HomeMy WebLinkAboutOrdinance 22813-08-2017ORDINANCE NO. 22813-08-2017 AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED SWORN POSITIONS IN THE POLICE DEPARTMENT BY ADDING TWENTY POSITIONS IN THE CLASSIFICATION OF POLICE OFFICER EFFECTIVE JULY 22, 201'7; PROVIDING A STATEMENT OF PURPOSE AND INTENT; PROVIDING THAT TAIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES AND REPEAL CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 143.021(a), Texas Local Government Code provides that a municipality's governing body shall by ordinance (i) establish the classifications of police officers and (ii) prescribe the number of positions in each classification; and WHEREAS, on November 8, 2016, the City Council adopted Ordinance 22499- 11-2016, which established the Police Department's sworn personnel staffing levels, effective November 8, 2016, as follows: Assistant Chief Deputy Chief Captain Lieutenant Sergeant Corporal/Detective Police Officer Total 3 5 16 48 173 231 1,159 1,635; and WHEREAS, the Police Chief has requested that the City Council increase the number of authorized positions within the existing classification of Police Officer by twenty (20) effective July 22, 2017, to accommodate the graduates of Academy Class 142 and thereafter prescribe the number of authorized positions in the Police Department to conform with the proposed changes as set forth below in order to effect efficient economy of the operations of the Police Department. Ordinance No. 22813-08-2017 Page 1 of 3 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That, following the formal adoption of this ordinance, the following positions shall be the only sworn positions in each classification (rank) authorized in the City of Fort Worth Police Department effective July 22, 2017, until modified by subsequent ordinance: Assistant Chief Deputy Chief Captain Lieutenant Sergeant Corporal/Detective Police Officer Total SECTION 2. 3 5 16 48 173 231 1,179 1,655 That the "Mayor and Council Communication" memorandum, which is presented contemporaneously with this ordinance, is hereby expressly incorporated herein by reference for further clarification and explanation of the purpose and intent of the City Council in its adoption of this ordinance as well as the Department in its implementation. SECTION 3. That this ordinance shall be cumulative of all provisions of previous ordinances and of the Code of the City of Fort Worth, Texas (2015), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior police staffing ordinances for the Police Department and such Code, in which event conflicting Ordinance No. 22813-08-2017 Page 2 of 3 provisions of such ordinances and such code provisions are hereby repealed and this ordinance shall be controlling. SECTION 4. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of these ordinances are severable, and if any pluase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incoiporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. That this ordinance shall be effective July 22, 2017 with respect to the addition of twenty (20) positions in the Police Officer classification, and it is so ordained. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) and the attached ordinance is to increase the number of authorized positions in the classification of Police Officer in the Fort Worth Police Department by a total of twenty (20) in order to have sufficient Police Officer positions for all of the graduates of Fort Worth Police Recruit Class 142, which graduated on July 21, 2017. On July 22, 2017, the forty-five (45) recruits who graduated from Class 142 were commissioned. Under the current staffing ordinance, the Department only projected twenty-five (25) available vacancies for the pay period commencing July 22, 2017. Therefore, the Police Department recommends that the City Council authorize a temporary increase of twenty (20) positions in the Police Officer classification with an effective date of July 22, 2017 to accommodate all of the graduates of Class 142. Because July 22 is the beginning of a pay period and payroll is processed in arrears, adopting the ordinance with an effective date of July 22 for the 20 positions will allow all recruits in Class 142 to be properly classified and paid as of their initial commission date. Class 143, which is currently underway, is also expected to graduate forty-five (45) recruits to be commissioned on September 16, 2017. Although planned retirements and other attrition are expected to result in some vacancies by then, the Department will recommended a similar action in conjunction with the upcoming budget to temporarily accommodate this class. The need to add these positions is a result of the Department not generally carrying vacancies. In an effort to ensure that calls for service are met with optimum response times, the Police Department strives to keep the number of Police Officer vacancies as close to zerb as is reasonably possible. To accomplish this goal, Academy classes are scheduled to correspond with projected vacancies, including retirements and promotions. Recent promotional delays have affected the vacancy rate in the Officer classification. In addition, Class 142 and Class 143 are spaced closer than normal to allow for the ramp up of the Sixth Division. Because the necessary vacancies in the Police Officer classification are not available to accommodate the graduates of Class 142 and Class 143, the Department is seeking to temporarily Logname: 35STAFFING ORDINANCE - OFFICER POSITIONS CLASS 142 AND 143 Page 1 of 3 increase the number of authorized positions in the classification of Police Officer. On November 8, 2016, the City Council adopted its most recent authorized staffing ordinance for the Police Department (Ordinance No. 22499-11-2016), which increased the total number of authorized positions in the classification of Police Officer by twenty-one (21), the number of authorized positions in. the classification of Sergeant by three (3), and the number of authorized positions in the classification of Lieutenant by one (1), prescribing the total number of authorized positions for each classification of sworn personnel and providing for a total of 1,635 civil service positions. This M&C does not request approval of a contract with a business entity.
