AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
HALBERT STREET RIGHT OF WAY, SITUATED IN THE SARAH GRAY
JENNINGS SURVEY, ABSTRACT NO. 843, ORIGINAL TOWN OF
HANDLEY, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT
COUNTY, TEXAS, AND CONTAINING APPROXIMATELY 10,654
SQUARE FEET OR 0.2446 ACRES OF LAND, AS RECORDED IN
VOLUME 40, PAGE 51 OF THE DEED RECORDS OF TARRANT
COUNTY TEXAS, PROVIDING FOR THE REVERSION OF FEE IN SAID
LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Halbert Street right of way situated in the Sarah Gray Jennings Survey,
Abstract Number 843, as dedicated by the Original Town of Handley, an addition to the Town of
Handley (annexed by Fort Worth), Tarrant County Texas, as recorded in Volume 40, Page 51 of
the deed records of Tanant County, Texas, and containing, 10,654 square feet or 0.2446 acres of
land, and as more specifically described in Exhibits "A" attached hereto and incorporated herein
by reference, be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described street right-of-way is released and shall
revel�t to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement ai•e relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith ar�e hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

RIGHT-OF-WAY VACATION OF HALBERT STREET METES AND BOUNDS DESCRIPTION
BEING a 0.2446 acre parcel of land situated in the Sarah Gray Jennings Sutvey, Abstract No. 843, Tarrant County, Texas, and
being a portion of the existing right-of-way of Halbert Street (72 foot width), as dedicated by the Original Town of Handley,
an addition to the town of Handley (now annexed by the City of Fort Worth), as recorded in Volume 40, Page 51, Deed
Records of Tarrant County, Texas, said 0.2446 acre parcel of land being more particularly described by metes and bounds as
follows;
COMMENCING at a found 1/2-inch iron rod with yellow cap on the southerly right-of-way line of Rosedale Street (TX-Spur
303) (variable width), being on the east right-of-way line of a 25 foot wide alley as dedicated by said Original Town of
Handley, and being the most northerly corner of Tract A, Texas Electric Service Co. Handley Plant Site, an addition to the City
of Fort Worth, as recorded in Volume 388-C, Page 86, Plat Records of Tarrant County, Texas, and from which a found TxDOT
monument with brass disk on said southerly right-of-way bears North 79 degrees 17 minutes 45 seconds West, a distance of
287.67 feet;
THENCE South 14 degrees 19 minutes 44 seconds West, along the east right-of-way line of said 25 foot wide alley and a west
line of said Tract A, a distance of 334,07 feet to a set 5/8-inch iron rod with cap stamped "DUNAWAY ASSOC. LP" for corner;
THENCE North 75 degrees 55 minutes 03 seconds West, along the south right-of-way line of said 25 foot wide alley and a
north line of said Tract A, a distance of 186,94 feet to a set 5/8-inch iron rod with cap stamped "DUNAWAY ASSOC. LP" for
corner on an east line of Blocl< One, Texas Electric Service Co. Handley Plant Site Second Filing, an addition to the City of Fort
Worth, as recorded in Volume 388-25, Page 41, Plat Records of Tarrant County, Texas;
THENCE North 14 degrees 24 minutes 57 seconds East, along an east line of said Blocl< One, a distance of 25.00 feet to a set
5/8-inch iron rod with cap stamped "DUNAWAY ASSOC. LP" for the POINT OF BEGINNING at the intersection of the north
right-of-way line of said 25 foot wide alley with the east right-of-way line of said Halbert Street;
THENCE North 75 degrees 35 minutes 03 seconds West, along a northerly line of said Block One and the southerly
right-of-way line of said Halbert Street, a distance of 72.00 feet to a set 5/8-inch iron rod with cap stamped "DUNAWAY
ASSOC. LP" for corner on the west right-of-way line of said Halbert Street;
THENCE North 14 degrees 24 minutes 57 seconds East, along an easterly line of said Block One and the west right-of-way line
of said Halbert Street, a distance oP 147.98 feet to a set 5/8-inch iron rod with cap for corner;
THENCE South 75 degrees 35 minutes 03 seconds East, crossing the right-of-way of said Halbert Street, a dfstance of 72.00
feet to a point for corner on the east right-of-way line of said Halbert Street and the west line of Block 24, of said Original
Town of Handley;
THENCE South 14 degrees 24 minutes 57 seconds West, along the east right-of-way line of said Halbert Street and the west
line of said Block 24, a distance of 147.98 feet to the POINT OF BEGINNING and containing 0.2446 acres (or 10,654 square
feet) of land, more or less.

Adopt Ordinance Vacating a Portion of Halbert Street, Between the Texas Electric Service Company
Handley Plant Site and the Historic Handley Cemetery, to be Replatted by Oncor with the Adjoining
Property for a New Parking Lot (COUNCIL DISTRICT 5)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of Halbert Street between the Texas Electric Service
Company Handley Plant Site and the Historic Handley Cemetery, to be replatted by Oncor with the
adjoining property for a new parking lot; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Dunaway Associates, on behalf of Oncor, has requested the vacation of this portion of Halbert Street to be
replatted with the adjoining property for a new parking lot. The City Plan Commission recommended
approval of this request at its meeting on March 22, 2017. An acceptable final plat (FS-17-037) has been
received in accordance with the Subdivision Ordinance. The City Plan Commission granted a waiver to
allow only the west half of Halbert Street to be replatted with the adjoining property.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through platting
process. The City does not possess any fee interest in the right-of-way or own any property adjacent to
the right-of-way and did not expend any City funds to purchase the right-of-way in fee or by easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City
Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), Staff recommends
waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the
street.
This project is located in COUNCIL DISTRICT 5.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds.
