL TO REAFFIRM ITS POLICY OF
ENDORSING ALL ELIGIBLE TRANSPORTATION ENHANCEMENT GRANT
APPLICATIONS FROM THE DALLAS-FORT WORTH METROPOLITAN AREA
WHEREAS the Transportation Equity Act for the 21St Century (TEA-21) reauthorized the
Surface Transportation Program (STP) and sets aside 10 percent of STP funding for transportation
enhancement (TE) activities and
WHEREAS the Federal Highway Administration has published official guidance for
implementation of transportation enhancement activities under TEA-21 (FHWA Final Guidance
Transportation Enhancement Activities 23 U S C and TEA-21 December 17 1999) and
WHEREAS said official guidance defines
funded TE activities to be included in approl
improvement programs and
12 qualifying TE activity categories and requires
riate metropolitan and statewide transportation
WHEREAS said official guidance provides that `There must be sufficient opportunities for
local communities to take advantage of a variety of TE options Therefore States are encouraged
to avoid combining activity categories where such combinations eliminate the opportunity for fair
and open competition based on the merits of the TE proposals and
WHEREAS the Texas Transportation Commission has adopted state regulations to
implement the TE program in Texas and
WHEREAS for projects within metropolitan areas said state regulations require TE grant
•
applications to include assurances from the pertinent Metropolitan Planning Organization (MPO)
that funded TE projects will be included in the MPO s Transportation Improvement Program (TIP)
and
WHEREAS the Regional Transportation Council (RTC) as the state-designated MPO for
the Dallas-Fort Worth metropolitan area adopted a policy on May 13 1999 for the endorsement of
TE grant applications and
WHEREAS according to said policy the RTC shall include in the Dallas-Fort Worth TIP all
funded TE projects that comply with pertinent federal and state regulations are consistent with the
Metropolitan Transportation Plan and conform with air quality attainment requirements by not
expanding automobile traffic capacity and
WHEREAS the RTC is currently considering various proposed amendments to said policy
including proposed requirements that TE projects serve a direct transportation function and/or
provide an eligible air quality benefit; and
WHEREAS said proposed amendments would effectively limit the range of eligible TE
categories contrary to the intent of TEA-21 as reflected in FHWA s official guidance and
WHEREAS in 2000 the Texas Transportation Commission awarded $194 million in TE
funds statewide of which $33 million was awarded to 31 projects in the Dallas and Fort Worth
districts and
WHEREAS 16 of the 31 Dallas and Fort Worth district projects totaling $16 6 million would
not have been eligible for RTC endorsement if the RTC had required that TE projects serve a
direct transportation function and provide an eligible air quality benefit, as evidenced by the list of
projects in the attached Exhibit A, and
WHEREAS the proposed amendments being considered by the RTC would unnecessarily
restrict the competitiveness of TE grant applications from the Dallas-Fort Worth metropolitan area
and would unnecessarily limit the variety of meritorious projects that might be funded and
WHEREAS the City Council wishes to express support for the RTC s current policy
regarding the endorsement of TE grant applications
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH
That the City Council urges the RTC to reaffirm its policy of endorsing. all TE grant
applications from the Dallas-Fort Worth metropolitan area that comply with pertinent federal
and state regulations are consistent with the Metropolitan Transportation Plan and conform
with air quality attainment requirements by not expanding automobile traffic capacity
2 That the City Council requests the Mayor to transmit copies of this resolution to the Chair
and all members of the RTC and to appropriate staff of the North Central Texas Council of
Governments
