HomeMy WebLinkAboutOrdinance 22824-08-2017 ORDINANCE NO. 22824-08-2017 AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF TWO ALLEYS AND PORTIONS OF MYRTLE STREET, SITUATED IN THE BELLEVUE HILL ADDITION AND BROOKS AND BAILEYS SUBDIVISION, FORT WORTH, TARRANT COUNTY, TEXAS AS SHOWN ON THE PLATS RECORDED IN VOLUME 35, PAGE 243 AND VOLUME 32, PAGE 431 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following alleys and streets described below: 1. Being that portion of a fifteen foot wide alley right-of-way, situated B1ockA1, Bellevue Hill Addition, an addition to the City of Fort Worth, Tarrant County Texas; being as shown on the plat as recorded in Volume 35, Page 243 of the Deed Records of Tarrant County, Texas, containing 3,086 square feet of land more or less; 2. Being portion of a twelve foot wide alley, situated in Block 4, Brooks and Baileys Subdivision, a subdivision to the City of Fort Worth, Tarrant County Texas; being as shown on the plat as recorded in Volume 32, Page 431 of the Deed Records of Tarrant County, Texas, containing 4,200 square feet of land more or less; 3. Being that portion of W Myrtle Street, a forty foot wide right of way, situated in the Bellevue Hill Addition, an addition to the City of Fort Worth, Tarrant County Texas and the Brooks and Baileys Subdivision,a subdivision to the City of Fort Worth, Tarrant County, Texas; being as shown on the plats recorded in Volume 35,Page 243 and Volume 32, Page 431 of the Deed Records of Tarrant County, Texas, containing 8,330 square feet of land more or less and as more specifically described in Exhibits "A" through "F" attached hereto and incorporated herein, by reference be and the same are vacated and extinguished. That the easements to the lands in the above-described vacated alleys rights-of-way are hereby released and shall revert to the adjacent owner as provided by law whereupon the easements shall be automatically extinguished. SECTION 3. That all existing utility easements in the alley rights of way shall be retained by the City until such time all utilities located in the easements are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Adopt the attached ordinance vacating a portion of Myrtle Street between College Avenue and Alston Avenue, an alley between Myrtle Street and Morphy Street and an alley Between College Avenue and Alston Avenue, to be replatted with the adjoining property for additions to De Zavala Elementary School; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: MJ Thomas Engineering, LLC, on behalf of Fort Worth ISD, has requested the vacation this portion of Myrtle Street and the two alleys to be replatted with the adjoining property for additions to De Zavala Elementary School. The City Plan Commission recommended approval of this request at its meeting on May 24, 2017. An acceptable final plat (FS-16-063) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through platting process. The City does not possess any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the rights-of-way in fee or by easement.
