HomeMy WebLinkAboutOrdinance 22798-08-2017ORDINANCE NO. 22798-OS-2017 AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY SITUATED IN BLOCK 55 OF THECHAMBERLIN ARLINGTON HEIGHTS ADDITION, CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AS SHOWN IN THE PLAT THEREOF RECORDED IN VOLUMENT 63, PAGE 21 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS, CONTAINING APPROXIMATELY 8,008 SQUARE FEET OR 0.184 ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION l. That an alley, situated the in Block 55, Chamberlin Arlington Heights Addition, an addition to the City of Fort Woi�th as shown in the plat thereof recorded in Volume 63, Page 21 of the Plat Records of Tarrant County, and containing approximately 8,008 square feet or 0.184 acre of land more or less, and as more specifically described in Exhibit "A" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated alley right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. Hill with the Adjoining Property in Order to Resolve Existing and Proposed Encroachments by Residential Structures into the Alley Right-of-Way (COUNCIL DISTRICT 7) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached ordinance vacating an alley in Block 55, Chamberlin Arlington Heights Addition, between Halloran Street and Horne Street, to be replatted by Kenneth A. Hill with the adjoining property for additional residential uses; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Carter Surveying and Mapping, on behalf of Kenneth A. Hill, has requested the vacation of this alley to be replatted with the adjoining property in order to resolve existing and proposed encroachments by residential structures into the alley right-of-way. The City Plan Commission recommended approval of this request at its meeting on November 18, 2016. An acceptable final plat (FS-17-092) has been received in accordance with the Subdivision Ordinance. The entire width of the alley was dedicated by the properties to the south of the alley, therefore the entire width will revert to these properties during the platting process. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through platting process. The City does not possess any fee interest in the right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way in fee or by easement. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the alley. This project is located in COUNCIL DISTRICT 7. This M&C does not request approval of a contract with a business entity.
