HomeMy WebLinkAboutResolution 3989-05-2011 A Resolution NO. 3989-05-2011 A RESOLUTION AUTHORIZING THE EXECUTION OF A LOCAL PROJECT ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR PRELIMINARY ENGINERING, RIGHT-OF-WAY, UTILITIES AND CONSTRUCTION OF THE LITSEY ROAD WIDENING FROM 2- LANES TO 4-LANES DIVIDED FROM INDEPENDENCE PARKWAY TO CLEVELAND-GIBBS ROAD AS A MAJOR ARTERIAL WHEREAS, the State has received money from the North Texas Tollway Authority for the right to develop, finance, design, construct, operate, and maintain the SH 121 toll project from Business SH 121 in Denton County to US 75 in Collin County("SH 121 payments"); and WHEREAS, pursuant to Transportation Code, 228.006 the State shall authorize the use of surplus revenue of a toll project for a transportation project, highway project, or air quality project within the district of the Texas Department of Transportation in which any part of the toll project is located; pursuant to Transportation Code, §228.012 the State has created a separate subaccount in the state highway fund to hold such money (SH 121 Subaccount), and the State shall hold such money in trust for the benefit of the region in which a project is located, and may assign the responsibility for allocating money in the subaccount to a metropolitan planning organization(MPO); and WHEREAS, in Minute Order 110727, dated October 26, 2006, the Texas Transportation Commission (the"Commission")approved a memorandum of understanding(MOU)with the Regional Transportation Council (RTC), which is the transportation policy body of the North Central Texas Council of Governments (NCTCOG) and a federally designated MPO, concerning in part the administration, sharing, and use of surplus toll revenue in the region; under the MOU the RTC shall select projects to be financed using surplus revenue from a toll project, subject to Commission concurrence; and WHERREAS, the City of Fort Worth identified the need to widen Litsey Road from a 2 lanes rural section to a 4 lane divided arterial from Independence Parkway to Cleveland-Gibbs Road; and WHERREAS, on July 31, 2007, the City Council approved Resolution 3507-07-2007 authorized submittal of selected projects for funding consideration under the SH 121 payment CDA Funding Initiative call- for-projects, which included the widening of Litsey Road from Independence Parkway to Cleveland-Gibbs Road; and WHEREAS, the Regional Transportation Council of the North Central Texas Council of Governments selected the widen Litsey Road from 2 lanes to 4 lanes divided from Independence Parkway to Cleveland-Gibbs Road; and d-L-r FORTWORTH Resolution No. 3989-05-2011 WHEREAS, the City of Fort Worth desires to enter into a Local Project Advance Funding Agreement with the Texas Department of Transportation for the City of Fort Worth to conduct preliminary engineering, right-of-way, utilities and construction of Litsey Road widening from 2- lanes to 4-lanes from Independence Parkway to Cleveland Gibbs Road; and NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH Authorizes the City Manager to execute a Local Transportation Project Advance Funding Agreement (LPAFA) with the Texas Department of Transportation for the City of Fort Worth to conduct preliminary engineering, right-of-way, utilities and construction of Litsey Road widening from 2-lanes to 4-lanes between Independence Parkway and Cleveland Gibbs Road. Adopt the attached resolution authorizing the City Manager to execute a funding agreement in the amount of$8,000,000.00 with the Texas Department of Transportation for engineering, right-of-way, utilities and construction of Litsey Road widening from two-lanes to four-lanes divided between Independence Parkway and Cleveland Gibbs Road; 2. Approve the transfer of$1,600,000.00 from the Street Improvement 2008 Fund to the Grant Capital Project Fund towards the City's match; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grant Capital Projects Fund in the amount of$8,000,000.00; and 4. Authorize an Engineering Services Agreement in the amount of$358,700.00 with Halff Associates, Inc., for the design of Litsey Road from Independence Parkway to Cleveland Gibbs Road. DISCUSSION: Litsey Road from Independence Parkway to Gibbs Road is a major arterial on the City's Master Thoroughfare Plan and through this project it will be widened from two-lanes to four-lanes. The one lane bridge on this section of Litsey Road was closed in April 2007 due to severe deterioration (M&C G-15671, April 10, 2007). The bridge has recently been reconstructed to four lanes with a temporary two-lane approach roadway by Texas Department of Transportation (TxDOT)under agreement with Denton County. The City's participation in this overall improvement effort with Denton County is to provide the permanent roadway through construction of a four-lane facility (M&C C-22445, October 16, 2007). The attached resolution authorizes a funding agreement with TxDOT in the amount of$8,000,000.00 that includes $6,400,000.00 in the Federal funds and $1,600,000.00 in City local match funds. Funding for the local match is available in the 2008 Street Improvement Fund. In addition, an engineering services agreement is included with Halff Associates, Inc., in the amount of$358,700.00 for design and construction support services. The City's goal on this project is 26 percent. This project is located in COUNCIL DISTRICT 2, Mapsco pages 8D and 9A. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Grant Capital Project Fund.
