HomeMy WebLinkAboutOrdinance 22803-08-2017Ordinance No. 22803-08-2017 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $24,000.00, SUBJECT TO RECEIPT OF FUNDS, FOR ADDITIONAL REIMBURSABLE FUNDS FOR THE POLICE DEPARTMENT'S PARTICIPATION IN THE UNITED STATES MARSHALS SERVICE VIOLENT OFFENDER TASK FORCE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $24,000.00, subject to receipt of funds, for additional reimbursable funds for the Police DepartmenYs participation in the United States Marshals Service Violent Offender Task Force. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 22393-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. For new obligations, please refer to Form USM-607, Joint Law Enforcement Operations Task Force Obligation Document. Joint Law Enforcement Operations partnerships with state and loca( agencies exist under a reimbursable agreement detailed in the Memorandum of Understanding. The United Stakes Marshals Service reserves the right to modify funding as needed and will provide notification of any changes to the JLEO participating agency. SECTION 1: Obligation Number A. Sign the completed Form USM-607A and return to the issuing DistrictJRFTF o�ce. 2. Send an email to the District/RFTF point of contact acknowledging that the agency has received and understo�d the USM-607A. The USMS POC will then print the e-mait and attach to the modification form in lieu of an agency signature. When completed, the form will be returned to the District/RFTF office. Districts are responsible for modifying obligations in UFMS according to tha USM-607A information. RFTF modifications wil( be forwarded to Headquarte►•s IOD to be entered into UFMS. Adopt the attached ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of $24,000.00, subject to receipt of funds, for the purpose of receiving additional reimbursable funds for the Police Department Fugitive Unit's participation in the United States Marshal Service Violent Offender Task Force. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to appropriate additional reimbursable funds that the City has been awarded for the Police Department Fugitive Unit's participation in the United States Marshals Service (USMS) Violent Offender Task Force (Task Force or VOTF). The Fugitive Unit has participated in this USMS Task Force for many years (M&Cs C-24625, C-02556, C- 27111, C-28175 and City Secretary Contract Nos. 41389 and 47968). The program operates pursuant to the Presidential Threat Protection Act of 2000 (Public L. 106544; 28 U.S.C. §566 note), which provides for the establishment of permanent Fugitive Apprehension Task Forces consisting of Federal, State and local law enforcement authorities in designated regions of the United States, to be directed and coordinated by the United States Marshals Service, for the purpose of locating and apprehending fugitives. The City receives asset forFeiture funds from the USMS to reimburse a portion of the City's expenditures associated with participation in the Task Force. Reimbursement is limited to overtime expenses related to the VOTF. The City of Fort Worth is responsible for officer salaries and associated fringe benefits. Indirect expenses are not eligible for reimbursement. On April 11, 2017, the City Council approved M&C C-28175, which authorized continuation of the Memorandum of Understanding (MOU) for Fiscal Year 2017, with an appropriation of $99,703.00 to account for expenses reimbursed during the Fiscal Year. On June 2, 2017, the Police Department received a modification document from the USMS to increase this year's funding by $24,000.00. Adoption of the attached appropriation ordinance will provide capacity to account for the expenses to be reimbursed from the additional funds.
