AN ORDINANCE DECREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF
$1,237,500.00 TO REFLECT THE ACCEPTANCE OF A PERPETUAL
EASEMENT IN LIEU OF A CASH DONATION AS THE SOURCE OF A
PORTION OF THE MATCHING FL7NDS FOR THE 2004 TEXAS PARKS AND
WILDLIFE REGIONAL PARK GRANT FOR THE PURPOSE OF FUNDING
THE DEVELOPMENT OF RECREATIONAL FACILITIES AND ECOSYSTEM
RESTORATION 1N THE AREA OF THE GATEWAY PARK TRINITY RIVER
OXBOW; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES 1N CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Ordinance Number 15821, adopted on January 13, 2004, appropriated
$4,500,000.00 in the Grants Fund upon receipt of a grant from the Texas Parks and
Wildlife Department for the purpose of funding the development of recreational facilities
and ecosystem restoration in the area of the Gateway Parlc Trinity River Oxbow; and
WHEREAS, the Trinity River Water District planned to provide a cash donation in
the amount of $1,237,500.00 for a pol�tion of the City's local matching funds; and
WHEREAS, the Trinity River Water District granted the City a perpetual easement
valued at $1,237,500.00 in lieu of the cash donation; and
WHEREAS, this Ordinance is necessary to reflect a change in the source of the
$1,237,500.00 in local matching funds from a cash connibution to a land donation in the
for7n of a peipetual easement.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments in the Budget of the
City Manager, there shall also be decreased estimated receipts and appropriations in the Grants
Fund in the amount of $1,237,500.00 to reflect the acceptance of a peipetual easement in lieu of a
cash donation as the source of a portion of the matching funds for the 2004 Texas Parks and
Wildlife Regional Park Grant.
SECTION 2.
That should any poi�tion, section or part of a section of this ordinance be declared invalid,
inoperative or void foi• any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way iinpair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of all other ordinances and appropriations effecting and
amending the Grant Fund budget except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall talce effect upon adoption.

Adopt Appropriation Ordinance Decreasing Estimated Receipts and Appropriations in the Grants Fund in

Donation as the Source of a Portion of the Matching Funds for the 2004 Texas Parks and Wildlife Regional
Park Grant for the Development of Recreational Facilities and Ecosystem Restoration for the Trinity River
Oxbow at Gateway Park (COUNCIL DISTRICT 4)
RECOMMENDATION:
It is recommended that the City Council adopt the attached appropriation ordinance decreasing the
estimated receipts and appropriations in the Grants Fund in the amount of $1,237,500.00 to reflect the
acceptance of a perpetual easement in lieu of a cash donation as the source of a portion of the matching
funds for the 2004 Parks and Wildlife Regional Park Grant for the development of recreational facilities
and ecosystem restoration for the Trinity River Oxbow at Gateway Park.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to reflect a change in a portion of the
matching funds for the 2004 Texas Parks and Wildlife Regional Park Grant from a cash donation to the
acceptance of a perpetual easement valued at $1,237,500.00.
On May 14, 2002, (M&C G-13624), the City Council adopted the updated Gateway Park Master Plan. The
Master Plan included the potential joint venture to develop recreational and ecosystem restoration facilities
in the area of the Trinity River Oxbow at Gateway Park.
The Texas Parks and Wildlife Recreation Grants Branch administers the Regional Grants Program under
the Texas Recreation and Parks Account (TRPA) to assist with the acquisition and development of multi-
jurisdictional public recreation areas and facilities serving metropolitan communities throughout the State
of Texas. The program provides 50 percent matching funds as reimbursement grants to eligible local
governments for both active recreation and conservation opportunities. The Parks and Wildlife
Commission awards grants yearly when funds are available.
On January 13, 2004, (M&C G-14221), the City Council authorized the resubmission application and
acceptance of an application for a 2004 Texas Parks and Wildlife Grant to fund land acquisition,
recreational facilities, and ecosystem restoration in the area of the Trinity River Oxbow at Gateway
Park. As part of the grant, the City is required to contribute $2,500,000.00 in local matching funds. It was
originally anticipated that the Tarrant Regional Water District (TRWD) would make a cash donation in the
amount of $1,237,500.00 for a portion of the City's matching funds. In lieu of the cash donation, the
TRWD granted the City a perpetual easement valued at $1,237,500.00. Texas Parks and Wildlife has
approved this substitution.
The Trinity River Oxbow area is currently under construction. Upon completion of the Trinity River Oxbow

area construction, the Park and Recreation Department will bring forth an M&C recommending that the
property be officially dedicated as Parkland.
Gateway Park is located in COUNCIL DISTRICT 4.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon adoption of the above recommendation, appropriations will be
adjusted in the current capital budget of the Grants Capital Project State Fund to reflect the donation of a
perpetual easement.
