URGING THE TEXAS MUNICIPAL LEAGUE TO ADOPT LEGISLATION THAT
WOULD CREATE ALTERNATIVE METHODS TO COLLECT LIENS
WHEREAS cities are often called upon to remediate or abate properties associated
with tall weeds and substandard vacant property where the owners have failed to take the
required actions to keep their properties in line with City regulations and
WHEREAS, cities attempt to bill and collect from these property owners for these
services and
WHEREAS, if a property owner fails to pay these bills for City enforced abatement
services such as mowing demolitions or board ups alien is placed on the property at the
county level and
WHEREAS other states have implemented state laws that allow for cities that
assess liens for unpaid abatement services to also file a tax lien with the county i,f the
abatement bill remains unpaid and
WHEREAS in those states a tax lien once filed with the county becomes part of
the property tax bill and
WHEREAS in order for property owners to stay current on his or her property
taxes due the abatement bills would have to be paid and
WHEREAS, it would be beneficial for Texas cities to implement a similar law to
give cities the tools to collect from property owners that fail to address code violations on
their properties that are subsequently abated by the city
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH
That the City of Fort Worth urges the Texas Municipal League to support a constitutional
amendment and enabling legislation that would allow cities the ability to collect
abatement liens and would provide for legal authority that makes the lien part of the
property tax bill assessed on the property C~TY C®V~~
