AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
TWO ALLEYS LOCATED BETWEEN DICKSON STREET AND
WAGGOMAN STREET AND PORTIONS OF LIVINGSTON AVENUE,
STANLEY AVENUE AND DICKSON STREET SITUATED IN BLOCKS
10, 11 AND 12 OF THE UNIVERSITY HILL ADDITION; BLOCK 21,
HOMELAND ADDITION AND BLOCK 2, WIESENBERGER ADDITION
#3, ADDITIONS TO THE CITY OF FORT WORTH AS RECORDED IN
THE DEED AND PLAT RECORDS OF TA.~'12RANT COUNTY, TEXAS;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the following alleys and streets described below:
1. A portion of a 15 foot wide alley situated between Block 21, Homeland
Addition and Block 12, University Hill Addition, additions to the City of Fort
Worth according to a plats recorded in Volume 388, pages 13 and 28 of the
Plat Records of Tarrant County, Texas, containing 6,244 of land more or less
and lying between Dickson Street and Waggoman Street;
2. A portion of Livingston Avenue, situated between Blocks 11 and 12,
University Hill Addition, an addition to the City of Fort Worth as recorded in
Volume 388, Page 28 of the Plat Records of Tarrant County, Texas, and
containing 11,685 square feet of land more or less;
3. A portion of a 12 foot wide alley situated in Block 11, University Hill
Addition, and addition to the City of Fort Worth as recorded in Volume 388,
page 28 of the Plat Records of Tarrant County, Texas, containing 2,817 square
feet of land more or less and lying between Dickson Street and Waggoman
Street;
4. A portion of Stanley Avenue situated between Blocks 10 and 11, University
Hill Addition, an addition to the City of Fort Worth a recorded in Volume
1
388, Page 28 of the Plat Records of Tarrant County, Texas, and containing
11,780 square feet of land more or less;
5. A portion of Dickson Street situated between Blocks 10,11 and 12, University
Hill Addition, an addition to the City of Fort Worth as recorded in
Volume388, Page 28 of the Plat Records of Tarrant County and Block 2,
Wiesenberger Addition #3, an addition to the City of Fort Worth as recorded
in Volume 1744, Page 39 of the Deed Records of Tarrant County, Texas and
that certain tract of land as conveyed to the City of Fort Worth by deed
recorded in Volume 1584, page 396 of the Deed Records of Tarrant County,
Texas and containing 17,550 square feet of land more or less; and
6. A portion of Stanley Avenue situated between Block 2, Wiesenberger
Addition #3, an addition to the City of Fort Worth as recorded in
Volurnel744, Page 39 of the Deed Records of Tarrant County, Texas and that
certain tract of land conveyed to the City of Fort Worth by deed recorded in
Volume 1584, page 396 of the Deed Records of Tarrant County, Texas and
containing 7,000 square feet of land more or less;
and as more specifically described in Exhibits "A" and "B" attached hereto and
incorporated herein, by reference be and the same are vacated and extinguished.
SECTION 2.
That the fee to the lands in the above-described vacated alleys and streets are hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in the easements are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.

SECTION 5.
That this ordinance shall take effect upon adoption.

County, Texas and Block I2, University Hill Addition according to plat zecorded in Volume 388, Page 28,
Plat Records, Tarrant County, Texas and all that portion of said alley.that lies west of that certain tract of

Avenue situated between Blocks 11 and I2, University Hill Addition according to plat xecorded in Volume
388, Page 28, Plat Records, Tarrant County, Texas from the existing most northerly south right-of-way
line of Dickson Street to' the north Iine of that certain tract of land as conveyed to the City of Fort Worth
by deed recorded in Volume IS84, Page 396, Deed Records, Tarrant County, Texas and containing I1,68S
square feet of land, more or less.
RO.W. VACATED PARCEL 3) Being all of the called 12.0 foot alley right-of-way situated in Block 11,
University Hill Addition according to plat recorded in Volume 388, Page 28, Plat Records, Tarrant
County, Texas from the existing most northerly south. right-of-way liue of Dickson Street to the nartlz line
of that certain tract of land as conveyed to the City of Fart Worth by deed recorded in Volume 1584, Page
396, Deed Records, Tarrant county, Texas and containing 2,81 square. feet of Iand, more or less.
RO.~'. VACATED PARCEL 4) Being all of that called SOA foot right-of-way portion of Stanley
Avenue situated between Blocks 10 and 11, University Hill Addition according to plat recorded in Volume
388, Page 28, Plat Records, Tarrant County, Texas from the existing most northerly south right-of-way
line of Dickson Street to the mast southerly north right-of--way line of Dickson Street according to plat of
Wiesenberger Addition #3 recorded in Volume 1744 ,Page 39, Deed Records, Tarrant County, Texas and
containing 11,780 square feet of land, more or less.
RO.W. VACATED PARCEL 6) Being all of that called 30.0 foot right-af way portion of Dickson Street

SUBJECT:
Adopt an Ordinance Vacating Portions of Two Alleys and Portions of Three Streets, Livingston
Avenue, Stanley Avenue, Dickson Street, Containing Approximately 1.31 Acres of Land, Located
within Blocks 10, 11 and 12, University Hill Addition, Block 21 Homeland Addition and Block 2,
Weisenberger Addition No. 3, in the City of Fort Worth, Tarrant County, Texas
RECOMMENDATION:
It is recommended that the City Council adopt an ordinance vacating:
1. A portion of an alley 15 feet wide, between Block 12, University Hill Addition and Block 21, Homeland
Addition, containing approximately 0.14 acres of land;
2. A portion of Livingston Avenue, 50 feet wide, located between Blocks 11 and 12, University Hill Addition,
containing approximately 0.27 acres of land;
3. A portion of an alley 12 feet wide, within Block 11, University Hill Addition, containing approximately 0.06
acres of land;
4. A portion of Stanley Avenue, 50 feet wide, located between Blocks 10 and 11, University Hill Addition,
containing approximately 0.27 acres of land;
5. A portion of Dickson Street, 30 feet wide, located adjacent to Blocks 10, 11 and 12, University Hill
Addition, and Block 2 Wiesenberger Addition No. 3, containing approximately 0.40 acres of land; and
6. Another portion of Stanley Avenue, 50 feet wide, located adjacent to Block 2, Wiesenberger Addition No.
3, containing approximately 0.16 acres of land, in the City of Fort Worth, Texas.
DISCUSSION:
The City of Fort Worth Water Department has requested to vacate the above unimproved rights-of-way and
to replat and incorporate them within the adjoining property. The applicant plans to use the area to construct
a new water storage tank and distribution facilities for the Southside Pump Station. The City Plan
Commission recommended approval of this request at its meeting on October 24, 2007. An acceptable
replat (FS-07-195) has been received. Any existing utilities will be relocated at the applicant's expense, or
retained within a designated easement, along with an appropriate plat note that no permanent structures
may be constructed or placed thereon.
This request is located in COUNCIL DISTRICT 9.
